37 CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting March 23,1944 10:30 Α.Μ. Council Chamber, City Hall 259 The meeting was called to order, with Mayor Miller presiding. Roll call Present: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Absent : Councilman Wolf 1 4 Present also: Walter E. Seaholm, Acting City Manager; J. E. Motheral, City Engineer; J. M. Patterson, Jr., Acting City Attorney; and R. D.Thorp, Chief of Police. The minutes of the meetings of March 6, March 7, March 9, and March 16, 1944, were read; and upon motion of Councilman Alford were adopted as read by the following votes Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilman Wolf MESSRS. HORANCE SHELTON and PAUL BOWMAN, representing Travis Post No.76, American Legion, came before the Council and submitted a request that the City contribute to the services of a County Service Officer to handle the claims for compensation of disabled World War II veterans; and recommended the appointment of Emil Kuehne as such officer. After a discussion of the matter, it was moved by Councilman Bartholomew that the request be granted and the sum of One Hundred. Seventy-five Dollars ($175.00) per month be appropriated for the purpose stated, as long as same is necessary; that the City Council concur in the recommendation for the appointment of EMIL KUEHNE to the position; and that the Acting City Manager be instructed to notify the Commissioners Court of the action of the City Council, with a view to getting said Commissioners Court to take similar action. The motion carried by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilman Wolf The application of CHARLES EDWARD MABRY, 5210 Clarkson Avenue, for a taxicab driver's permit, duly approved by the Acting City Manager, was submitted. Councilman Alford moved that the permit be granted. The motion CITY OF AUSTIN, TEXAS 260 carried by the following votes Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller. Noes : None Absent: Councilman Wolf The application of EXEL HAMBY, 509 East 15th Street, for a taxicab driver's permit, duly approved by the Acting City Manager, was submitted. Councilman Alford moved that the permit be granted. The motion carried by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller. Noes : None Absent: Councilman Wolf The appeal of THOMAS LEE SPOON, 110 Mildred Street, for reconsideration of his application for renewal of his taxicab driver's permit, was heard. After considering same, it was moved by Councilman Alford that upon the recommendation of the Chief of Police the said Thomas Lee Spoon be granted a permit to drive a taxicab for a probationary period of ninety (90) days. The motion carried by the following vote: Ayes : Councilmen Alford, Bartholomew, Gillis, Mayor Miller. Noes : None Absent: Councilman Wolf The appeal of JAMES HARRY NICHOLSON, 505 West 11th Street, for renewal of his taxicab driver's permit, which had been recommended for denial, was heard. After considering same, it was moved by Councilman Alford that upon the recommendation of the Chief of Police, the said James Harry Nicholson be granted a permit to drive a taxicab for a probationary period of ninety (90) days, the permit to be made permanent at the expiration of that period if applicant's record is satisfactory, applicant to report to the Chief of Police once a month in the meantime. The motion carried by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller. Noes: None Absent: Councilman Wolf The application of THE TAVERN, 922 West 12th Street, by Dave Bassit, owner, for a wine and beer permit, duly approved by the Acting City Manager, was submitted. Councilman Bartholomew moved that the permit be granted. The motion carried by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller. Noes: None Absent: Councilman Wolf The application of DR. ROBT. W. SHIPP for a change in zoning of the premises at 1510-12 Lavaca Street from a "C-1" Commercial District to a "C-2" Commercial District, was received. The matter was referred to the Board of Adjustment for consideration and report, and a public hearing on same was called for April 13 next at 11:00 A. Μ. Councilman Bartholomew offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Acting City Manager be, and he is hereby, authorized and CITY OF AUSTIN, TEXAS 261 directed to execute and file an application on behalf of the City of Austin to the United States of America through the Federal Works Agency for a grant to aid in financing the alterations and additions to the Nurses Home at Brackenridge Hospital. THAT the Acting City Manager be, and he is hereby, authorized and directed to furnish such information as the United States of America through the Federal Works Agency may reasonably request in connection with the application which is herein authorized to be filed. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes : 'Councilmen Alford, Bartholomew, Gillis, Mayor Miller. Noes: None Absent: Councilman Wolf Councilman Alford offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, the Texas Public Service Company has conducted a leakage survey on San Jacinto Boulevard from a point 32 feet north of the south line of East 12th Street northerly to a point 103 feet south of the south line of East 13th Street; and WHEREAS, numerous gas leaks were found which are hazardous to the general public; and WHEREAS, the Texas Public Service Company has requested permission to cut the pavement in the aforementioned block at twelve-foot intervals in order to repair leaks at each bell joint and also to cut the pavement and sidewalk area at all service locations in order to make the necessary repairs to their gas main; and WHEREAS, said Company has agreed to repair said street and sidewalk area in accordance with the direction of the City Engineer, and to pay all expenses incidental to the restoration of said pavement and sidewalk area; and WHEREAS, said request has been reviewed and considered by the City Council of the City of Austin; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Texas Public Service Company be permitted to cut the pavement on San Jacinto Boulevard from a point 32 feet north of the south line of East 12th Street northerly to a point 103 feet south of the south line of East 13th Street at twelve-foot intervals in order to repair leaks at each bell joint and also to cut the pavement and sidewalk area at all service locations in order to make the necessary repairs to their gas main. VIVIAN JEAN PORTER, 600 West 15th Street, for a taxicab driver's permit was submitted. Councilman Alford moved that, upon the recommendation of the Chief of Police, applicant be granted a taxicab driver's permit, for daylight driving only, for a probationary period of ninety (90) days. The motion carried by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller. Noes : None Absent: Councilman Wolf Councilman Gillis offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, City of Austin taxes were assessed in the name of Saint Joseph Grand Lodge for the year 1937 through 1942 on Lot 5, Block 8, Outlots 2 and 3, Division "B", in the City of Austin, Travis County, Texas, said taxes being in the amount of $174.50 and for non-payment of same at maturity penalty in the sum of $8.72 has been assessed, and interest in the amount of $36.17 has accrued, making a total amount of taxes, penalty and interest due $219.39; and WHEREAS, the City Council of the City of Austin deems it just and equitable to remit said penalty in the sum of $8.72, and one-half of the interest in the sum of $18.08; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the aforesaid penalty in the sum of $8.72 and one-half of the interest in the amount of $18.08 are hereby remitted, and the Tax Assessor and Collector of the City of Austin is hereby authorized and directed to charge said penalty and said interest off his rolls and to issue to the party entitled to receive same a receipt in full upon the payment of the aforesaid taxes and one-half of the interest, as aforesaid. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes : Councilmen Alford, Bartholomew, Gillis, Mayor Miller.
