2.30 CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting February 24, 1944 10:45 Α.Μ. Council Chamber, City Hall 230 The meeting was called to order, with Mayor Miller presiding. Roll call Present: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Absent: Councilman Wolf - 1 - 4 Present also: Walter E. Seaholm, Acting City Manager; J. E.Motheral, City Engineer; J. M. Patterson, Jr., Acting City Attorney; and R.D. Thorp, Chief of Police. Upon motion of Councilman Alford, the reading of the minutes was dispensed with. Mayor Miller offered the following resolution and moved its adoption: (RESOLUTION) JOSEPH KOEN was taken by death February 5, 1944. He was born in Russia in 1860 and came to this country in 1885. Soon afterwards he moved to Austin, where he made his home for some fifty-seven years. Joseph Koen served as an Alderman of our city government, as a member of the City Advisory School Board, and as a member of the Citizens' Advisory Committee for the rebuilding of the Tom Miller Dam. His friends knew him as an able, conscientious citizen who was unselfishly devoted to the welfare of the community; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Council desires to express its esteen and respect for him and its sorrow and condolence to his family upon his death by having a copy of this resolution entered in the minutes of the City Council and a copy of same signed by members of the Council furnished to the surviving members of his family. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilman Wolf 231 CITY OF AUSTIN, TEXAS 231 S. I. WILSON, colored, came before the Council and submitted an offer in writing to sell the City a five-acre tract of land on East 12th Street just west of the City Incinerator for a playground for small Negro children, the consideration for same being $12,000.00. The matter was taken under advisement. A petition, signed by Parent-Teacher Association of Blackshear School, Tillotson College, Holy Cross Hospital and School, and Negro citizens, asking for an asphalt topping on 11th Street from Comal to Chicon Streets, was received. The matter was referred to the Acting City Manager and the Engineering Department for consideration. Councilman Bartholomew offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, on the 22nd day of February, 1944, Walter E. Seaholm, Acting City Manager, acting for and in behalf of the City of Austin, executed a lease with the Braniff Airways, Inc., pertaining to the Austin Municipal Airport. To facilitate the final consummation of said transaction, said lease was executed by Walter E. Seaholm, the Acting City Manager, before the adoption of this resolution. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the execution of the above mentioned lease, a copy of which is attached hereto, is hereby ratified and affirmed by the City Council of the City of Austin. BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Clerk be, and she is hereby, authorized and directed to attach a duplicate original of this resolution to said lease and file said lease in the permanent files of her office without the necessity of recording the contents of said lease in the Minutes of the City Council. Seaholm, the Acting City Manager of the City of Austin, be, and he is hereby, authorized and directed to execute for and in behalf of the CITY OF AUSTIN a warranty deed to T. C. Steiner conveying a portion of Outlot No. 37, Division "E" of the Government Outlots adjoining the Original City of Austin, Travis County, Texas, according to map or plat of said Government Outlots on file in the General Land Office of 23 CITY OF AUSTIN, TEXAS 232 the State of Texas, said property being more particularly described by metes and bounds as follows: Beginning at an iron stake set at the southeast corner of said Hamilton to City of Austin tract of land, same being the northeast corner of a tract of land conveyed to R. G. Mueller by R. B. Robbins by deed dated December 30,1941, of record in Volume 627, page 464 of the Deed Records of Travis County, Texas, and from which iron stake the southeast corner of Outlot 37, Division "E", bears S. 19001 W.144.22 feet; Thence N. 70°49' W. at 128.96 feet pass an iron stake at the northwest corner of the aforementioned Robbins to Mueller tract of land, in all a distance of 129.06 feet to an iron stake set at the southwest corner of the said Hamilton to City of Austin tract or parcel of land; Thence N. 18°56' E. 39.73 feet to an iron stake set at the northwest corner of the aforementioned tract or parcel of land, same being the southwest corner of a tract or parcel of land conveyed to C. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Acting City Manager be, and he is hereby, authorized and directed to destroy, or cause to be destroyed, by cremation in the City Incinerator, before witnesses, all such bonds and interest coupons having been fully recorded and verified as above stated. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilman Wolf Acting City Manager Seaholm submitted a written request from Dr. Z. T. Scott, Chairman of the Austin-Travis County Tuberculosis Sanatorium Board, for an increase in the Budget appropriation for said Sana- torium in an amount of Three Thousand Dollars ($3,000.00). The request was referred back to the Acting City Manager to find out what the County proposes to do in the matter. The appeal of DANIEL W. BYARS for restoration of his taxicab driver's permit, heretofore revoked, was heard. After considering the appeal, it was moved by Councilman Alford that the said Daniel W. Byars be granted a taxicab driver's permit for a 30-day probationary period, condition-- ed upon his first submitting the Chief of Police his discharge papers from the Navy, and the approval of same by said Chief of Police. The motion carried by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, and Mayor Miller Noes: None Absent: Councilman Wolf Councilman Gillis offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, the newly constructed State Highway 29 passes through the northeast portion of the City of Austin, and part of said highway lies within the corporate limits of said City; and WHEREAS, a name for the portion of said highway 29 within the City limits has not been adopted; and WHEREAS, said Highway 29 is a direct route between Bergstrom Field Airport, the Municipal Airport, and the University Airport; and and WHEREAS, AIRPORT BOULEVARD has been suggested as an appropriate name; WHEREAS, the City Council has considered said name and believes it should be adopted; now, therefore, 235 CITY OF AUSTIN, TEXAS 235 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the name AIRPORT BOULEVARD be, and the same is hereby, adopted for all that portion of State Highway 29 situated within the corporate limits of the City of Austin. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes : Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilman Wolf Councilman Gillis offered the following resolution and moved its adoptions (RESOLUTION) WHEREAS it has been determined that the assessment for taxes for the year 1943 against the beauty shop equipment of the Cactus Beauty Shop in Austin, Travis County, Texas, is excessive, and that same should be corrected; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the assessment for taxes on the above mentioned equipment for the year 1943 be, and the same is hereby, reduced and corrected from the present assessed value of $600.00 to $300.00, and that the City Assessor and Collector of taxes is authorized and directed to make such change in the tax rolls. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilman Wolf Councilman Alford offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, City of Austin taxes were assessed in the name of J.P.McPherson for the years 1935, 1938, 1939, 1940, and 1943, on the east half of Lot 6, Block 4, Outlot 69, Division "D", Byrne Subdivision, in the City of Austin, Travis County, Texas, said taxes for said years being in the amount of $366.79, and for non-payment of same at maturity, penalty in the sum of $14.50 has been assessed, and interest in the amount of $83.42 has accrued, making the total amount of taxes, penalties and interest due $464.71; and WHEREAS, the City Council of the City of Austin deems it just and equitable to remit said penalty in the sum of $14.50, and one-half of the interest in the sum of $41.71; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the aforesaid penalty in the sum of $14.50 and one-half of the CITY OF AUSTIN, TEXAS interest in the sum of $41.71 are hereby remitted, and the Tax Assessor and Collector of the City of Austin is hereby authorized and directed to charge said penalty in the sum of $14.50 and said interest in the sum of $41.71 off his rolls, and to issue to the party entitled to receive same a receipt in full upon the payment of the aforesaid taxes and one-half of the interest, as aforesaid.
