REGULAR MENTING OF THE CITY COUNCIL: Austin, Texas, August 12, 1943 The City Council convened in regular session at the regular meeting place in the Council Chamber at the Municipal Building, on Thursday, August 12, 1943, at 10:30 A. M., with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; absent, Councilman Wolf. There were present also: Walter E. Seaholm, Acting City Manager; J. E. Motheral, City Engineer; J. M. Patterson, Jr., Acting City Attorney; and R. D. Thorp, Chief of Police, The minutes of the Recessed Meeting of August 2, and the Regular Meeting of August 5, 1943, wore read, and upon motion of Councilman Alford were adopted as read by the following vote: "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilman Wolf absent. The application of James William Coker, 214 Congress Avenue, for a license to operate as a taxicab a Mercury 4-door Sedan, 1940 Model, State License No. K57-559, recommended for approval by the Acting City Manager et al, was submitted. Councilman 0111is moved that the license be granted. The motion carried by the following votet "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilman Wolf absent. The following ordinance was introduced by Councilman Gilliss AN ORDINANCE AMENDING THAT CERTAIN ORDINANΟΣ ENTITLED "AN ORDINANCE CREATING THE OFFICE OF CITY GAS INSPECTOR, AND DEFINING THE DUTIES OF SUCH OFFICE; CREATING A BOARD FOR THE ΧΑΜΙΝΑΤΙΟΝ OF GAS-FITTERS, AND PROVIDING FOR THE EXAMINATION AND LICENSE OF GAS-FITTERS, PROVIDING FOR THE INSPECTION OF GAS AND GAS METERS; PRESCRIBING RULES AND REGULATIONS FOR THE QUALITY, PRESSURE AND MEASURE OF GAS SUPPLIED TO CONSUMERS, AND FOR THE ENFORCEMENT THEREOF; PROVIDING RULES AND REGULATIONS TOR THE INSTALLATION AND MAΙΝΤΕΝΑΝCE OF GAS PIPING AND FIXTURES; AND PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE, "PASSED BY THE CITY COUNCIL JULY 19, 1928, AND RECORDED IN VOLUME "G", PAGE 435, OF THE ORDINANCE RECORDS OF THE CITY OF AUSTIN, BY AMENDING SECTION 3(6) OF SAID ORDINANCE RELATING TO THE TESTING OF CAS METERS, The ordinance was read the first time and Councilman Gillis moved that the rules be suspended and the ordinance be passed to its second reading. The ordinance was then read the third time and Councilman Gillis moved that the ordinance be finally passed. The Mayor then announced that the ordinance had been finally passed. The following ordinance was introduced by Councilman Gilliss AN ORDINANCE CLOSING AND VACATING A PORTION OF NICKERSON STREET AS SHOWN ON A PLAT OF GOODSHADE ADDITION TO THE CITY OF AUSTIN, RECORDED IN PLAT BOOK 102, PAGE 18 OF THE PLAT RECORDS OF TRAVIS COUNTY, TEXAS, AND DECLARING AN EMERGENCY. The ordinance was read the first time and Councilman Gillis moved that the rules be suspended and the ordinance be passed to its second reading. The motion carried by the following vote: "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilman Wolf absent. The ordinance was then read the second time and Councilman Gillis moved that the rules be further suspended and the ordinance be passed to its third reading. The ordinance was then read the third time and Councilman Gillis moved that the ordinance be finally passed. The Mayor then announced that the ordinance had been finally passed. The Mayor laid before the Council for its second reading, the following ordinancet AN ORDINANCE FIXING AND LEVYING AN OCCUPATION TAX ON CERTAIN COIN-OPERATED MACHINES; DEFINING TERMS AND PHRASES USED HEREIN, PROVIDING CERTAIN EXCEPTIONS, PROVIDING TOR ISSUANCE OF A LICENSE BY THE TAX COLLECTOR AND ASSESSOR, AND REQUIRING THAT SUCH LICENSE BE ATTACHED TO THE MACHINE FOR WHICH IT IS ISSUED; GIVING THE TAX COLLECTOR AND ASSESSOR THE RIGHT TO EXAMINE THE BOOKS AND RECORDS; DEOLARING AGAINST A CONSTRUCTION WHICH WOULD LEGALIZE MACHINES PROHIBITED BY THE STATE LAW OR THE CONSTITUTION; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH, AND DECLARING AN EMERGENCY. The ordinance was read the second time and Councilman Alford moved that the rules be suspended and the ordinance be passed to its third reading. The ordinance was then read the third time and Councilman Alford moved that the ordinance be finally passed. Councilman Bartholomew offered the following resolutiont (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Walter E. Seaholm, the Acting City Manager, be and he is hereby authorized and directed to execute for and in behalf of the City of Austin a quitclaim deed to Frank Moulis and wife, Mary Allen Moulis, conveying all the right, title, and interest acquired by the City of Austin to the north one-half (N.1/2) of Lot 2, Block 5-0, Swisher's Addition to the City of Austin, Texas, by deed from R. E. White, Sheriff of Travis County, dated August 8, 1895, and recorded in Volume 110, page 506, of the Deed Records of Travis County, Texas. Upon motion of Councilman Bartholomew, the foregoing resolution was adopted by the following vote: "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Naye," none; Councilman Wolf absent. The application of Ben L. Hessler, 1608 Willow Street, for a renewal of his taxicab driver's permit, recommended for approval by the Acting City Manager et al, was submitted. Councilman Alford moved that the application de granted. The motion carried by the following vote: "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilman Wolf absent. The application of James Olyn Hendricks, 60-A East Avenue, for a taxicab driver's permit, recommended for approval by the Acting City Manager, et al, was submitted. Councilman Alford moved that the permit be granted. The motion carried by the following vote: "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilman Wolf absent. The application of Robert H. Delancey, 300 Congress Avenue, for a license to operate as a taxicab a Chevrolet 4-door Sedan, 1940 Model, State License N17-249, Motor No. 3033012, said automobile having been owned and operated by D. F. Samuel as a taxicab under Operator's License No. 85, and sold to applicant by the said D. F. Samuel upon his induction into the armed forces. Councilman Alford moved that the license be granted. The motion carried by the following vote: "Ayes," Councilmen Alford, Π Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilman Wolf absent. The Mayor announced that there were three vacancies on the City Plan Commission, and then nominated Raymond S. Brooks as a member of said Commission. The nomination was confirmed by the following votes "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilman Wolf absent. Councilman Bartholomew then nominated Charles M. Morton as a member of said Commission. The nomination was confirmed by the following vote: "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilman Wolf absent. It was the sense of the meeting that the appointment of a third member to fill the remaining vacancy on said Commission be deferred to a subsequent meeting of the City Council. There being no further business, on motion, seconded and carried, the meeting was then recessed at 11:15 A. M., subject to call of the mayor.
