162 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, February 11, 1943 The City Council convened in regular session, at the regular meeting place in the Council Chamber at the Municipal Building, on Thursday, February 11, 1943, at 10:40 A. M., with Mayor Tom Miller presiding. Roll call showed the following members presents Councilmen Alford, Gillis, and Mayor Miller; absent, Councilmen Bartholomew and Wolf. There were present also: J. E. Motheral, City Engineer; Gibson R. Randle, Acting City Attorney; J. M. Patterson, Jr., Assistant City Attorney; and R. D. Thorp, Chief of Police; absent, Acting City Manager Seaholm. The Minutes of the regular meeting of February 4, 1943, were read; and upon motion of Councilman Alford, were adopted as read by the following vote: "ayes," Councilmen Alford, Gillis, and Mayor Miller; "nays," none; Councilmen Bartholomew and Wolf absent. Horace Shelton, Attorney for Vera Barton, colored, presented a petition signed by the business firms in the vicinity of 1900 Fast 12th Street, there being no residences adjacent thereto, waiving any objections to the granting of a wine and beer permit to his client at said location. It was then moved by Councilman Alford that the application of the said Vera Barton, colored, for a wine and beer permit at 1900 Fast 12th Street, be approved. The motion carried by the following vote: Hayes," Councilmen Alford, Gillis, and Mayor Miller; "nays," none; Councilmen Bartholomew and Wolf absent. The application of J. A. Reed, 1618 Rosewood Avenue, for a wine and beer permit, duly approved by the Acting City Manager, et al., was submitted. Councilman Gillis moved that the application be approved. The motion carried by the following vote: Hayes," Councilmen Alford, Gillis, and Mayor Miller; "nays," none; Councilmen Bartholomew and Wolf absent. The application of R. L. Schnauts, 621 Congress Avenue, for a retail package store permit, duly approved by the Acting City Manager, et al., was submitted. Councilman 01111s moved that the application be approved. The motion carried by the following vote: "ayes," Councilmen Alford, Gillis, and Mayor Miller; "nays," none; Councilmen Bartholomew and Wolf absent. The application of N. C. Nalls and E. R. McClain, 2032 Fredericksburg Boad, for a retail wine and beer permit, duly approved by the Acting City Manager, et al., was submitted. Councilman Gillis moved that the application be approved. The motion carried by the following voter "ayes," Councilmen Alford, Gillis, and Mayor Miller; "nays," none; Councilmon Bartholomew and Wolf absent. Mr. James Parnell, representing the Janes Gravel Company, came before the Council and submitted an offer of $100 for the purchase of a strip of ground owned by the City, approximately 62x112.49 feet, located south of the International & Great Northern Railroad on West 3rd Street and west of Baylor Street. The matter was taken under advisement. The said James Parnell, representing the Janes Gravel Company, also submitted a request for the permanent closing of the south end of Baylor Street, which has never been actually opened. The matter was taken under advisement, pending a petition from abutting property owners agreeing to the closing of said street. The application of Sherman White, colored, 1407 Sanches Street, for a license to operate as a taxicab a 1941 Model, Ford Coach, Motor No. 009016, State License No. NO8-947, duly approved by the Acting City Manager, et al., was submitted. Councilman Alford moved that the license be granted, it having been shown that the applicant was operating a taxicab prior to September 1, 1942. The motion carried by the following vote: "ayes," Councilmen Alford, Gillis, and Mayor Miller; "nays," none; Councilmen Bartholomew and Wolf absent. The application of Herbert Andrew Whisenant, 106 East 2nd Street, for a taxicab driver's permit, i i duly approved by the Acting City Manager, et al., was submitted. Councilman Gillis moved that the permit be granted. The motion carried by the following vote: "ayes," Councilmen Alford, Gillis, and Mayor Miller; "naye," none; Councilmen Bartholomew and Wolf absent. The application of Sherman White, colored, 1407 Sanches Street, for a taxicab driver's permit, duly approved by the Acting City Manager, et al., was submitted. Councilman Gillis moved that the permit be granted. The motion carried by the following vote: "ayes," Councilmen Alford, Gillis, and Mayor Miller; "nays," none; Councilmen Bartholomew and Wolf absent. Pursuant to the authority vested in him under Section Five of the Housing Authorities Law of the State of Texas, Mayor Miller nominated Hubert B. Jones and Louise Haynie as Commissioners of the Housing Authority of the City of Austin, to succeed themselves, for the two-year term ending December 23, 1944, retroactive to December 23, 1942. The nominations were confirmed by the following vote: "ayes," Councilmen Alford, Gillis, and Mayor Miller; "naye," none; Councilmen Bartholomew and Wolf absent. The question of eliminating various traffic stops and signal lights for the duration of the War in order to conserve tires and gasoline, as proposed by the Office of Defense Transportation, came up for discussion; and the matter was referred to the Traffic Division for study and recommendation. A committee from the Austin Symphony Orchestra, composed of Judge Ben Powell, Malcolm Gregory, Kurt Schmedes, C. A. Schutse, and F. C. Morse, came before the Council and submitted a request for assistance in its program for enlargement of the scope of its activities to include a junior orchestra, choral groups, etc., by authorising the employment of H. J. Buytendorp as full-time director, at a salary of $200 per month, said director to be under the supervision of the Recreation Department. After some discussion of the matter, it was moved by Councilman Alford that the request of the Austin Symphony Orchestra be granted; and that the sum of Eighteen Hundred Dollars ($1800.00) be appropriated out of the General Fund, not otherwise appropriated, for the purpose of paying the salary of the said H. J. Buytendorp as full-time director, for the remainder of this year, starting April 1, at the rate of $200 per month, the said director to be employed by the Recreation Department, and also to be under the direction of said Austin Symphony Orchestra. The motion carried by the following vote: "ayes," Councilmen Alford, Gillis, and Mayor Miller; "nays," none; Councilman Bartholomew and Wolf absent. M., February 11, 1943, in the Council Chamber at the Municipal Building, with Mayor Tom Miller presiding. The Mayor announced that the purpose of the meeting was to consider certain amendments to the Parking Meter and Traffic Ordinances. The Mayor then introduced the following Ordinancet AN ORDINANCE AMENDING THAT CERTAIN ORDINANCE ESTABLISHING PARKING METER ZONES IN THE CITY OF AUSTIN AND PROVIDING FOR THE REGULATION OF TRAFFIC THEREBY, WHICH ORDINANCE WAS PASSED BY THE CITY COUNCIL OF THE CITY OF AUSTIN AUGUST 19, 1937, AND IS RECORDED IN BOOK "K", PAGES 281-286, INCLUSIVE, OF THE ORDINANCE RECORDS OF THE CITY OF AUSTIN, BY AMENDING SHOTION 9 OF SAID ORDINANCE SO AS TO PROVIDE THAT IT SHALL NOT BE NECESSARY FOR THE COMPLAINT TO ALLEGE OR THE STATE TO PROVE GUILTY KNOWLEDGE; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. The Ordinance was read the first time and Councilman 01111s moved that the rules be suspended and the Ordinance be passed to its second reading.
