MAYOR Austin, Texas, Jamuary 28, 1943 The City Council convened in regular session, at the regular meeting place in the Council Chamber in the Municipal Building, on Thursday, January 28, 1943, at 11:00 A. M., with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen Alford, Bartholomew, Gillig, and Mayor Miller; absent, Councilman Wolf. There wore present also: Walter E. Seaholm, Acting City Manager: J. E. Motheral, City Engineer: Gibson R. Randle, Acting City Attorney; and H. D. Thorp, Chief of Police. The Minutes of the regular meeting of January 21, 1943, were read, and upon motion of Councilman Bartholomew, were adopted an read by the following vote: "nyes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. The following application for license to operate a private boat was submitted: Name and Address of Applicant Richardson, Koet - Description of Bont Cyprenn, Skiff, 1940 Model, Evinrude, b-pannenger Councilman Bartholomew moved that the application be approved, subject to approval of the Lako Austin Navigation Board. The motion provoiled by the following vote: "Ayes," Councilmen Alford, Bartholomew, 0111.18, and Mayor Miller; "nays," none; Councilman Wolf absent. The application of Wayland Clinton Fisher, 1013 East 9th Street, for a taxiunb driver's permit, duly approved by the Acting City Manager, et al., war submitted. The following resolution was introduced by Councilman Alford: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: and THAT the City Council of the City of Austin hereby approves the construction and maintenance of a wooden stairway on the northeast cornor of West 5th Street alley adjacent to the building located on the east one-half of Lot 7, Block 54, of the Original City of Austin, Texas, and locally known as 516 Colorado Street, which building is occupied by the Service Men's Center operated by the Salvation Army, and hereby authorizes the said Salvation Army to construct and maintain said wooden stairway, subject to the same's being constructed in compliance with all the ordinancos relating thereto further subject to the foregoing attached recommendations; and the Building Inspector is hereby authorized to issue a building permit for the erection of this stairwny after full compliance with all the provisions of this resolution, and said permission shall be held to be granted and accepted subject to all nocesaary, reasonable and proper, present and future regulations and ordinances of the City of Austin, Toxas, in the enforcement of the proper police, traffic, and firo regulations, and the right of revocation is retained if, after hearing, it is found by the City Council that the said Salvation Army has failed and rofused and will continue to fail and refuse to perform any such conditions, regulations, and ordinances. Seaholm Acting City Manager Austin, Texхня Dear Sirt We, the undersigned, have considered the application of the Salvation Army, through Harrison-Wilson Company, Agent for the building, for permission to construct and maintain a wooden stairway on the northenst corner of West 5th Street alley adjacent to the building located on the east one-half of Lot 7, Block 54, of the Original City of Austin, Texas, and locally known as 516 Colorado Street, and we advise that the following conditions exists The second story of the above mentioned building is now occupied by the Service Men's Center, operated by the Salvation Army, and at the present time has only one means of egress. The Army officials insist that another means of egress be provided and the only feasible place to erect this exit stairway would be in the alley as mentioned above. This would not cause any more obstruction in the alley than exists at the present time, owing to the fact that the light poles in their present locations extend as much as 30 inches into the alley, and the erection of a stairway 30 inches wide would not further restrict passage in this alley. We recommend that the Salvation Army be given permission to construct and maintain such outside wooden stairway in the alley arca mentioned above to extend not more than 30 inches, and which has the approval of the Army officials in charge, and that this privilege be granted for the duration of the war, or until such time when it is no longer needed by the service men while on leave in Austin. A written communiontion from the Austin Transit Company, requesting approval of a proposed change in the Main Line Bus schedule, wan received. Thereupon the following resolution was introduced by Councilmon Bartholomew: (RESOLUTION) WHEREAS, The Austin Transit Company has applied to the City of Austin for a change in one of ite routes, with a view toward improving the Company's service, which route is more particularly described hereinafter; and WHEREAS, The City Council of the City of Austin, after due consideration, finds that the proposed change is required by public convenience and necessity; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the discontinuance of the following route be, and it is hereby, approved, to be effective within a reasonable time: BEGINNING at Congress Avenue and Fifth Street; Thence east on East Fifth Street to East Avenue; Thence south on East Avenue to Holly Street; Thence east on Holly Street to Anthony Street; Thence north on Anthony Street to Garden Street; Thence east on Garden Street to Canadian Street; Thence south on Canadian Street to Holly Street: Thence west on Holly Street to Hast Avenue; Thence north on East Avenue to East Fifth Street; Thence west on Fast Fifth Street to Congross Avonue and the point of beginning. Upon motion of Councilman Bartholomew, the foregoing resolution was adopted by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. Councilman Alford offered the following resolution: (RESOLUTION) WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter namod, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTINI THAT Texas Public Service Company be, and the same is hereby, permitted to lay and constrict ite enn mains in and upon the following streetst (1) A gas main in ROSEWOOD AVENUM from a point 19 feet annt of Comel Street ensterly to a point 43 fect enst of Lawson Lane, the conterline of which gas main shall be 17 feet south of, and parallel to, the centerline cf said Rosewood Avenue. Said gas main described above shall have a covering of not less than 2 feet. (2) A pas regulator pit, 3.5x3.5', in ROSEWOOD AVENUE east of Comal Street, the center of said pit to be 25 feet east of the east line of Comal Street and 17 feet south of the centerline of Rosewood Avenue. The Texas Public Service Company is hereby put upon notice that the City of Austin does not warantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the 159 160 fact that greater depthe may not be required at special points. Then the Texon Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assi/chments, they shall apply to the City Engineering Department not lees than threo (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been inid, shall be under the supervis- ion and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Upon motion of Councilman Alford, the foregoing resolution was adopted by the following votes "ayes," Councilmen Alford, Bartholomew, 011118, and Mayor Miller; "nays," none; Councilmen Wolf absent. The Acting City Manager submitted to the Council the matter of a rovision of the voting ward boundaries of the City of Austin to conform to those of the County of Travis.
