575 CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting August 24, 1944 10:30 Α.Μ. Council Chamber, City Hall 575 The meeting was called to order, with Mayor Miller presiding. Roll call Present: Councilmen Bartholomew, Gillis, Mayor Miller Absent : Councilmen Alford and Wolf -2 - 3 Present also: Walter E. Seaholm, Acting City Manager; J.E.Motheral, City Engineer; J. M. Patterson, Jr., Acting City Attorney; and R. D. Thorp, Chief of Police. The minutes of the Regular Meeting of August 17, 1944, were read, and on motion of Councilman Gillis, were adopted as read by the following vote: Ayes: Councilmen Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilmen Alford and Wolf A proclamation by the Mayor, proclaiming V-DAY, the day that Germany unconditionally surrenders to the Allies, as a day of thanks to Almighty God for the victory; and urging all business firms, wherever possible to do so, to close on that day in order that their employees may join with their families in a proper observance of the day, was approved. The application of JAMES EDWARD WILKERSON, 602 West 8th Street, for a taxicab driver's permit, duly approved by the Acting City Manager, was submitted. Councilman Bartholomew moved that the permit be granted. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilmen Alford and Wolf The application of ELDON DEE LANE, 4004 Avenue C, for a taxicab driver's permit, duly approved by the Acting City Manager, was submitted. Councilman Bartholomew moved that the permit be granted. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilmen Alford and Wolf 51 CITY OF AUSTIN, TEXAS The application of JESSE LEE RHYMES, Star Route B, Box 109-A, for a 576 taxicab driver's permit, duly approved by the Acting City Manager, was submitted. Councilman Gillis moved that the permit be granted. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilmen Alford and Wolf The application of NELSON GARRETT, 1600 East 3rd Street, for a taxicab driver's permit, duly approved by the Acting City Manager, was submitted. Councilman Gillis moved that the permit be granted. MCELROY for permission to operate a horse-back riding business in the 1500 block on Barton Springs Road was received. The matter was referred to the Board of Adjustment for consideration. ion: Councilman Gillis offered the following resolution and moved its adopt(RESOLUTION) WHEREAS, taxes for the years 1930 through 1943, were assessed against improvements on Lot 10, Block 6, Outlot 48, Division "0", Riverside Subdivision, located in the City of Austin, Travis County, Texas, said taxes being assessed in the name of Mrs. Louisa Staples Estate; and WHEREAS, it has been determined that no improvements existed on said property during said years, and that assessment against said improvements has been carried erroneously on the rolls of the City Tax Assessor and Collector; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the taxes assessed for the years 1930 through 1943 on the improvements on Lot 10, Block 6, Outlot 48, Division "O", Riverside Subdivision, in the City of Austin, Travis County, Texas, be, and the same are hereby cancelled and the Tax Assessor and Collector is authorized and directed to strike same from the tax rolls. This action shall not affect the assessments for taxes against the above described real estate, but shall apply to improvements only. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: ion: Ayes : Councilmen Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilmen Alford and Wolf Councilman Gillis offered the following resolution and moved its adopt(RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: 57T CITY OF AUSTIN, TEXAS 577 THAT Walter E. Seaholm, the Acting City Manager, be, and he is hereby authorized and directed to execute for and in behalf of the CITY OF AUSTIN a special warranty deed to Harwood Stacy, conveying all the right, title and interest acquired by the City of Austin to a tract of land 100 x 131 feet out of a tract of three and three-sevenths (3-3/7) acres, subdivision of the Bouldin Estate, out of Abstract 8, Survey 20, Isaac Decker League, Austin, Travis County, Texas, by Cause No. 20244, and Order of Sale and sale to the City of Austin by deed dated September 9, 1903, recorded in Book 564, pages 303-304, Deed Records of Travis County, Texas, for such consideration as said Walter E. Seaholm may deem adequate and sufficient. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes : Councilmen Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilmen Alford and Wolf The City Engineer reported favorably on the petition of property owners asking for the closing of the alley in Block No. 7 of Walsh Place. Councilman Gillis then offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, in Book 3, page 26 of the Plat Records of Travis County, Texas, there appears a map or plat of a subdivision of land known as Walsh Place on Lake Austin; and WHEREAS, upon said map or plat there is shown various streets and alleys; also various lots and blocks, one block being designated as Block 7 and being traversed by an alley 20 feet in width; and WHEREAS, the owners of a majority of the property abutting said alley have petitioned the City Council of the City of Austin to vacate and abandon said alley; and WHEREAS, said petition has been reviewed and considered by the City Council of the City of Austin; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT that certain alley traversing Block 7 of Walsh Place on Lake Austin as referred to above be permanently closed and vacated, except however, the City of Austin hereby reserves the right to construct, maintain, operate, and control all public utilities in, upon, over, and across said alley. Seaholm, the Acting City Manager of the City of Austin, be, and he is hereby, authorized and directed to execute for and in behalf of the CITY OF AUSTIN a general warranty deed to Everett L. Looney, conveying a part of Outlot No. 14, in Division "C", of the Government Outlots adjoining the Original City of Austin, Travis County, Texas, according to map or plat of said Government Outlots on file in the General Land Office of the State of Texas, said property being more particularly described by metes and bounds as follows: Beginning at an iron stake which is the most northerly corner of that certain tract of land which was conveyed to F. Schuber by Jas. H. Robertson and J. E. Wildbahn in accordance with a deed recorded in Travis County Deed Records, Vol, 113, page 219; thence S. 30° W. 135.45 feet to an iron stake on the northwest line of that tract conveyed to F. Schuber by Jas. H. Robertson and J. E. Wildbahn; thence S. 59° 56' E. 151.7 feet to an iron stake; thence N. 30°2' E. 135.0 feet to the southeast face of a 3 inch pipe post in the E. H. Perry fence; thence N. 59° 40 W. 151.75 feet to the place of the beginning, and containing 20,517 square feet of land, for a total consideration of THREE HUNDRED AND FIFTY DOLLARS ($350.00) and legal services heretofore rendered. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes: Councilmen Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilmen Alford and Wolf Councilman Bartholomew offered the following resolution and moved. its adoption: (RESOLUTION) WHEREAS, the City of Austin taxes for the years 1933, 1934, 1935 and 1939, were assessed in the name of Mrs. J. E. Phillips on E. 23-1/2 feet of Lot 3 and W. 23 feet of Lot 4, Block 177, Original City, all of said property being located in the City of Austin, Travis County, Texas; said taxes for said years being in the amount of $293.92, and for nonpayment of same at maturity penalty in the sum of $14.70 has been assessed and interest in the amount of $143.60 has accrued, making the total amount of taxes, penalties, and interest due $452.22; and WHEREAS, the City Council of the City of Austin deems it just and equitable to remit said penalty in the sum of $14.70 and one-half of the interest in the sum of $71.80; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the aforesaid penalty in the sum of $14.70 and one-half of the interest in the sum of $71.80 are hereby remitted, and the Tax Assessor and Collector of the City of Austin is hereby authorized and directed to charge said penalty in the sum of $14.70 and said interest in the sum of $71.80 off his rolls and to issue to the party entitled to receive same a receipt in full upon the payment of the aforesaid taxes and one-half of the interest, as aforesaid. 579 CITY OF AUSTIN, TEXAS Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes: Councilmen Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilmen Alford and Wolf There being no further business, upon motion, seconded and carried, the meeting was recessed at 11:15 A.
