Council Chamber, City Hall 502 The meeting was called to order, with Mayor Miller presiding. Roll call Present: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Absent : Councilman Wolf 1 - - 4 Present also: J. E. Motheral, City Engineer; J.M.Patterson, Jr., Acting City Attorney; and R. D. Thorp, Chief of Police. Absent, Walter E. Seaholm, Acting City Manager. The minutes of the Regular Meeting of June 8, 1944, were read, and on motion of Councilman Alford, were adopted as read by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller; Noes: None Absent: Councilman Wolf The appeal of FRED OREN BROWN on his application for a taxicab driver's permit, recommended for denial, was heard. After consideration of the facts in the case, it was moved by Councilman Alford that the said Fred Oren Brown be granted a permit to drive a taxicab for a probationary period of ninety (90) days, conditioned upon his reporting to the Chief of Police at thirty day intervals in the meantime. The motion carried by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, and Mayor Miller. Noes: None Absent: Councilman Wolf The application of JAMES GORDON COX, 300 Congress Avenue, for a taxicab license covering a 180 Model Chevrolet Sedan, Engine No. 3651896, State License No. 172-112 (1942), No. FR3-212 (1944), to replace Taxicab Permit No. 6 can. celled by Walter W. Owens, duly approved by Acting City Manager, was submitted. Councilman Bartholomew moved that the license be granted. The motion carried by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, and Mayor Miller. Noes: None Absent: Councilman Wolf MESSRS. BEN R. SCHIEFFER and S. Z. SKINNER came before the Council and requested that some action be had on the petition heretofore submitted by CITY OF AUSTIN, TEXAS 503 the property owners in the vicinity of Hollywood Avenue and Werner Avenue north of Edgewood Avenue for elimination of a bad drainage condition there. After considerable discussion, action on the matter was postponed pending an inspection on the ground by the City Engineer, the Acting City Attorney, and the City Council, to determine whether the City has any obligation in the matter. REVEREND W. L. HOLLAND, Colored, Pastor of the Sweet Home Baptist Church, came before the Council and asked that a playground for the Negroes be built in Clarksville. The matter was referred to the Recreation Department for consideration. Councilman Gillis introduced the following ordinance: AN ORDINANCE TENTATIVELY FIXING AND LEVYING MUNICIPAL TAXES FOR THE CITY OF AUSTIN, TEXAS, FOR THE YEAR 1944; AND DECLARING AN EMERGENCY. The ordinance was read the first time and Councilman Gillis moved that the rules be suspended and the ordinance be passed to its second reading. The motion carried by the following vote: Ayes : Councilmen Alford, Bartholomew, Gillis, Mayor Miller. Noes : None Absent: Councilman Wolf The ordinance was read the second time and Councilman Gillis moved that the rules be further suspended and the ordinance be passed to its third reading. Noes : None ed. ion: Absent: Councilman Wolf Thereupon the Mayor announced that the ordinance had been finally passCouncilman Alford offered the following resolution, and moved its adopt- (RESOLUTION) WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be, and the same is hereby, permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in CHICON STREET from a point 37 feet north of East 14th Street southerly 1ll feet, the centerline of which 501 CITY OF AUSTIN, TEXAS gas main shall be ll feet west of, and parallel to, the east property line of said Chicon Street. Said gas main described above shall have a covering of notless than 2-1/2 feet. (2) A gas main in COLLEGE ROW from a point 235 feet east of Chicon Street easterly 97 feet, the centerline of which gas main shall be 7 feet south of, and parallel to, the north property line of said College Row. Said gas main described above shall have a covering of notless than 2-1/2 feet. (3) A gas main in EAST 51ST STREET from a point 16 feet west of East Avenue westerly 143 feet, the centerline of which gas main shall be 7-1/2 feet south of, and parallel to, the north property line of said East 51st Street. Said gas main described above shall have a covering of notless than 2-1/2 feet. (4) A gas main in AIRPORT BOULEVARD, EAST 50TH STREET south 195 feet, the centerline of which gas main shall be 9 feet west of, and parallel to, the east property line of said Airport Boulevard. Said gas main described above shall have a covering of notless than 2-1/2 feet. (5) A gas main in EAST 52ND STREET from a point 84 feet east of Depew Avenue easterly 119 feet, the centerline of which gas main shall be 7-1/2 feet south of, and parallel to, the north property line of said East 52nd Street. Said gas main described above shall have a covering of notless than 2-1/2 feet. (6) A gas main in LAWSON LANE, Dotzon Street to Gregory Street, the centerline of which gas main shall be 2 feet west of, and parallel to, the east property line of said Lawson Lane. Said gas main described above shall have a covering of notless than 2-1/2 feet. (7) A gas main in GREGORY STREET, Lawson Lane west 85 feet, the centerline of which gas main shall be 6 feet south of, and parallel to, the north property line of said Gregory Street. Said gas main described above shall have a covering of notless than 2-1/2 feet. (8) A gas main in WHITTIER STREET from a point 141 feet north of Hawthorne Street southerly 18 feet, the centerline of which gas main shall be 13-1/2 feet east of, and parallel to, the west property line of said Whittier Street. Said gas main described above shall have a covering of notless than 2-1/2 feet. 504 500 CITY OF AUSTIN, TEXAS 505 The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Ayes: Noes : None Absent: Councilman Wolf It was moved by Councilman Alford that, in accordance with the recommendation of the Chief of Police, the taxicab driver's permit issued to THOMAS LEE SPOON be revoked. Councilman Alford moved that the permit be granted if upon further investigation by the Police Department applicant's driving record is satisfactory.
