208 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, October 22, 1943 The City Council convened in Regular Session at the regular meeting place in the Council Chamber at the Municipal Building on October 22, 1943, at 10:45 A. M., with Mayor Tom Miller presiding; the meeting having been held on Friday on account of the Mayor's absence from the City on Thursday. Roll call showed the following members present: Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; absent, Councilman Wolf. There were present alsot Lt. Col. Quiton Morgan, City Manager; Wm. M. Wolf, Assistant City Attorney: J. E. Motheral, City Engineer; and R. D. Thorp, Chief of Police; absent, Acting City Manager Seaholm and Acting City Attorney Patterson. The minutes of the Regular Meeting of October 14, 1943, were read, and upon motion of Councilman Alford, were adopted as rend by the following vote: "Ayes," Councilmen Alford, Bartholomew, Gillis, end Mayor Miller; "Nays," none; Councilman Wolf absent. The appeal of Travis Clyde Milstead, 908 South 2nd Street, on his application for a taxicab driver's permit was heard. It was moved by Mayor Miller that said applicant be granted a 90-day proba- tionary taxicab driver's permit, with the provision that he report to the Chief of Police every thirty days in the meantime. The motion carried by the following vote: "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilman Wolf absent. The application of Christopher C. Cook, 307 West 8th Street, for a taxicab driver's permit, duly recommended for approval by the Acting City Manager et al, was submitted. Councilman Alford moved that the permit be granted. The motion carried by the following vote: "Ayes," Councilmen Alford, Bartholomew, Gillie, and Mayor Miller; "Nays," none; Councilman Wolf absent. The application of Wallace H. Word, 402 East Sath Street, for a renewal of his taxicab driver's permit, duly recommended for approval by the Acting City Manager et al, was submitted. Councilman Alford moved that the application de granted. The motion carried by the following vote: "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Naye," none; Councilman Wolf absent. The application of E. B. Dodd, owner, for a wine and beer permit for the "Old Mexico", 806 Red River Street, duly approved by the Acting City Manager et al, was submitted. Councilman Bartholomew moved that the permit be granted. The motion carried by the following vote: "Ayes," Councilmen Alford, Bartholomew, Oillis, and Mayor Miller: "Nays," none; Councilman Wolf absent. The following resolution was introducedi (RESOLUTION) WHEREAS, City of Austin taxes were assessed in the name of M. P. Smartt Estate for the years 1939. 1940, 1941, and 1942, on 6 acres, Outlot 33, Division "C", in the City of Austin, Travis County, Texnя, said toyes being for the sum of $404.47, and for nonpayment of "ame at maturity, penalty in the sum of $20.22 has been assessed, and interest in the mum of $51.00 has accrund, making the total amount of taxes, penalty and interest $475.69; and WHEREAS, the City Council of the City of Austin deoma it just and equitable to remit said penalty in the sum of $20.?? and one-half of the interest in the sum of $25.50; therefore, HE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the aforesaid penalty in the sum of $20.?? and one-half of the interest in the sum of $25.50 are hereby remitted, and the Tax Assessor and Collector of the City of Austin ir authorized and directed to charge caid penalty in the sum of $20.?? and one-half of the interest in the sum of $25.50 off his rolls and to issue to the party entitled to receive came a receipt in full upon the payment of said taxes and one-half the interest, ar aforesaid. Upon motion, the foregoing resolution was adopted by the following vote: "Ayes," Councilzen Alford, 209 Bartholomew, Gillin, and Mayor Miller; "Naye," none; Councilman "olf beent. The following resolution was introduced: (RESOLUTION) WHEREAS, City of Austin taxes were assessed in the name of Mrs. C. J. Jonen for the years 1939, 1940, 1941, and 1942, on 7.96 neres, Blocks 30, 33, and 34, Wolling Ploce, in the City of Austin, Travie County, Texas, neid taxes being for the sum of $168.00, and for nonpayment of same at maturity, penalty in the sum of $8.40 has been assessed, and interest in the sum of $20.42 han accrued, making the total amount of taxes, penalty and interest $196.82; and WHEREAS, the City Council of the City of Austin deems it just and equitable to remit said penalty in the sum of $8.40 and one-half of the interest in the sum of $10.21; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTINI THAT the aforesaid penalty in the sum of $8.40 and one-half of the interest in the sum of $10.21 are hereby remitted, and the Tax Assessor and Collector of the City of Austin is authorized and directed to charge said penalty in the sum of $8.40 and one-half of the interest in the num of $10.21 off his rolls and to issue to the party entitled to receive same a receipt in full upon the payment of said taxes and one-half of the interest, as aforesaid. Upon motion, the foregoing resolution was adopted by the following vote: "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilmen Wolf absent. The following resolution wan introduced: (RESOLUTION) WHEREAS, it has been determined that the assessment for taxes for the year 1943 against the improvements on the West one-half (W.1/2) of Lote 7 and 8, Block 42, Plat 11, in the City of Austin, Travis County, Texas, assessed in the name of W. S. Benson, is excessive, and that same should be corrected; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the assessment for taxes on the improvements on the aforesaid property for the year 1943 be, and the same is hereby, reduced and corrected from the present assessed value of $10,845.00 to $8,670.00, and that the City Assessor and Collector of taxes is authorized and directed to make such change in the tax rolls. Upon motion, the foregoing resolution was adopted by the following vote: "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller, "Nays," none; Councilman Wolf absent.
