Council Chamber, City Hall The meeting was called to order, with Mayor Miller presiding. Roll call Present: Councilmen Alford, Bartholomew, Gillis, Mayor Miller 4 Absent : Councilman Wolf 1 - Present also: Walter E. Seaholm, Acting City Manager; J.E. Motheral, City Engineer; W. T. Williams, City Attorney; and R. D. Thorp, Chief of Police. The minutes of the Regular Meeting of March 22, 1945, were read, and on motion of Councilman Alford, were adopted as read by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilman Wolf Councilman Gillis offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, the City Council has decided to provide lower domestic rates to consumers residing within the corporate limits of the City of Austin for a seven months period; namely, for water consumption on which bills are rendered between April 1 and October 31, 1945, for the purpose of furthering the Victory Garden program and the further beautification of the city; and WHEREAS, it is the intention of the City Council that this reduction shall be made only to those water consumers whose use shall be strictly for residential purposes, and is not effective for commercial purposes; THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be, and he is hereby, authorized and directed to make effective on all water readings within the corporate limits of the City of Austin, Texas, for all water consumers whose use is strictly for 319 CITY OF AUSTIN, TEXAS 319 residential purposes, as of bills rendered between April 1 to October 31, 1945, at the following rates: (minimum charge) First 1,500 50 cents Next 2,000 30 cents per 1,000 gallons Next 12,500 - 18 cents per 1,000 gallons Next 34,000 14 cents per 1,000 gallons Next 200,000 1.2 cents per 1,000 gallons Over 250,000 - 12 cents per 1,000 gallons Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilman Wolf The written application of P. J. ANTHONY for a change in zoning, from residential to commercial or industrial, of the property located at 1212 East 19th Street, was received; and the matter was referred to the Board of Adjustment for consideration and recommendation. The application of the AVENUE CAFE, 207 Congress Avenue, for a wine and beer license, duly approved by the Acting City Manager, was submitted. Councilman Alford moved that the license be granted. The motion carried by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilman Wolf The application of CHESTER LEE DANIEL, 300 Congress Avenue, for a license to operate as a taxicab a 1941 Chevrolet Sedan, State License (1945) FR3416, Engine #AA5099, duly approved by the Acting City Manager, said license to replace Taxicab License No. 9 cancelled by D. F. Samuel, was submitted. Councilman Gillis moved that the license be granted. The motion carried by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilman Wolf The application of HILLERY OWENS, 300 Congress Avenue, for a license to operate as a taxicab a 1941 Model 4-door Plymouth Sedan, State License (1945) No. N24827, Factory No. P-1213529, approved by the Acting City Manager, said license to replace Taxicab License No. 85 cancelled by George L. Owens, was submitted. Councilman Gillis moved that the license be granted. The motion carried by the following vote: Ayes : Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilman Wolf The application of PFC. IVAN H. MILLER, Bergstrom Field, for a taxicab driver's permit, approved by the Acting City Manager, was submitted. Councilman Alford moved that the permit be granted. The motion carried by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilman Wolf 32 CITY OF AUSTIN, TEXAS 320 The application of MAXIE GOFF, 700 Highland Avenue, for a taxicab driver's permit, duly approved by the Acting City Manager, was submitted. Councilman Alford moved that the permit be granted. The motion carried by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilman Wolf Councilman Gillis introduced the following ordinance: AN ORDINANCE AMENDING THAT CERTAIN ORDINANCE ENTITLED: "AN ORDINANCE REGULATING TRAFFIC UPON THE PUBLIC STREETS OF THE CITY OF AUSTIN; PRESCRIBING PENALTIES FOR THE VIOLATION OF SAME; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY," WHICH SAID ORDINANCE WAS PASSED BY THE CITY COUNCIL OF THE CITY OF AUSTIN MAY 6, 1937, AND IS RECORDED IN BOOK "K", PAGES 159-179, INCLUSIVE, OF THE ORDI NANCE RECORDS OF THE CITY OF AUSTIN, BY AMENDING ARTICLE IV, SECTION 23, SUBSECTION (d) OF SAID ORDINANCE; REPEALING ALL ORDI NANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. The ordinance was read the first time and Councilman Gillis moved that the rule be suspended and the ordinance be passed to its second reading. The motion carried by the following votes Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilman Wolf The ordinance was read the second time and Councilman Gillis moved that the rule be further suspended and the ordinance be passed to its third reading. The motion carried by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilman Wolf The ordinance was read the third time and Councilman Gillis moved that the ordinance be finally passed. The motion carried by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilman Wolf The Mayor then announced that the ordinance had been finally passed. The City Attorney was instructed to have the Tax Assessor and Collector prepare a list of delinquent taxpayers and have same ready for study by the Council at its next regular meeting. L. C. PROCTOR, local chairman of the United National Clothing Collection Drive for the collection of clothing for the suffering people of the war zones, appeared before the Council and asked that the City cooperate with CITY OF AUSTIN, TEXAS 321 them by allowing the use of the City's trucks for the collection of such clothing on Sunday, April 15. After hearing the request, the City Council went on record as thoroughly indorsing the movement, and authorized the use of the City's trucks on this occasion. The following resolution was submitted: (RESOLUTION) WHEREAS, the City of Austin taxes for the years 1932 through 1935 and 1938 through 1940 were assessed in the name of Hans Harton on Lot 5, Block B, Outlot 2, Division "Z", Raymond, Plat 94, in the City of Austin, Travis County, Texas; said taxes for said years being in the amount of $410.28, and for non-payment of same at maturity, penalty in the sum of $20.51 has been assessed, and interest in the amount of $199.36 has accrued, making the total amount of taxes, penalty and interest due $630.15; and WHEREAS, the City Council of the City of Austin deems it just and equitable to remit said penalty in the sum of $20.51 and one-half of the interest in the sum of $99.68; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the aforesaid penalty in the sum of $20.51 and one-half of said interest in the sum of $99.68 are hereby remitted, and the Tax Assessor and Collector of the City of Austin is hereby authorized and directed to charge said penalty in the sum of $20.51 and said interest in the sum of $99.68 off his rolls and to issue to the party entitled to receive same a receipt in full upon the payment of the aforesaid taxes and interest. vote: Upon motion, the foregoing resolution was adopted by the following Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Foes : None Absent: Councilman Wolf There being no further business, upon motion, seconded and carried, the meeting was recessed at 11:40 A.
