310 REGULAR MEETING OF THE CITY COUNCIL: Austin, Texas, November 24, 1943. The City Council convened in Regular Session, at the regular meeting place in the Council Chamber at the Municipal Building, on Wednesday, November 24, 1943, at 10:45 A. M., Thursday being Thanksgiving Day, with Mayor Tom Miller presiding. Roll call showed the following member present: Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; absent, Councilman Wolf. There were present also: Walter E. Seaholm, Acting City Manager; J. E. Motheral, City Engineer; Wm. Wolf, Assistant City Attorney; and R. D. Thorp, Chief of Police. The minutes of the Regular Meetings of November 10, and November 18, 1943, were read, and upon motion of Councilman Alford, were adopted as read by the following vote: "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Naye," none; Councilman Wolf absent. Acting City Manager Seaholm submitted the following estimate of the Engineering Department on the cost of paving the streets adjacent to the State Cemetery: Memorandum to Mr. Motheral: "November 23, 1943 Following is an estimate of the cost of constructing an 8" gravel base with a 3-course inverted penetration asphalt top on the streets adjacent to the State Cemetery: Navasota (7th to 11th) Comal (7th to 11th) Eleventh Street (Navasota to Comal) - 4,700 sq. yde. pavement at $1.00 ------$4,700.00 4,700 sq. yds. pavement at $1.00 ---------- 4,700.00 3,350.sq. yds. pavement at $1.00 -3,350.00 In addition, we have estimated the cost of completing the pavement on Eleventh Street from Rosewood Avenue to Navasota Street at $250.00. (Sgd) C. G. Levander 11 Councilman Gillis moved that the foregoing estimate be approved, and that the sum of $12,750.00 be appropriated out of the General Fund in payment of the cost of such pavement on the above named streets adjacent to the State Cemetery. The motion carried by the following vote: "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilman Wolf absent. It was moved by Mayor Miller that the Acting City Attorney be instructed to have a resolution prepared for the next regular meeting, commemorating the life and works of the late Prof.A.N.McCallum, Superintendent of the Austin Public Schools, and that copies of same be sent to the family of the decensed and to the School Board. The motion carried by the following vote! "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilman Wolf Absent. Councilman Alford offered the following resolutions (RESOLUTION) WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its ges mains in the streets in the City of Austin horefter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be, and the same is hereby, permitted to lay and construct its gas mains in and upon the following streets! (1) A gas main in ROSEWOOD AVENUE from a point 103 feet east of Chicon Street,eesterly to Chestnut Street, the centerline of which gas main shall be 17 feet south of, and parallel to the centerline of said Rosewood Avenue. Said ges main described above shall have a covering of not less than 2 feet. (7) A gas main in CHESTNUT AVENUE from Rosewood Avenue north 220 fert, the centerline of which gas main choll be 1? feet west of, and parallel to the east line of cold Chestnut Avenue Snid ces main described above shall have a cover of not less thon al feet. The Texas Public Service Compony is hereby put upon notice that the City of Austin does not gurrantee that the space assigned above if cleer from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that grerter depths may not be required et special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not lees than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the cypense of repairs or replacement of any underground utility damaged during the constriction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plus, water must be used at intervole during the course of backfilling of the ditches. THAT the work and laying of snid gar moins, including the excovetion in the streets and the restoration and maintenance of said streets after snid mains have been laid shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise grented to said company by the City of Austin, Upon motion of Councilman Alford, the foregoing resolution was adopted by the following vote! "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilmen Wolf absent. The application of the Post Office Cafe, 503 Lavaca Street, for a wine and beer permit, duly recommended for approval by the Acting City Manager et al, was submitted. Councilman Bartholomew moved that the permit be granted, The motion carried by the following vote: "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilman Wolf absent. The application of Bruce Brinkley, 1707 Canterbury Street, for a taxicab driver's permit, duly recommended for amprovel by the Acting City Manager, et al, was submitted. Councilman Alford moved that the permit be grented. The motion carried by the followin; vote: "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilman Wolf absent. The application of Clyde Weber Crooks, 46 East Avenue, for a taxicab driverle permit, duly recommended for opproval by the Acting City Menacer, et al, was submitted. Councilman Alford moved that the permit be granted. The motion carried by the followin vote: "Ayer," Councilmen Alford, Bartholomew, Gillis, and Mayor Killer; "Noys," none; Councilmen Wolf absent. The application of Martin Buford Henke, colored, 1812 Washington Avenue, for toxicab driverts permit, duly recommended for coproval by the Acting City Manager, et al, was submitted. Councilmen Alford moved that the permit be granted. The motion corried by the following votes "Ayes," Councilmen Alford, Bartholomew, Cillie, and Meyer Miller: "Heyr," none; Councilmen Wolf corent. The followin resolution we introduced: (PESOLUTION) WHEREAS, City of Astin toyes word in the none of Ernest Molle for the poore 1906 through 194 on Lots 20 and 21, in lock 1, Lee's Hill, in the City of Austin, Trevi County, Texas, 311 312 soid tryen bein for the sum of $300., nd for non-payment of umet moity, penal ir. cum of $16.01 has been papeared, and interert in the sum of $144.77 hrs ccrued, mrkin the total omount of toxen, penalty and interest $221.16; ond WHEREAS, the City Council of the City of Austin deeme it just and equitable to remit rrid penalty in the sum of $16.01 and one-half of the interest in the sum of $77.38; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, THAT the aforesaid penalty in the sum of $16.01 and one-half of the interest in the im of $72.38 are hereby remitted, and the Tax Assessor and Collector of the City of Austin is cuthorized and directed to charge said penalty in the sum of $16.01 and one-half of the interest in the מנות of $72.38 off his rolls and to issue to the party entitled to receive some a receipt in full upon the pryment of anid taxer and one-half of the interest, na aforesaid. Upon motion, the foregoing resolution was adopted by the following votet "Ayen," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller: "Naye," none; Councilmen Wolf sbsent. The following resolution was introduced: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the sun of $12,750.00 be, and the same is hereby, appropriated out of the General Fund, not otherwise appropriated, for the purpose of constructing an 8" gravel base with a 3-course inverted penetration asphalt top on the streets adjacent to the State Cemetery, towits NAVASOTA STREET from 7th to 11th Streets: 4,700 sq. yds, pavement at $1.00 $ 4,700.00 COMAL STREET from 7th to 11th Streete: 4,700 sq. yds. pavement at $1.00 ELEVENTH STREET from Navasote to Comal Streets: 3.350 sq. yds. pavement at $1.00 Total - in accordance with estimate submitted by the Engineering Department. -- 14,700.00 3.350.00 $12,750.00 Upon motion, the foregoing resolution was adopted by the following vote: "Ayes," Councilmen Alford, Bartholomew, Gillia, and Mayor Miller: "Nays," none; Councilman Wolf absent.
