CITY OF AUSTIN, TEXAS 613 MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting October 05, 1944 10:40 Α.Μ. Council Chamber, City Hall The meeting was called to order, with Mayor Miller presiding. Roll call Present: Councilmen Alford, Bartholomew, Gillis, Mayor MillerAbsent : Councilman Wolf - 1 Present also: Walter E. Seaholm, Acting City Manager; J.E. Motheral, City Engineer; J. M. Patterson, Jr., Acting City Attorney. The reading of the minutes was dispensed with, upon motion of Councilman Alford. A committee from the Iron Workers Union #482, with L. A. Smith as spokesman, came before the Council and complained that the prevailing wage scale for steel workers was not being paid by the Contractor for the construction of a culvert on Windsor Road at Sharon Lane. The matter was re- ferred to the City Engineer for investigation. The application of LYLES' PACKAGE STORE, 110 East 6th Street, for a permit to operate a package store, duly approved by the Acting City Manager, was submitted. Councilman Bartholomew moved that the permit be granted. The motion carried by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilman Wolf MRS. GEORGE VAN FLEET, chairman of the state-wide movement to induce civilians to plant the Pyracantha (Fire Thorn) shrub, or any other shurb or flower, as a living honor to the returning service men and women, came before the Council and requested that the City participate in the movement by contacting those people who could not be reached by other methods. It was the sense of the meeting that the request be granted; and that the sponsors submit a short, concise statement covering the matter, to be mimeographed by the City and mailed out with the water and light bills. R. E. JANES appeared before the Council relative to his written application for a permit to build a spur track and loading ramp on his property contiguous to the Colorado River west of Lamar Boulevard, for the purpose 6/4 CITY OF AUSTIN, TEXAS 614 of loading crushed rock, sand, and gravel. After considerable discussion, the matter was taken under advisement. A committee from the Chamber of Commerce, composed of Messrs. Nagle, Long, and Schulle, appeared before the Council and asked that the week of October 8-14 be proclaimed as Fire Prevention Week. Mayor Miller then moved "That the City Council, recognizing the fact that for a number of years the Chamber of Commerce has designated Fire Prevention Week, which has been very helpful in making the people fire con- scious and in keeping down the fire insurance rate for Austin, hereby proclaims the week of October 8-14 as Fire Prevention Week, and pledges to the Chamber of Commerce the cooperation of the City in the matter in every way possible, " Which motion carried by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilman Wolf. The application of PVT. ROBERT H. ALLEN, Bergstrom Field, for a taxicab driver's permit, duly approved by the Acting City Manager, was submit- ted. Councilman Alford moved that the permit be granted. The motion carried by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilman Wolf Councilman Bartholomew offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, the curb and sidewalk specifications of the City of Austin, Texas, which have been previously adopted by the City Council of the City of Austin require that all curbs and sidewalks be constructed of concrete unless a special permit has been secured from the City Council of the City of Austin to construct curbs, sidewalks and ramps of other materials; and WHEREAS, Miss Bird Smith, a feme sole, owner of Lot 4, Outlot 5, Division "C", Park Hill Addition, a subdivision within the City of Austin, CITY OF AUSTIN, TEXAS Travis County, Texas, which property abuts the south side of Park Place, and being locally known as 711 Park Place, has requested the City Council of the City of Austin to grant permission to construct three (3) rock retaining walls across the sidewalk area at the above described location; and 615 WHEREAS, the City Council of the City of Austin has investigated and approved the construction of said retaining walls; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Miss Bird Smith, a feme sole, owner of Lot 4, Outlot 5, Division "C", Park Hill Addition, a subdivision within the City of Austin, Travis County, Texas, which property abuts the south side of Park Place, and being locally known as 711 Park Place, is hereby granted permission to construct three (3) rock retaining walls across the sidewalk area at the above described location, and said retaining walls are to be constructed under the supervision and direction of the City Engineer of the City of Austin, and that the said rock retaining walls shall be laid in a smooth and workmanlike manner, and that the same shall not create a hazard to pedestrians. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilman Wolf Councilman Alford offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be, and the same is hereby, pernitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in WASHINGTON AVENUE from Poquito Street easterly 436 feet, the centerline of which gas main shall be 12 feet south of, and parallel to, the north property line of said Washington Avenue. Said gas main described above shall have a covering of not less than 2-1/2 feet. (2) A gas main in EAST 5TH STREET from a point 43 feet west of Pace Street westerly 118 feet, the centerline of which gas main shall be 13-1/2 feet north of, and parallel to, the south property line of said East 5th Street. Said gas main described above shall have a covering of not less than 2-1/2 feet. CITY OF AUSTIN, TEXAS (3) A gas main in EAST 3RD STREET from a point 83 feet east of Navasota Street easterly 330 feet, the centerline of which gas main shall be 9 feet south of, and parallel to, the north property line of said East 3rd Street. Said gas main described above shall have a covering of not less than 2-1/2 feet. (4) A gas main in CHESTNUT AVENUE from a point 171 feet north of Rosewood Avenue northerly 86 feet, the centerline of which gas main shall be 12 feet west of, and parallel to, the east property line of said Chestnut Avenue. Said gas main described above shall have a covering of not less than 2-1/2 feet. (5) A gas main in EAST 17TH STREET from Salina Street easterly 110 feet, the centerline of which gas main shall be 7-1/2 feet south of, and parallel to, the north property line of said East 17th Street. Said gas main described above shall have a covering of not less than 2-1/2 feet. (6) A gas main in POQUITO STREET from a point 32 feet north of East 20th Street south to East 20th Street, the centerline of which gas main shall be 9 feet east of, and parallel to, the west property line of said Poquito Street. Said gas main described above shall have a covering of not less than 2-1/2 feet. (7) A gas main in EAST 20TH STREET from Poquito Street westerly 77 feet, the centerline of which gas main shall be 7-1/2 feet south of, and parallel to, the north property line of said East 20th Street. Said gas main described above shall have a covering of not less than 2-1/2 feet. (8) A gas main in EAST 11TH STREET from a point 87 feet east of Prospect Avenue easterly 360 feet, the centerline of which gas main shall be 22 feet south of, and parallel to, the north property line of said East 11th Street. Said gas main described above shall have a covering of not less than 2-1/2 feet. (9) A gas main in SOUTH 3RD STREET from a point 487 feet south of West Live Oak Street southerly 164 feet, the centerline of which gas main shall be 13-1/2 feet east of, and parallel to, the west property line of said South 3rd Street. 616 CITY OF AUSTIN, TEXAS Said gas main described above shall have a covering of not less than 2-1/2 feet. (10) A gas main in PENNSYLVANIA AVENUE from a point 200 feet east of Comal Street easterly to Comal Street, the centerline of which gas main shall be 19 feet south of, and parallel to, the north property line of said Pennsylvania Avenue. Said gas main described above shall have a covering of not less than 2-1/2 feet. (11) A gas main in EAST 18TH STREET from Salina Street westerly 190 feet, the centerline of which gas main shall be 7-1/2 feet south of, and parallel to, the north property line of said East 18th Street. Said gas main described above shall have a covering of not less than 2-1/2 feet. 617 The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilman Wolf The Acting City Manager was authorized to go ahead and negotiate with the Travis County Water Control and Improvement District #1, with a view to option date of December 1 which the City has to exercise for taking over the system. The written application of JAMES LEE, 2916 East 14th Street, for a change in zoning, from "A" Residence to "C" Commercial, of his property located at 2916 East 14th Street, was received. The matter was referred CITY OF AUSTIN, TEXAS to the Board of Adjustment for consideration and recommendation.
