217 CITY OF AUSTIN, TEXAS 219 MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting February 10, 1944 11:20 A. M. Council Chamber, City Hall The meeting was called to order, with Mayor Miller presiding. Roll call Present: Councilmen Bartholomew, Gillis, Mayor Miller Absent : Councilmen Alford and Wolf 2 - -3 There were present also: Walter E. Seaholm, Acting City Manager; J. E. Motheral, City Engineer; J. M. Patterson, Jr., Acting City Attorney; and R. D. Thorp, Chief of Police. The minutes of the Regular Meetings of January 20, 1944, January 27, 1944, and February 3, 1944, were read; and upon motion of Councilman Gillis, were adopted as read by the following vote: Ayes: Councilmen Bartholomew, Gillis, and Mayor Miller Noes: None Absent: Councilmen Alford and Wolf The appeal of ROBERT E. MADDOX, by Ayres K. Ross, Attorney, for reinstatement of his taxicab driver's permit heretofore revoked, was heard. After considering the appeal, it was moved by Councilman Bartholomew that the said Robert E. Maddox be granted a 90-day probationary taxicab driver's permit. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Gillis, and Mayor Miller Noes: None Absent: Councilmen Alford and Wolf It was moved by Councilman Bartholomew that, upon the recommendation of the Acting City Manager and the Chief of Police, the taxicab driver's permit heretofore issued to THOMAS LEE SPOON be revoked. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Gillis, and Mayor Miller Noes: None Absent: Councilmen Alford and Wolf It was moved by Councilman Bartholomew that, upon the recommendation of the Acting City Manager and the Chief of Police, the taxicab driver's permit heretofore issued to DANIEL W. BYARS be revoked. The motion carried by the following votes Ayes; Councilmen Bartholomew, Gillis, and Mayor Miller Noes: None Absent: Councilmen Alford and Wolf CITY OF AUSTIN, TEXAS 220 Councilman Gillis offered the following resolution, and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Walter E. Seaholm, the Acting City Manager, is hereby authorized and directed in behalf of the City of Austin to execute a quitclaim deed to George A. Endress, conveying Lot No. 32, Outlot No. 38, Division "D", Samson's Subdivision in the City of Austin, Travis County, Texas, in consideration of the payment of all taxes and the court costs involved in tax suit No. 44558, City of Austin v. George A. Endress, in the 53rd District Court of Travis County, Texas. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes: Councilmen Bartholomew, Gillis, and Mayor Miller Noes: None Absent: Councilmen Alford and Wolf Councilman Bartholomew offered the following resolution, and moved its adoption: (RESOLUTION) WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the street in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be, and the same is hereby, permitted to lay and construct its gas mains in and upon the following street: A gas main in SANTA MARIA STREET from Prowse Lane easterly 95 feet, the centerline of which gas main shall be 7-1/2 feet south of, and parallel to, the north property line of said Santa Maria Street. Said gas main described above shall have a covering of not less than 25 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. CITY OF AUSTIN, TEXAS And that whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes: Councilmen Bartholomew, Gillis, and Mayor Miller Noes: None Absent: Councilmen Alford and Wolf The application of LYTTON'S DRIVE-IN, 4703 Burnet Road, by Mrs. J. L. Lytton, for a wine and beer permit, duly approved by the Acting City Manager, was submitted. Councilman Gillis moved that the permit be granted. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Gillis, and Mayor Miller Noes: None Absent: Councilmen Alford and Wolf H. L. KUHLMAN came before the Council and requested that more adequate provision be made for the preservation of relics belonging to the ex-Volunteer Firemen's Association now stored at the fire halls, Acting City Manager Seaholm reported that in the plans for remodeling of the West Austin Fire Hall provision had been made for the permanent preservation of such relics. The Acting City Attorney was instructed to prepare a resolution commemorating the life and public works of the late Joe Koen. The application of WALTER JEFFERSON WALKER, 1709 East 12th Street, for a taxicab license covering a Chevrolet Sedan, 1936 Model, Motor No. 6537770, State License No. FE-851, to replace Taxicab Permit No. 97 cancelled by Lester Warren Walker, duly approved by the Acting City Manager, was submitted. Councilman Bartholomew moved that the license be granted. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Gillis, and Mayor Miller Noes: None Absent: Councilmen Alford and Wolf The application of JOHN CALVIN MOORE, 1303 West 3rd Street, for a taxicab driver's permit, duly approved by the Acting City Manager, was submitted. Councilman Gillis moved that the permit be granted. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Gillis, and Mayor Miller Noes: None Absent: Councilmen Alford and Wolf The application of HOWARD LEE CAFFEY, 84 East Avenue, for a taxicab driver's permit, duly approved by the Acting City Manager, was submitted. Councilman Gillis moved that the permit be granted.
