Council Chamber, City Hall The meeting was called to order, with Mayor Miller presiding. Roll call Present: Councilmen Alford, Bartholomew, Gillis, Mayor Miller-4 Absent : Councilman Wolf - 1 Present also: Walter E. Seaholm, Acting City Manager; J.M.Patterson, Jr., Acting City Attorney; J. E. Motheral, City Engineer; and R. D. Thorp, Chief of Police, The reading of the minutes was dispensed with. Commissioners Perry, Jones, and Wirtz of the Austin Housing Authority presented to the Council a letter received by said Authority from the Texas Veterans Advisory Service relative to provision by the Federal Board of Public Housing for living units for married ex-service men and graduate students at the University of Texas. Dean W. R. Woolrich, Chairman of The Planning and Advisory Committee for Veterans, and Prof. Walter T. Rolfe, Coordinator of The Veterans Advisory Service, were present and spoke at length on the need for more ade- quate housing facilities at the University to take care of the returning ex-service men and their families and of graduate students who will want to take advantage of the educational opportunities for veterans at the University of Texas, and asked that the City Council and the Austin Housing Authority cooperate with them in having a survey made to determine what should be done. Following which, it was moved by Councilman Gillis that the City Council cooperate with the Committee by giving its moral support and the services of any skilled men on the Planning Board to work with them in making such survey, and that after a report on same is submitted, a public hearing on the matter be held. Which motion carried by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilman Wolf CITY OF AUSTIN, TEXAS 2 The Austin Housing Authority then agreed that, pending such survey, application would be made to the Federal Housing Authority for permission to build such houses. Pursuant to published notice thereof, the public hearing on the proposal of the City Council to amend the Zoning Ordinance in the following particulars, towit: To amend the USE designation of the following described property so as to change same from "A" Residence District to "CH Commercial District: was opened. Lot 1, Block 2, Outlot 6, Division "B", known as 1614 East 7th Street, in the City of Austin, Texas, Jerome Snead, Jr., Attorney for Applicant, plead for the change on the grounds that this street is a traffic artery leading to the superhighway east of the City, and therefore is more suitable for commercial than residential purposes; that Applicant not having received notice of the hearing before the Board of Adjustment failed to appear and plead his case at that time; and that Applicant thinks the abutting property owners are under a misapprehension as to what will be done with this property if rezoned. A large group of property owners appeared and protested the change on the grounds that there is a commercial section within two blocks of this property which is ample for their needs; and that they object to any further encroachment of business in this residential area. A written protest by said property owners was also submitted. No other property owners or interested persons desiring to be heard, it was then moved by Councilman Alford that the action of the Board of Adjustment be sustained, and the proposed change in zoning of the property in question be denied. Nauert and other property owners for a change in zoning, from "A" Residence District to "C" Commercial District, of the property bordering on East 47th Street and lying between Depew Street on the east and Red River Street on the west, to include Lots Nos. 1,2,3,and 4, and 39 and 40 in Block 13, and Lots 12, 13, 14, 15, and 16, in Block 14 of Outlot 17, Division "C", Ridgetop Annex, was received; and the matter was referred to the Board of Adjustment for consideration and recommendation. R. G. Mueller appeared before the Council and asked that the City proceed with the construction of a storm sewer in the 600 block on West 4th Street adjacent to the property of the Miller-Hostetter Company in accordance with the request of Mrs. Tom Miller now under consideration. The matter was again referred to the City Engineer to work out a satisfactory agreement with the adjoining property owners relative to their pro rata of the cost. 3 CITY OF AUSTIN, TEXAS Councilman Bartholomew offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, The International-Great Northern Railroad has presented to the City Council a tentative map or plan showing the proposed construction of a water line in a street in the City of Austin hereafter named, and said map or plan has been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT The International-Great Northern Railroad be, and the same is hereby, permitted to lay and construct a water line in and upon the following streets: A 4-inch water line across LAMAR BOULEVARD, the centerline of which water line shall be 76 feet south of, and parallel to, the north property line of West 3rd Street. Said water line described above shall be incased in a 6-inch cast iron pipe and shall have a cover of not less than 20 feet. The International-Great Northern Railroad is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand. The International-Great Northern Railroad is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of the line named in this resolution. That the work and laying of said water line, including the excavation in the streets and the restoration and maintenance of said streets after said line has been laid, shall be under the supervision and direction of the City Manager. Dawson, conveying all the right, title, and interest acquired by the City of Austin to Lots 11, 12, and 13, Block "T", J. E. That the City Manager, or in his absence the Acting City Manager, be, and he is hereby, authorized and directed to enter into a contract in behalf of the City of Austin with the United States of America, for the leasing by the City of Austin to the United States of America of the Austin Municipal Airport, said property being more fully described in the lease which is attached hereto; said premises to be used by the United States of America as an auxiliary landing field, in accordance with the terms and provisions of said lease, a copy of which is attached hereto. That the City Clerk be, and she is hereby, authorized and directed to place a copy of this lease agreement, which is attached hereto, in the permanent files of her office without the necessity of recording the contents of said lease agreement in the minutes of the City Council.
