296 ارد REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, October 14, 1943 The City Council convened in Regular Session, at the regular meeting place in the Council Chamber at the Municipal Building, on Thursday, October 14, 1943, at 10:40 A. M., with Mayor Tom Miller presiding. Roll call showed the following members presents Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; absent, Councilman Wolf. There were present also: Walter E. Seaholm, Acting City Manager, J. E. Motheral, City Engineer; J. M. Patterson, Jr., Acting City Attorney; and R. D. Thorp, Chief of Police. The minutes of the Regular Meeting of October 7, 1943, were read, and upon motion of Councilman Alford, were adopted as read by the following vote; "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Naya," none; Councilman Wolf absent. A proclamation by the Mayor, proclaiming October 27 as "NAVY DAY," was approved. : Mr. A. S. Hull came before the Council to request the immediate enactment of the proposed ordinance licensing bootblacks, and the appointment of a Citizens Council to act as an executive committee in making recommendations and plans for solving the juvenile delinquency problem. After some discussion, it was the sense of the Council that the question of an executive committee be deferred pending passage of the ordinance and the appointment of a counsellor. The Mayor submitted a letter from F. R. Rice, Supervising Principal of Blackshear and Rosewood Schools, asking for a light in the vicinity of said schools as a means of solving the delinquency problem there. The letter was received and filed. In accordance with published notice, the Mayor announced the public hearing open on the proposal of the City Council to amend the Zoning Ordinance in the following particularst To amend the USE designation and the HEIGHT AND AREA designation of the following described property so that same shall hereafter be designated as "O" Commercial District and Second Height and Area, to-wits All that part of the tract of land conveyed to E. M. Bohis and wife by Mrs. Mary K. Schneider and others by deed dated February 16, 1926, of record in the Deed Records of Travis County, Texas, in Volume 385, at pages 164-166, described as follows: Beginning where the north line of said tract conveyed to said E. M. Bohls and wife is intersected by the east line of "C-1" Commercial Zone exterming along South Congress Avenue as now shown by zone map of the City of Austin; thence with the north line of said property conveyed to and owned by the said E.M.Bohle and wife to the northwest corner of Lot C in Goodshade Addition as shown by map or plat of said Addition of record in the Plat Records of Travis County, Texas, in Volume 523, at pages 1-2; thence southward with the west line of Lots C and B of said Goodshade Addition to the north line of the City of Austin; thence with the north line of said "C" Commercial Zone westward to the east line of said "C-1" Commercial Zone; thence northward with the east line of said "C-1" Commercial Zone to the place of beginning, the property with respect to which extension of said "C" Commercial Zone is desired being the property enclosed in red on plat of part of Goodshade Addition and the Bohls Cottages property on file in the office of the City Clerk, and consisting of the east section of the Bohls Cottages property now covered by cottages comprising part of Bohls Cottages or tourist court, but not now shown on the sone map as part of said "C" Commercial Zone; the abandoned section of Nickerson Street lying between the Bohls Cottages property and Goodshade Addition; and Lots D and I of said Goodshade Addition, all in the City of Austin, Texas. No property owner or other interested person appeared to protest the proposed change. Written communications from Mr. E. R. Youngblood and Mr. and Mrs. E. R. Sedwick, stating they had no objection to the proposed change; and from Mrs. Sara Earls Huber, protesting the proposed change, were received and filed. The following ordinance was then introduced by Councilman Gillis; 297 AN ORDINANCE AMENDING THE CERTAIN ORDINANCE PASSED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS, JULY 17, 1941, BEING A GENERAL REVISION OF THE ZONING ORDINANCE OF THE CITY OF AUSTIN, WHICH AMENDATORY ORDINANCE IS RECORDED IN BOOK "L", PAGES 152-174, INCLUSIVE, OF THE ORDINANCE RECORDS OF THE CITY OF AUSTIN, TEXAS, THE AMENDATORY ORDINANCE HEREBY ENACTED CHANGING THE USI DEBIONATION AND THE HEIGHT AND AREA DESIGNATION FROM "A" RESIDENCE DISTRICT AND FIRST HEIGHT AND AREA DISTRICT TO "C" COMMERCIAL DISTRICT AND SECOND HEIGHT AND AREA DISTRICT, OF A TRACT OF LAND 340 FEET IN LENGTH AND 103 FEET IN WIDTH EXTENDING ALONG THE NORTH SIDE OF THE PRESENT "C" COMMERCIAL DISTRICT ALONG EAST LIVE OAK STREET, AND SITUATED BETWEEN THE PRESENT C-1 COMMERCIAL DISTRICT ALONG SOUTH CONGRESS AVENUE AND THE WEST LINE OF LOTS B AND C, OF GOODSHADE ADDITION, IN THE OITY OF AUSTIN, TRAVIS COUNTY, TEXAS; AND ORDERING A DELINEATION OF THE OFFICIAL USE MAP AND THE OFFICIAL HEIGHT AND AREA MAP 80 AS TO SHOW THE CHANGE HEREBY ORDERED; AND DECLARING AN EMERGENCY. The Ordinance was read the first time and Councilman Gillis moved, seconded by Councilman Bartholomew, that the rule be suspended and the Ordinance be placed on its second reading. The motion carried by the following vote: "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilman Wolf absent. The Ordinance was then read the second time and Councilman Gillis moved, seconded by Councilman Bartholomew, that the rule be further suspended and the Ordinance be placed on its third reading. The motion carried by the following vote: "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilman Wolf absent. The Ordinance was then read the third time and Councilman Gillis moved, seconded by Councilman Bartholomew, that the Ordinance be finally passed. The motion carried by the following vote: "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilman Wolf absent. The Mayor then announced that the Ordinance had been finally passed. Councilman Alford offered the following resolution: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT WALTER E. SEAHOLM, Acting City Manager, be, and he is hereby, authorized and directed to execute for and in behalf of the CITY OF AUSTIN a quitclaim deed to Walter L. Plumley and wife, Lura Plumley, conveying all the right, title, and interest acquired by the CITY OF AUSTIN to Lot No. 6, Block No. 1, Barton Springs Park Addition to the City of Austin, Texas, by judgment in Cause No. 43268 and order of sale and sale to the CITY OF AUSTIN under said judgment by deed dated November 24, 1928, recorded in Volume 1429, page 616 of the Deed Records of Travis County, Texas. Upon motion of Councilman Alford, the foregoing resolution was adopted by the following votel "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilman Wolf absent.
