The minutes of the Regular Meeting of August 24, 1944, were read, and on motion of Councilman Gillis, were adopted as read by the following vote: Ayes: Councilmen Alford, Gillis, Mayor Miller Noes: None Absent: Councilmen Bartholomew and Wolf The application of HOWARD WYNN'S PLACE, 1100 East 11th Street, for a Wine and Beer Retailer's permit, duly approved by the Acting City Manager, was submitted. The motion carried by the following vote: ion: Ayes: Councilmen Alford, Gillis, Mayor Miller Noes: None Absent: Councilmen Bartholomew and Wolf Councilman Gillis offered the following resolution and moved its adopt(RESOLUTION) WHEREAS, the curb and sidewalk specifications of the City of Austin, Texas, which have been previously adopted by the City Council of the City of Austin require that all curbs and sidewalks be constructed of concrete unless a special permit has been secured from the City Council of the City of Austin to construct curbs, sidewalks and ramps of other materials; and WHEREAS, Mrs. F. S. Peterson, a widow, owner of Lot 3, Outlot 5, Division "C", Park Hill Addition, a subdivision within the City of Austin, Travis County, Texas, which property abuts the south side of Park Place, and being known locally at 709 Park Place, has requested the City Council of the City of Austin to grant permission to construct three (3) rock retaining walls across the sidewalk area at the above described location; and WHEREAS, the City Council of the City of Austin has investigated and approved the construction of said retaining walls; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Mrs. F. S. Peterson, a widow, owner of Lot 3, Outlot 5, Division "C", Park Hill Addition, a subdivision within the City of Austin, Travis County, Texas, which property abuts the south side of Park Place, being known locally at 709 Park Place, is hereby granted permission to construct three (3) rock retaining walls across the sidewalk area at the above described location, and said retaining walls are to be constructed under the supervision and direction of the City Engineer of the City of Austin, and that the said rock retaining walls shall be laid in a smooth and workmanlike manner, and that the same shall not create a hazard to pedestrians. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: ion: Ayes: Councilmen Alford, Gillis, Mayor Miller Noes: None Absent: Councilmen Bartholomew and Wolf Councilman Alford offered the following resolution and moved its adopt(RESOLUTION) WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore 58% CITY OF AUSTIN, TEXAS 583 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be, and the same is hereby, permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in EAST 3RD STREET from Pedernales Street easterly 832 feet, the centerline of which gas main shall be 7층 feet south of, and parallel to, the north property line of said East 3rd Street. Said gas main described above shall have a covering of notless than 2 feet. (2) A gas main in CONCHO STREET from East 21st Street northerly 203 feet, the centerline of which gas main shall be 75 feet west of, and parallel to the east property line of said Concho Street. Said gas main described above shall have a covering of notless than 20 feet. (3) A gas main in CURVE STREET from a point 63 feet north of East 11th Street northerly 94 feet, the centerline of which gas main shall be 9 feet west of, and parallel to, the east property line of said Concho Street. Said gas main described above shall have a covering of notless than 20 feet. (4) A gas main in HACKBERRY STREET from a point 62 feet west of Angelina Street easterly to Angelina Street, the centerline of which gas main shall be 13 feet south of, and parallel to, the north property line of said Hackberry Street. Said gas main described above shall have a covering of notless than 2-1/2 feet. (5) A gas main in EAST 9TH STREET from a point 205 feet east of Lincoln Street easterly 529 feet, the centerline of which gas main shall be 7 feet north of, and parallel to, the south property line of said East 9th Street. Said gas main described above shall have a covering of notless than 2 feet. (6) A gas main in EAST AVENUE from a point 490 feet north of East 46th Street northerly 100 feet, the centerline of which gas main shall be 7½ feet west of, and parallel to, the east property line of said East Avenue. : Said gas main described above shall have a covering of notless than 25 feet. (7) A gas main in RIVERVIEW STREET from a point 60 feet east of Lynn Street easterly 60 feet, the centerline of which gas main shall be 7½ feet north of, and parallel to, the south property line of said Riverview Street. 587 CITY OF AUSTIN, TEXAS Said gas main described above shall have a covering of notless than 25 feet. (8) A gas main in SOUTH 2ND STREET from West Johanna Street southerly 159 feet, the centerline of which gas main shall be 10 feet west of, and parallel to, the east property line of said South 2nd Street. Said gas main described above shall have a covering of notless than 22 feet. (9) A gas main in EAST 10TH STREET from a point 233 feet east of Lincoln Street easterly 84 feet, the centerline of which gas main shall be 7 feet north of, and parallel to, the south property line of said East 10th Street. Said gas main described above shall have a covering of notless than 22 feet. 584 The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Depart- ment not less than three (3) days before such information is required. The Texas Public Service is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: ion: Ayes: Councilmen Alford, Gillis, Mayor Miller Noes; None Absent: Councilmen Bartholomew and Wolf Councilman Gillis offered the following resolution and moved its adopt(RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: SECTION 1. That Walter E. Seaholm, the Acting City Manager, be, and he is hereby, authorized and directed to enter into a contract in behalf of the City of Austin with the State Board for Vocational Education, for 5 Du CITY OF AUSTIN, TEXAS 585 services rendered at the Brackenridge Hospital, Austin, Texas, to patients authorized for treatment by the supervisor of physical restoration or director of vocational rehabilitation, State Board for Vocational Education, a copy of said contract being attached hereto. SECTION 2. That the City Clerk be, and she is hereby, authorized and directed to place the contract, which is attached hereto, in the parmanent files of her office without the necessity of recording the contents of said contract in the minutes of the City Council. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes : Councilmen Alford, Gillis, Mayor Miller Noes : None Absent: Councilmen Bartholomew and Wolf Acting City Manager Seaholm submitted a written request from the Naval Aid Auxiliary Organization, operating under jurisdiction of President's War Relief Control Board, Washington, D. C., for permission to use West 7th Street for a three-day period during the latter part of October for the showing of a Jap Zero plane. Councilman Gillis moved that the request be granted. The motion carried by the following vote: Ayes: Councilmen Alford, Gillis, Mayor Miller Noes: None Absent: Councilmen Bartholomew and Wolf There being no further business, upon motion, seconded and carried, the meeting was recessed at 11:10 A.
