MAYOR Austin, Texas, January 7, 1943 The City Council convened in regular session, at the regular meeting place in the Council Chamber at the Municipal Building, on Thursday, January 7, 1943, at 10:45 A. M., with Mayor Tom Miller presiding. Roll call showed the following members presents Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; absent, Councilman Wolf. There were present also: Walter E. Seaholm, Acting City Manager; J. E. Motheral, City Engineer; Gibson R. Randle, Acting City Attorney; and R. D. Thorp, Chief of Police. The Minutes of the Recessed Meeting of December 23, and the Regular Meeting of December 24, 1942, were road, and upon motion of Councilman Bartholomew, were adopted as read by the following votes "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. The appeal of C. B. Sima on his application for a taxicab driver'a permit, which had been recommended for denial, was heard. No action was taken on the matter. The application of James Johnson Hopkins, Route 2, Box 4204, for a taxicab driver's permit, duly approved by the Acting City Manager, et al., was submitted. Councilman Alford moved that the permit be granted. The motion prevailed by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf shsent. The application of Arnold Upshaw, colored, 1309 East 13th Street, for a taxicab driver's permit, duly approved by the Acting City Manager, et al., was submitted. Councilman Alford moved that the permit be granted. The motion prevailed by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. 101 102 The application of Shelton Eugene Ayers, 504 Oakland Avenue, for a taxicab driver's permit, duly approved by the Acting City Manager, et al., was submitted. Councilman Alford moved that the application be granted. The application of Moses Sampson, Jr., colored, 2204 Bryant Street, for a taxicab driver'a permit, duly approved by the Acting City Manager, et al., was submitted. Councilman Alford moved that the permit be granted. The motion prevailed by the following vote: "ayen," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. The application of Anthony Boonai, 304 Congress Avenue, for a license to operate as a taxicab a 5-passenger Mercury Sedan, 1940 Model, Factory Motor No. 188933, State License No. N21-526, duly approved by the Acting City Manager, et al., was submitted. Councilman Gillis moved that the license be granted. The application of Oscar Ira Leach, 300 Congress Avenue, for a license to operate as a taxicab a 4-door Chevrolet 1940 Model, Motor No. 2718400, State License No. 187-797, duly approved by the Aoting City Manager, et al., was submitted. Councilman Gi11is moved that the license be granted. Shackles, colored, 1709 East 12th Street, for a license to operate as a taxicab a 2-door DeLuxe Sedan, Motor No. 4610300, State License No. 122-666, 1938 Model Ford, duly approved by the Acting City Manager, et al., was submitted. Councilman 0111is moved that the license be granted. The motion prevailed by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. The following applications for licenses to operate private boats were submitted: Name and Address of Applicant Purdy, William H. 1906 Matthewa Street - Van der Veer, W. R.- 809 Leonard Street Description of Boat Home-made, Cabin Crusier, 1942 Model, "Levihthan, Jr." 10-passenger Redhead, Sail, 4 years old, 4-passenger Councilman Bartholomew moved that the applications be approved, subject to approval of the Lake Austin Navigation Board. The motion prevailed by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. The following resolution was introduced by Councilman Alford: (RESOLUTION) WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed location of its gan maing in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be, and the same in hereby, permitted to lay and constrict its gas mains in and upon the following streetst A gas main in EAST 30TH STREET, from a point 178 feet east of Dancy Street easterly to La Fayette Avenue, the centerline of which gas main shall be 7.5 feet north of, and par- allel to, the south property line of said East 30th Street. Said gas main described above shall have a covering of notless than 2 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas maine, including the excavation in the streets and the restoration and maintenance of said streets after said maine have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Upon motion of Councilman Alford, the foregoing resolution was adopted by the following votet "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. Councilman Bartholomew introduced the following ordinancer AN ORDINANCE AMENDING THAT CERTAIN ORDINANCE ENTITLED "AN ORDINANCE REGULATING TRAFFIC UPON THE PUBLIC STREETS OF THE CITY OF AUSTIN, PRESCRIBING PENALTIES FOR THE VIOLATION OF SAME, REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY, WHICH SAID ORDINANCE WAS PASSED BY THE CITY COUNCIL OF THE CITY OF AUSTIN MAY 6, 1937, AND RECORDED IN BOOK "K", PAGES 159-179, INCLUSIVE, OF THE ORDINANCE RECORDS OF THE CITY OF AUSTIN, TEXAS, BY AMENDING SECTION 49-A OF SAID ORDINANCE, REGU