224 : REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, June 10, 1943 The City Council convened in regular session, at the regular meeting place in the Council Chamber at the Municipal Building, on Thursday, June 10, 1943, at 10:40 A. Me, with Mayor Tom Miller presiding. Roll call showed the following members presents Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; absent, Councilman Wolf. There were present alsos Walter E. Seaholm, Acting City Manager; J. E. Motheral, City Engineer; J. M. Patterson, Jr., Acting City Attorney; and R. D. Thorp, Chief of Police. : The minutes of the Regular Meeting of June 3, 1943, were read, and after correction, were adopted by the following vote: "ayes," Councilmen Alford, Bartholomew, 0111is, and Mayor Miller; "naye," none; Councilman Wolf absent. The application of Carl Bradley Eldridge, 1618 Navasota Street, for a renewal of his taxicab driver's permit, duly approved by the Acting City Manager, et al., was submitted. Councilman Alford moved that the renewal be granted. The motion carried by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. The application of James Sherman Ferris, 907 East 2nd Street, for a renewal of his taxicab driver's permit, duly approved by the Acting City Manager, et al., was submitted. Councilman Alford moved that the renewal be granted. The motion carried by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. The application of Corley Rector Steward, colored, 1912 Tillotson Avenue, for a taxicab driver's permit, duly approved by the Acting Oity Manager, et al., was submitted. Councilman Alford moved that the permit be granted. The motion carried by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. The application of George Stanley Wallace, 2613 Dias Street, for a taxicab driver's permit, duly approved by the Acting City Manager, et al., was submitted. Councilman Alford moved that the permit be granted. The motion carried by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. The application of William Aaron Schreffler, 305 East 9th Street, for a taxicab driver's permit, duly approved by the Acting City Manager, et al., was submitted. Councilman Bartholomew moved that the permit be granted. The motion carried by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "naya," none; Councilman Wolf absent. The application of Ted Valden for a wine and beer permit for THD'S, 301 East 16th Street, duly approved by the Acting City Manager, et al., was submitted, Councilman Alford moved that the permit be granted. The motion carried by the following votes "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "naye," none; Councilman Wolf absent. Councilman Gillis offered the following resolutions (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTINI THAT Walter E. Seaholm, the Acting City Manager, be, and he is hereby, authorized and fully empowered to execute for and in the name of the City of Austin, a release and quitclaim of that certain easement executed by James J. Haynes, et al., to the City of Austin, dated June 7, 1918, recorded in Volume 305, page 79, of the Deed Records of Travis County, Texas, in so far as Lot No. 17. Block No. 6, Edgemont Addition to the City of Austin is concerned. Upon motion of Councilman Gillis, the foregoing resolution was adopted by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. The following ordinance was introduced by Councilman Alfordi AN ORDINANCE AMENDING THAT CERTAIN ORDINANCE ENTITLED "AN ORDINANCE REGULATING TRAFFIC ON THE PUBLIC STREETS OF THE CITY OF AUSTIN; PRESCRIBING PENALTIES FOR THE VIOLATION OF SAME; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY," WHICH SAID ORDINANCE WAS PASSED BY THE CITY COUNCIL OF THE CITY OF AUSTIN MAY 6, 1937, AND IS RECORDED IN BOOK "K", PAGES 159-179, INCLUSIVE, OF THE ORDINANCE RECORDS OF THE CITY OF AUSTIN, BY AMENDING SECTION 12(6) OF SAID ORDINANCE; REPEALING ALL ORDINANOES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DEOLARING AN EMERGENCY The Ordinance was read the first time and Councilman Alford moved, seconded by Councilman Gillis, that the rule be suspended and the Ordinance be passed to its second reading. The motion carried by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. The Ordinance was read the second time and Councilman Gillis moved, seconded by Councilman Alford, that the rule be further suspended and the Ordinance be passed to its third reading. The motion carried by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. The Ordinance was read the third time and Councilman Alford moved, seconded by Councilman Gillis, that the Ordinance be finally passed. The motion carried by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "nays," none; Councilman