266 2.66 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, August 26, 1943 The City Council convened in Regular Session, at the regular meeting place in the Council Chamber at the Municipal Building, on Thursday, August 26, 1943, at 10:45 A. M., with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen Bartholomew, Gillis, and Mayor Miller; absent, Councilmen Alford and Wolf. There were present also: Walter E. Seaholm, Acting City Manager; J. E. Motheral, City Engineer; J. M. Patterson, Jr., Acting City Attorney; and R, D, Thorp, Chief of Police. The minutes of the Regular Meeting of August 19, 1943, were read; and upon motion of Councilman Gillis, were adopted as read by the following vote: "Ayes," Councilmen Bartholomew, Gillis, and Mayor Miller; "Naye," none; Councilmen Alford and Wolf absent. A group of visiting celebrities and war heroes, including Robert Taylor and Nancy Gates, moving picture stars, Jack Dempsey et al, made a courtesy call on the City Council, and were introduced by Congressman Lyndon Johnson. The Mayor then welcomed the group, expressing the thanks of the Council for their appearance here on the occasion of the War Bond Rally to be held at House Park at eight o'clock P. M., ushering in the THIRD WAR LOAN DRIVE. G. F. Zimmermann presented a written application by E. M. Bohls for a change in zoning so as to extend the "C" Commercial District to include the east section of the Bohls Cottages property, the portion of Nickerson Street vacated by Ordinance of August 12, 1943, and Lots E and D of Goodshade Addition, The matter was referred to the Board of Adjustment for consideration and recommendation. The written application of John W. Stayton, reapplying for a change in zoning, to "C-2" Commercial, of the property at 609 Brazos Street, was received. The matter was referred to the Board of Adjustment for consideration and recommendation. The application of Walton Lee Harris, 3402 Bailey Lane, for a renewal of his taxicab driver's permit, recommended for approval by the Acting City Manager et al, was submitted. Councilman Gillis moved that the permit be renewed. The motion carried by the following vote: "Ayes," Councilmen Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilmen Alford and Wolf absent. The application of Ralph Edward King, 717 East 32nd Street, for a taxicab driver's permit, recommended for approval by the Acting City Manager et al, was submitted. Councilman Bartholomew moved that the permit be granted. The motion carried by the following vote: "Ayes," Councilmen Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilmen Alford and Wolf absent. The application of Donald Ward McCaig, 1012 East 51st Street, for a taxicab driver's permit, recommended for approval by the Acting City Manager, et al, was submitted. Councilman Gillis moved that the permit be granted. The motion carried by the following vote: "Ayes," Councilmen Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilmen Alford and Wolf absent. The application of Hurshell Hartford Hatley, 207 East Live Oak Street, for a taxicab driver's permit, recommended for approval by the Acting City Manager et al, was submitted. Councilman Gillis moved that the permit be granted. The motion carried by the following vote: "Ayes," Councilmen Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilmen Alford and Wolf absent. The application of Claude Wilburn Hallmark, 1514 Hether Street, for a taxicab driver's permit, recommended for approval by the Acting City Manager et al, was submitted. Councilman Bartholomew moved that the permit be granted. The motion carried by the following vote: "Ayes," Councilmen Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilmen Alford and Wolf absent. It was moved by Councilman Bartholomew that in accordance with the recommendations of the Chief of Police, the temporary taxicab driver's permit granted Raburn Calvin Teague on July 22, 1943, be revoked. The motion carried by the following vote: "Ayes," Councilmen Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilmen Alford and Wolf absent. Councilman Gillis offered the following resolutiont (RESOLUTION) WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be, and the same is hereby, permitted to lay and construct its gas mains in and upon the following streetss A gas main in EAST 19TH STREET from a point 125 fest cast of Speedway, easterly 584 feet to west end of Waller Creek Bridge, the centerline of which gas main shall be 19 feet south of, and parallel to, the north line of EAST 19TH STREET. Said gas main described above shall have a covering of notless than 2 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility. damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Upon motion of Councilman Gillis, the foregoing resolution was adopted by the following votes "Ayes," Councilmen Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilmen Alford and Wolf absent, The following applications for private boat licenses, duly approved by the Lake Austin Navigation Board, were submitted: Name and Address of Applicant Cloud, R. Route B Box 6 Roberts, Josie R. 109 West 10th Street Description of Boat Acme, Outboard, three years old, Champion, 4-passenger Home-made, Row, New, "Jenny," 2-passenger Montgomery Ward, 1943 Model, Eclipse, 5-passenger Welch, Cruiser, 1942 Model, Cabin, Criss-Kraft, 14-passenger The motion carried by the follow Councilman Bartholomew moved that the above applications be granted. ing vote: "Ayes," Councilmen Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilmen Alford and Wolf absent. 267 268 Councilman Bartholomew offered the following resolutions (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sum of Six Hundred Dollars ($600.00) be, and the same is hereby, appropriated out of the General Fund, not otherwise appropriated, in payment of the City's pro rata of expenses incident to the War Bond Rally to be held at House Park on the evening of August 26, 1943, heralding the THIRD WAR LOAN DRIVE sponsored by the Federal Government, said amount to be made payable to Walter Bremond, Treasurer of said War Bond Rally. Upon motion of Councilman Bartholomew, the foregoing resolution was adopted by the following voter "Ayes," Councilmen Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilmen Alford and Wolf absent. The Acting City Manager submitted a Memo by the City Engineer, showing a tabulation of bids received on August 24 for the construction of a Negro Recreation Center. Councilman Gillis then offered the following resolutions (RESOLUTION) WHEREAS, a proposal for bids for the construction of a Negro Recreation Center to be located in Rosewood Park was duly advertised on the 8th day of August, 1943, and on the 22nd day of August, 1943; and WHEREAS, bide received in response to such proposal were publicly opened and read on the 24th day of August, 1943; and WHEREAS, it was found that the bid of J. R. Blackmore (Alternate No. 3) for the general contract in the amount of $31,044.00, the bid of Fox-Schmidt for the plumbing work in the amount of $1,858.00, and the bid of John Wattinger for the heating work in the amount of $1,193.00 were the lowest and best bids submitted, and that said bids were regular and proper in all particulars; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN; TEXAS: therefore, THAT the said bid of J. R. Blackmore (Alternate No. 3) for the general contract on said Negro Recreation Center in the amount of $31,044.00, the said bid of Fox-Schmidt for the plumbing work in the amount of $1,858.00, and the said bid of John Wattinger for the heating work in the amount of $1,193.00 be, and the same are hereby accepted, and the City Manager in behalf of the City of Austin is authorized and instructed to enter into a contract with the said J. R. Blackmore, Fox-Schmidt, and John Wattinger, respectively, for the construction of said Negro Recreation Center. The foregoing resolution was read in full, and Councilmen Gillin moved that same remain on file one week before being finally adopted. The motion carried by the following vote: "Ayes," Councilmen Bartholomow, Gillis, and Mayor Miller; "Nays," none; Councilmen Alford and Wolf absent. Dr. E. H. Givene, colored, was present, and on behalf of the Negro citizens of the City, thanked the City Council for having provided them with more adequate recreational facilities in the way of a recreation building. In the interest of better racial relations, the said Dr. Givens alan suomitted roquente for additional colored military police at the bus station, and for elimination by the shooting gallery of an amusement park south of the River of Negro dolls alongside dummies of Hitler, Mussolini, and Tojo. The matter was referred to the Acting City Manager for attention. There being no further business, upon motion, seconded and carried, the meeting was recessed at 11:35 A.