LATING THE SPEED OF AMBULANCES, WHICH SECTION 49-A WAS ADDED TO THE AFORESAID ORDINANCE BY AMENDMENT PASSED BY THE CITY COUNCIL APRIL 13, 1939, AND RECORDED IN BOOK "K", PAGES 497-500 OF THE ORDINANCE RECORDS OF SAID CITY; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY, The Ordinance was read the first time and Councilman Bartholomew moved that the rules be suspended and the Ordinance be passed to its necond reading. The Ordinance was then read the second time and Councilman Bartholomew moved a further suspension of the rules and the placing of the Ordinance on its third reading. The Ordinance was then read the third time and Councilman Bartholomew moved that the Ordinance be finally passed. The following ordinance was introduced by Councilman Alfords AN ORDINANCE AMENDING THAT CERTAIN ORDINANCE ENTITLED "AN ORDINANCE REGULATING THE OPERATION OF TAXICARS AND TAXICAB DRIVERS IN THE CITY OF AUSTIN UNDER THE Director OF PUBLIC Safety, PRESCRIBING LICENSE FEES FOR TAXICABS AND DRIVERS THEREOF: LICENSING AND REGULATING TAXICAR TERMINAL OPERATORS; PRESCRIBING PENALTIES FOR THE VIOLATION OF THE ORDINANCE; PROVIDING A SAVING CLAUSE; REPEALING CONFLICTING ORDINANCES, EXCEPTING CERTAIN JITNEY ORDINANCES; AND DECLARING AN EMERGENCY," WHICH ORDINANCE WAS PASSED BY THE CITY COUNCIL OF THE CITY OF AUSTIN DECEMBER 15, 1938, AND IS RECORDED IN BOOK "K", PAGES 440-452, OF THE ORDINANCE RECORDS OF THE CITY OF AUSTIN, BY AMENDING SECTION 13. SUBSECTION (a) (8) RELATING TO THE LICENSE FEE FOR TAXICAB DRIVERS, AND SECTION 20 RELATING TO THE EXPIRATION DATE OF TAXICAB DRIVERS LICENSES, BOTH OF WHICH SECTIONS WERE AMENDED BY AN ORDINANCE PASSED MAY 11, 1939, AND RECORDED AT BOOK "K", PAGES 512-514; AND DECLARING AN EMERGENCY. 103 104 The Ordinance wan read the first time and Councilman Alford moved that the rulen be ausponded and the Ordinance be passed to its second reading. The motion was seconded by Councilman Gillim, and the same prevailed by the following vote: "ayen," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. The Ordinance was read the second time and Councilman Alford moved that the rules be further suspended and the Ordinance be passed to its third reading. In compliance with a request of the USO, as submitted by the Acting City Manager, it was the sense of the Council that, upon completion of repairs to the building on East 5th Street to he used as a USO Center, three parking meters in front of said building be removed. The following resolution was introduced: (RESOLUTION) WHEREAS, City of Austin taxes were assessed in the name of Sam Work, Jr., for the years 1935 through 1941 on Lots 40 and 41, Block A, Barton Heights, and for the years 1938, 1939, and 1940, on personal property, all in the City of Austin, Travis County, Texas, said taxes being for the sum of $22.08, and for non-payment of same at maturity, penalty in the sum of $1.10 has been assessed, and interest in the sum of $3.24, making the total amount of taxes, penalty, and interest, $26.42; and WHEREAS, The City Council of the City of Austin deems it just and equitable to remit said penalty in the sum of $1.10, and one-half of the interest in the sum of $1.62; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the aforesaid penalty in the sum of $1.10, and one-half of the interest in the sum of $1.62, are hereby remitted; and the Tax Assessor and Collector of the City of Austin is authorized and directed to charge said penalty in the sum of $1.10 and one-half of the interest in the sum of $1.62 off his rolls, and to issue to the party entitled to receive same a receipt in full upon the payment of said taxes and one-half of the interest, as aforesaid. Upon motion, the foregoing resolution was adopted by the following vote: "ayee," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. The following resolution was introducedt (RESOLUTION) WHEREAS, City of Austin taxes were assessed in the name of Foster Rankin for the years 1931 through 1938 on Lot 4, Block 3, Outlot 18, Division "O", and for the year 1937 and 1938 on Lot 5, Block 3, Outlot 18, Division "O", and for the years 1937 and 1938 on personal property, all in the City of Austin, Travis County, Texas, said taxen being for the sum of $274.00, and for non-payment of same at maturity, penalty in the sum of $13.70 has been assessed, and interest in the sum of $107.06, making the total amount of taxes, penalty and interest, $394.76; and WHEREAS, The City Council of the City of Austin deems it just and equitable to remit said penalty in the sum of $13.70 and one-half of the interest in the sum of $53.53; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the aforesaid penalty in the sum of $13.70 and one-half of the interest, in the sum of $53.53, are hereby remitted, and the Tax Assessor and Collector of the City of Austin is authorized and directed to charge said penalty in the sum of $13.70 and one-half of the interest in the sum of $53.53 off his rolls, and to issue to the party entitled to receive name a receipt in full upon the payment of said taxes and one-half of the interest, ne aforesaid.