Wolf absent. The Mayor then announced that the Ordinance had been finally passed. The following resolution was introduced by Councilman Bartholomewi (RESOLUTION) WHEREAS, Walter E. Seaholm, Acting City Manager, has reported that the airplane hangar at the Municipal Airport has been completed by the contractor, J. M. Odom, in accordance with plans and specifications; and WHEREAS, The City Engineer has checked the final estimate and recommends acceptance of the hangar and payment of same; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT said contract and the works thereunder is hereby accepted, and the City Manager is hereby authorised and directed to pay the final estimate, including all change orders. Upon motion of Councilman Bartholomew, the foregoing resolution was adopted by the following votet "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "naye," none; Councilman Wolf absent. A petition, signed by T. O. Coffey, 1015 Milam Place, and other residents of Travis Heights Addition, asking that the authority of the Zoning Ordinance be invoked to prevent the proposed use of the promises at 1312-1314 Kenwood Avenue, owned by Peter Allidi and wife, Esther Allidi, as a convalescent home, was received and filed. A committee from the Business and Professional Women's Club, Miss Lydia Littman, spokesman, came before the Council and asked that their Clubhouse be granted free water and light, said promises being used exclusively on week-ends for the entertainment of soldiers. The matter was referred to the Acting City Manager, with instructions to grant said Club the half-rate allowed other organizations doing similar work. Louis Clemons, colored, 2227 Rosewood Avenue, appealed his application for a taxicab driver's permit. Mayor Miller moved that said applicant be granted a permit for a sixty-day probationary period, and that he report to the Chief of Police in the meantime. AN ORDINANCE AMENDING THAT CERTAIN ORDINANCE PASSED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS, JULY 17, 1942, BEING A GENERAL REVISION OF THE ZONING ORDINANCE OF THE CITY OF AUSTIN, WHICH AMENDATORY ORDINANCE IS RECORDED IN BOOK "L", PAGES 152-174, OF THE ORDINANCE RECORDS OF THE CITY OF AUSTIN, THE AMENDATORY ORDINANCE HEREBY INACTED ADDING TWO NEW PARAGRAPHS TO SECTION 10(4), SAID NEW PARAGRAPHS BEING NUMBERED 15 AND 16, AND PROVIDING THAT THE MANUFACTURE, BREWING, AND DISTILLING OF MALT, VINOUS, AND SPIRITOUS LIQUORS, AND OTHER TYPES OF PROCESSING AND MANUFACTURE OF A HAZARDOUS OR NUISANCE NATURE MAY BE CONDUCTED IN AN "E" HEAVY INDUSTRIAL DISTRIOT ONLY AFTER THE LOCATION THEREOF IS APPROVED BY THE BOARD OF ADJUSTMENT; CHANGING IN CERTAIN MINOR PARTICULARS THE WORDING OF THE FOLLOWING SECTIONS: SUBSECTION 11 OF SECTION 6; SUBSECTION 31 OF SECTION 9, SUBSECTION 44 OF SEOTION 9, SECTION 10(a), SUBSECTION 6 OF SECTION 11, SECTION 13(0) SECTION 14(a), SECTION 15(a), SECTION 16(a), SECTION 18(1), AND SECTION 19(A); PROVIDING A SAVING CLAUSE; AND DEOLARING AN EMERGENΟΥ. The Mayor then announced that the Ordinance had been finally passed. The following resolution was introduced: (RESOLUTION) WHEREAS, City of Austin taxes were assessed in the name of J. R. Bailey, for the years 1941 and 1942, on Lots 16, 17, 18, Block 1, Outlot 21, Division "C", Sunny Ridge, and Lots 3 (less 80'x170) 4, 5, 6, 7-6, 7-8, 12-А, 12-C (being the West end of 12), 1-А, 1-3 (less 90x1291), part of 1, and 113.85 x 116' (2-A-1) Outlot 6, 9, Division "C", Beau Site Subdivision, and for the year 1941, personal property, being a Buick Coupe, all located in the City of Austin, Travis County, Texas, said taxes being for the sum of $2,377.98, and for non-payment of same at maturity, penalty in the sum of $118.90 has been assessed, and interest in the sum of $106.96 has accrued, making the total amount of taxes, penalty and interest $2,603.84; and WHEREAS, The City Council of the City of Austin deems it just and equitable to remit said penalty in the sum of $118.90 and one-half of the interest in the sum of $53.48; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the aforesaid penalty in the sum of $118.90 and one-half of the interest in the sum of $53.48 are hereby remitted, and the Tax Assessor and Collector of the City of Austin is authorised and directed to charge said penalty in the sum of $118.90 and one-half of the interest in the sum of $53.48 off his rolls and to issue to the party entitled to receive same a receipt in full upon the payment of said taxes and one-half of the interest, as aforesaid. Upon motion, the foregoing resolution was adopted by the following vote: "ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "naye," none; Councilman Wolf absent.
