Council Chamber, City Hall 293 The meeting was called to order, with Mayor Pro tem Bartholomew presiding in the absence of Mayor Miller, who was attending the official open- ing of the Red Cross Drive. Roll call Present: Councilman Alford, Mayor Pro tem Bartholomew, Councilman GillisAbsent: Mayor Miller and Councilman Wolf 2 -3 Present also: Walter E. Seaholm, Acting City Manager; J.E. Mo theral, City Engineer; W. T. Williams, City Attorney; and R. D. Thorp Chief of Police. The minutes of the Regular Meetings of February 15 and February 23, 1945, were read, and on motion of Councilman Alford were adopted as read by the following vote: Ayes: Councilman Alford, Mayor Pro tem Bartholomew, Councilman Gillis Noes: None Absent: Mayor Miller and Councilman Wolf JOYCE WILLIAM BAKER, together with his attorney, Ayres K. Ross, was heard in an appeal for reinstatement of his taxicab driver's permit, which was revoked by the City Council at its last regular meeting. After considering the appeal, it was the sense of the Council that the recommendation of the Chief of Police that the permit be not reinstated, be sustained. The application of OSCAR IRA LEACH, 3202 Bailey Lane, for a license to operate as a taxicab a 4-door Chevrolet Sedan, 1942 Model, State License No. F10-127 (1942) and No. FR-4835 (1945) Motor No. 229047, Serial No. 3BH11-12109, to replace Taxicab License No. 56 cancelled by Joe J. Joseph, recommended for approval by the Acting City Manager, was submitted. Councilman Gillis moved that the application be approved. The motion carried by the following vote: tion: Ayes: Councilman Alford, Mayor Pro tem Bartholomew, Councilman Gillis Noes: None Absent: Mayor Miller and Councilman Wolf Councilman Alford offered the following resolution and moved its adop(RESOLUTION) WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets of the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be, and the same is hereby, permitted to lay and construct its gas mains in and upon the following streets: CITY OF AUSTIN, TEXAS 295 (1) A gas main in NEWTON STREET across West Annie Street intersection, the centerline of which gas main shall be 10 feet west of, and parallel to, the east property line of said Newton Street. Said gas main described above shall have a cover of not less than 2 feet. (2) A gas main in WEST ANNIE STREET from Newton Street west 136 feet, the centerline of which gas main shall be 10 feet south of, and parallel to, the north property line of said West Annie Street. Said gas main described above shall have a cover of not less than 22 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes: Councilman Alford, Mayor Pro tem Bartholomew, Councilman Gillis Noes: None Absent: Mayor Miller and Councilman Wolf Councilman Gillis offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, in Book 1, Page 75, of the Plat Records of Travis County, Texas, there appears a map or plat of a subdivision of land known as Hyde Park Addition No. 2 within the City of Austin, Travis County, Texas; and WHEREAS, upon said map or plat there appear various streets and alleys, one of which alleys herein referred to is 12 feet in width and traverses a portion of Block 15 of said Hyde Park Addition No.2 and being the alley CITY OF AUSTIN, TEXAS 296 one-half block north of, and parallel to, West 42nd Street, and extending from Avenue C to Avenue C Alley; and WHEREAS, said alley has not been opened to the public; and WHEREAS, the owners of all the property abutting said alley have requested the City Council of the City of Austin to close the above described alley; and WHEREAS, said request has been reviewed and considered by the City Council of the City of Austin; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT that alley in Block 15 of Hyde Park Addition No. 2, one-half block north of, and parallel to, West 42nd Street, and extending from Avenue C to Avenue C Alley is hereby permanently abandoned, vacated, and closed. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes: Councilman Alford, Mayor Pro tem Bartholomew, Councilman Gillis Noes: None Absent: Mayor Miller and Councilman Wolf Councilman Alford offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, in Book 4, page 202, of the Plat Records of Travis County, Texas, there appears a map or plat of a subdivision of land known as Barton Heights B; and WHEREAS, a street known as Anita Street is shown upon the aforesaid map or plat, which has been dedicated for public street purposes; and WHEREAS, the aforementioned street is partially graded and has not been opened to the public; and WHEREAS, Paul O. Simms, owner of all the land abutting each side of said Anita Street has petitioned the City Council of the City of Austin to permanently abandon, vacate, and close the said Anita Street, and the said Paul 0. Simms has agreed to dedicate in lieu of Anita Street another street serving this general vicinity to a better advantage, and a tentative layout has been prepared showing the street to be dedicated in lieu of said Anita Street, and said plan has been reviewed and considered by the City Council of the City of Austin; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Anita Street, as shown upon the map or plat of Barton Heights B previously referred to, is hereby permanently abandoned, vacated and closed. Seaholm, City Manager of the City of Austin, be, and he is hereby authorized and directed to enter into a contract with Robert H. Davis, Nannie L. Davis Hoist and her husband, J. A. Hoist, to purchase the northeast one-fourth and the west twenty-five feet of the north- west one-fourth of Lot No. 18, Outlot 55, Division "B", City of Austin, for the sum of $1800.00, payable in monthly installments of $25.00, with interest on deferred payments at 6% per annum; upon receipt of which the City of Austin will convey its title to said property to said Robert H. Davis, Nannie L. Davis Hoist and her husband, J. A. Hoist.
