CITY OF AUSTIN, TEXAS 652 MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting November 16, 1944 11:00 Α. Μ. Council Chamber, City Hall The meeting was called to order, with Mayor Miller presiding. Roll call Present: Councilmen Bartholomew, Gillis, Mayor Miller - 3 Absent: Councilmen Alford and Wolf 2 Present also: Walter E. Seaholm, Acting City Manager; J. E. Mo theral, City Engineer; J. M. Patterson, Jr., Acting City Attorney; and Capt. Roy Smith, Superintendent of Traffic. The minutes of the Regular Meeting of November 9, 1944, were read, and on motion of Councilman Gillis were adopted as read by the following vote: Ayes : Councilmen Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilmen Alford and Wolf J. E. MCCLAIN, on behalf of the AUSTIN TRANSIT COMPANY, submitted a request for discontinuance of the Magnesium Plant bus line owing to closure of the plant. It was the sense of the Council that a public hearing on the matter be called for the regular meeting on Thursday, November 23, and that, unless at such hearing good reasons for the continued operation of said line are shown, the same be discontinued on Monday, November 27. An appeal by LOUIS EDWARD CHERICO on denial of his application for a taxicab driver's permit was heard. Applicant was advised to submit the matter to the Chief of Police for reconsideration and if he sees fit to recommend same, the Council will then reconsider its action. The application of CITY PACKAGE STORE, 1230 West 6th Street, by F.Kopel, owner, for a Retail Package Store license, duly approved by the Acting City Manager, was submitted. Councilman Bartholomew moved that the license be granted. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Gillis, Mayor Miller Noes: • None Absent: Councilmen Alford and Wolf The application of DAVID STEPHEN WILSON, Route 2, Box 5264, for a taxicab driver's permit, duly approved by the Acting City Manager, was submitted. Councilmen Gillis moved that the permit be granted. Councilman Gillis moved that the permit be granted. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilmen Alford and Wolf The application of HAROLD LOYD BLUNDELL, 2216 South 3rd Street, for a taxicab driver's permit, duly approved by the Acting City Manager, was submitted. Councilman Gillis moved that the permit be granted. OWENS, 1004 West 43rd Street, for a license to operate as a taxicab a 1941 Chevrolet 4-door Sedan, Motor No. AA993139, State License (1942) No. F87-793, (1944) No. FR-922, to replace Taxicab License No. 73 cancelled by E. M. Powell, duly approved by the Acting City Manager, was submitted. Councilman Bartholomew moved that the license be granted. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilmen Alford and Wolf Councilman Bartholomew offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be, and the same is hereby, permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in KENMORE COURT from Windsor Road northerly 258 feet, the centerline of which gas main shall be 9 feet east of, and parallel to, the west property line of said Kenmore Court. Said gas main described above shall have a covering of not less than 25 feet. (2) A gas main in EAST 9TH STREET from a point 16 feet west of Prospect Avenue easterly to a point 25 feet west of but CITY OF AUSTIN, TEXAS Swenson Avenue, the centerline of which gas main shall be 7 feet north of, and parallel to, the south property line of said East 9th Street. Said gas main described above shall have a cover of notless than 2 feet. (3) A gas main in BOB HARRISON STREET from Comal Street westerly 466 feet, the centerline of which gas main shall be 35 feet south of, and parallel to, the north property line of said Bob Harrison Street. Said gas main described above shall have a covering of not less than 20 feet. (4) A gas main in BOB HARRISON STREET from a point 95 feet east of Navasota Street easterly 108 feet, the centerline of which gas main shall be 35 feet south of, and parallel to, the mrth line of said Bob Harrison Street. Said gas main described above shall have a cover of notless than 2 feet. (5) A gas main in SABINE STREET from East 12th Street southerly 130 feet, the centerline of which gas main shall be 23 feet west of, and parallel to, the east property line of said Sabine Street. Said gas main described above shall have a cover of notless than 20 feet. (6) A gas main in SINGLETON AVENUE from a point 30 feet north of East 