6 CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting October 19,1944 11:00 Α.Μ. Council Chamber, City Hall 626 The meeting was called to order, with Mayor Miller presiding. Roll call Present: Councilmen Bartholomew, Gillis, Mayor Miller - 3 Absent : Councilmen Alford and Wolf - 2 Present also: J. E. Motheral, City Engineer; J. E. Patterson, Jr., Acting City Attorney; and R. D. Thorp, Chief of Police. The minutes of the Regular Meeting of October 12, 1944, were read; and on motion of Councilman Bartholomew were adopted as read by the following vote: Ayes : Councilmen Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilmen Alford and Wolf Mayor Miller offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Acting City Manager be, and he is hereby, authorized and directed in behalf of the City of Austin to execute a quitclaim deed to L. E. Daniel, his heirs and assigns, in consideration of the payment of all taxes and costs on Lot 5, Block 4 of Outlots Numbers 34 and 46, Division "O", in the City of Austin, Travis County, Texas, which said property was sold to the City of Austin for taxes by the following deeds: 1. Deed of Fred Sterzing, Collector, to the City of Austin, dated October 1, 1889, recorded in Book 77, Page 463, Deed Records of Travis County, Texas; and 2. Deed of R. E. White, Sheriff, to the City of Austin, dated July 27, 1894, recorded in Book 110, Page 438, Deed Records of Travis County, Texas. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: CITY OF AUSTIN, TEXAS 627 Ayes: Councilmen Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilmen Alford and Wolf The application of ARNOLD & COMPANY, 212 West 4th Street, for a wine and beer distributor's license, duly approved by the Acting City Manager, was submitted. Councilman Gillis moved that the permit be granted. The motion carried by the following vote: Ayes : Councilmen Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilmen Alford and Wolf The application of the OASIS NIGHT CLUB, 309 West 5th Street, for a wine and beer license, duly approved by the Acting City Manager, was submitted. Councilman Bartholomew moved that the license be granted. The motion carried by the following vote: Ayes : Councilmen Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilmen Alford and Wolf The application of the SEAFOOD GRILL, 1300 South Congress Avenue, for a wine and beer license, duly approved by the Acting City Manager, was submitted. Councilman Gillis moved that the license be granted. Councilman Gillis moved that the permit be granted. Councilman Bartholomew moved that the permit be granted. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilmen Alford and Wolf It was moved by Councilman Gillis that the taxicab driver's permit issued to GEORGE JOSEPH, 407 East 8th Street, be revoked, upon the recommendation of the Chief of Police. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilmen Alford and Wolf Mayor Miller offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be, and the same is hereby, permitted to lay and construct its gas mains in and upon the following streets: 67 CITY OF AUSTIN, TEXAS (1) A gas main in MILL STREET from East 9th Street north 123 feet, the centerline of which gas main shall be 74 72 feet west of, and parallel to, the east property line of said Mill Street. Said gas main described above shall have a covering of not less than 2 feet. (2) A gas main in CHICON STREET from East 18th Street north 32 feet, the centerline of which gas main shall be 11 feet west of the east property line of said Chicon Street. Said gas main described above shall have a covering of not less than 20 feet. (3) A gas main in HOLLY STREET from Mildred Street east 144 feet, the centerline of which gas main shall be 26 feet south of, and parallel to, the north property line of said Holly Street. Said gas main described above shall have a covering of not less than 22 feet. (4) A gas main in FLORES STREET from a point 94 feet west of Waller Street easterly 55 feet, the centerline of which gas main shall be 6s feet south of, and parallel to, the north property line of said Flores Street. Said gas main described above shall have a covering of not less than 20 feet. (5) A gas main in BENTLEY STREET from a point 5 feet south of Fredericksburg Road southerly 667 feet, the centerline of which gas main shall be 7 feet west of, and parallel to, the east property line of said Bentley Street. Said gas main described above shall have a covering of not less thần 2) feet. (6) A gas main in EAST 10TH STREET from a point 30 feet west of Mill Street easterly 680 feet, the centerline of which gas main shall be 7 feet north of, and parallel to, the south property line of said Fast 10th Street. Said gas main described above shall have a covering of not less than 2 feet. (7) A gas main in SAN MARCOS STREET from a point 112 feet north of East 10th Street northerly 62 feet, the center. line of which gas main shall be 27 feet west of, and parallel to, the east property line of said San Maгсов Street Said gas main described above shall have a covering of not less than 20 feet. 629 CITY OF AUSTIN, TEXAS 630 The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes: Councilmen Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilmen Alford and Wolf There being no further business, upon motion seconded and carried, the meeting was recessed at 11:30 A.
