REGULAR MEETING OF THE CITY COUNCIL: 331 331 Austin, Texas, January 06, 1944 The City Council convened in Regular Session, at the regular meeting place in the Council Chamber at the Municipal Building, on Thursday, January 6, 1944, at 10:55 A. M., with Mayor Tom Miller presiding. Roll call showed the following members present: Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; absent, Councilman Wolf. There were present also: Walter E. Seaholm, Acting Oity Manager; J. E. Motheral, City Engineer; J. M. Patterson, Jr., Acting City Attorney; and R. D. Thorp, Chief of Police, The minutes of the Regular Meeting of December 23, 1943, were read, and upon motion of Councilman Alford, were adopted as read by the following vote: "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilman Wolf absent. The following resolution was introduced by Councilman Bartholomews (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, SECTION 1. THAT the City Manager, or in his absence the Acting City Manager, be, and he is hereby, authorised and directed to enter into a contract in behalf of the CITY OF AUSTIN with the UNITED STATES OF AMERICA for the storing, handling, and delivery of aircraft engine fuel to the Army Air Forces at the Austin Municipal Airport for the period of January 1, 1944, to and including June 30, 1944, said contract to be in accordance with the terms and provisions of the attached Contract No. W 33-038-ac-1676 (11550). SECTION II. BE IT FURTHER RESOLVED that the City Manager, or in his absence the Acting Oity Manager, be, and he is hereby authorised and directed to execute for and in behalf of the CITY OF AUSTIN any renewals or. extensions of the above mentioned contract which in his judgment are expedient and beneficial to the CITY OF AUSTIN. SECTION III. That the City Clerk be, and she is hereby, authorized and directed to place a copy of this contract and agreement, which is attached hereto, in the permanent files of her office without the necessity of recording the contents of said contract in the minutes of the 01ty Council. The following resolution was introduced by Councilman Alfordi (RESOLUTION) WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be, and the same is hereby, permitted to lay and construct its gas mains in and upon the following streetas (1) A gas main in BONNIE ROAD from a point 46 feet west of Pecos Street westerly 177 fest, the centerline of which gas main shall be 7.5 feat south of, and parallel to, the north property line of said Bonnie Road. Said gas main described above shall have a cover of not less than 20 feet. (2) A gas main in RIVERVIEW STREET, from a point 99 feet west of Lynn Street westerly 41 fest, the centerline of which gas main shall be 7.5 feet north of, and parallel to, the south property line of said Riverview Street. Said gas main described above shall have a cover of not less than 2 feet. (3) A gas main in WHITTIER STREET, from a point 205 feet south of Hawthorne Street northerly 68 feet, the centerline of which gas main shall be 13.5 feet east of, and 332 232 parallel to, the west property line of said Whittier Street. Said gas main described above shall have a cover of not less than 2 feet. (4) A gas main in EAST TWENTIETH STREET from a point 57 feet east of Concho Street easterly 65 feet, the centerline of which gas main shall be 7.5 feet south of, and parallel to, the north property line of said East 20th Street. Said gas main described above shall have a cover of not less than 2 feet. (5) A gas main in BOB HARRISON STREET from a point 40 fest west of San Bernard Street westerly 35 feet, the centerline of which gas main shall be 35 feet south of, and parallel to, the north property line of said Bob Harrison Street. Said gas main described above shall have a cover of not less than 20 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the Oity Engineering Department notless than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is out in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid shall be under the supervision and direction of the 01 ty Manager, and under all the pertinent terms and conditions of the certain franchise granted to said company by the City of Austin. Upon motion of Councilman Alford, the foregoing resolution was adopted by the following votet "Ayes," Councilmen Alford, Bartholomew, Gillis, and Mayor Miller; "Nays," none; Councilman Wolf absent, The following resolution was introduced by Councilman Gilliss (RESOLUTION) WHEREAS, heretofore on the 16th day of March, 1939, by resolution of the City Council recorded in Minute Book 17, pages 452-453, of the Records of Minutes of the City Council of the City of Austin, the City Council closed and vacated two alleys of Mira Loma, a map or plat of which is recorded in Book 4, page 16, of the Plat Records of Travis County, Texas, but certain casement rights were retained for the construction, maintenance and operation of all public utilities in, upon and across the aforementioned alleys; and WHEREAS, such easement rights over the hereinafter described property no longer being needed, the City Council by resolution on the 1st day of May, 1941, authorised the Oity Manager to release and quitclaim to Ralph Greear and wife, Alta Greear, all of such easement rights; and WHEREAS, such instrument releasing such rights was executed and delivered by the City Manager but was lost or misplaced by said grantee and does not appear of record; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager, or in his absence the Acting City Manager, be, and he is hereby, authorised and directed, in the name of the City of Austin, to release and quitclaim unto Ralph Gresar and wife, Alta Gresar, all the City of Austin's right, title, interest, claim and demand in and to a portion of the alley extending in an easterly and westerly direction traversing Mira Loma between Vista Lane and John D.