13th Street northerly to a point 80 feet north of East 17th Street, the centerline of which gas main shall be 7 feet west of, and parallel to, the east property line of said Singleton Avenue. Said gas main described above shall have a cover of notless than 2 feet. (7) A gas main in EAST 16TH STREET from Singleton Avenue westerly 143 feet, the centerline of which gas main shall be 7½ feet south of, and parallel to, the north property line of said East 16th Street. Said gas main described above shall have a cover of notless than 2 feet. (8) A gas main in EAST 14TH STREET from Coleto Street to Singleton Avenue, the centerline of which gas main shall be 7½ feet south of, and parallel to, the north property line of said East 14th Street. Said gas main described above shall have a cover of notless than 22 feet. (9) A gas main in CHESTNUT AVENUE from East 14th Street northerly 49 feet, the centerline of which gas main shall be 654 CITY OF AUSTIN, TEXAS 12 feet west of, and parallel to, the east property line of said Chestnut Avenue. Said gas main described above shall have a cover of not less than 20 feet. (10) A gas main in SANTA ROSA STREET from a point 56 feet west of Prowse Lane westerly 128 feet, the centerline of which gas main shall be 6 feet south of, and parallel to, the north property line of said Santa Rosa Street. Said gas main described above shall have a cover of not less than 2 feet. (11) A gas main in CHESTNUT AVENUE from a point 49 feet south of Washington Avenue northerly 97 feet, the centerline of which gas main shall be 12 feet west of, and parallel to, the east property line of said Chestnut Avenue. Said gas main described above shall have a cover of notless than 2 feet. (12) A gas main in WASHINGTON AVENUE from Chestnut Avenue westerly 103 feet, the centerline of which gas main shall be 12 feet south of, and parallel to, the north property line of said Washington Avenue. Said gas main described above shall have a cover of notless than 20 feet. (13) A gas main in CURTIS AVENUE from East 22nd Street northerly 232 feet, the centerline of which gas main shall be 7½ feet west of, and parallel to, the east property line of said Curtis Avenue. Said gas main described above shall have a cover of notless than 2 feet. (14) A gas main in EAST 20TH STREET from Comal Street easterly 216 feet, the centerline of which gas main shall be 7 feet south of, and parallel to, the north property line of said East 20th Street. Said gas a in described above shall have a cover of notless than 22 feet. (15) A gas main in EAST 21ST STREET from a point 22 feet west of Leona Street westerly 66 feet, the centerline of which gas main shall be 15 feet south of, and parallel to, the north property line of said East 21st Street. Said gas main described above shall have a cover of notless than 2 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear 655 CITY OF AUSTIN, TEXAS 656 from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes: Councilmen Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilmen Alford and Wolf The following report of the Board of Adjustment on the application of JAMES LEE for a change in zoning of the 2900 block of East 14th Street, was received and ordered filed: "Austin, Texas November 15,1944 Honorable Mayor and City Council Austin, Texas Gentlemen: The Board of Adjustment, at a meeting held on November 14,1944, considered the amended application of James Lee which was submitted to the Board on November 3rd for a recommendation. After considerable discussion with the Board, the applicant, James Lee, withdrew the application and intends to seek a better site for his business in an existing commercial zone. The Board, therefore, accepted the withdrawal and recommends to the City Council that no further action be taken on this application. Yours very truly, BOARD OF ADJUSTMENT By /s/ H. F. Kuehne Chairman The application of ELMA DOYLE LINDEMAN for a change in zoning of the property at 1401 Lavaca Street from a "C-1# Commercial District to a "C-2" CITY OF AUSTIN, TEXAS 657 Commercial District was received, and the matter was referred to the Board of Adjustment for consideration. The application of FRED ADAMS for a change in zoning of the property at 1614 East 7th Street from an "A" Residence District to a "C# Commercial District was received, and the matter was referred to the Board of Adjustment for consideration and recommendation.
