331 CITY OF AUSTIN, TEXAS 331 MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting April 12,1945 10:45 Α.Μ. Council Chamber, City Hall The meeting was called to order, with Mayor Miller presiding. Roll call Present: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Absent :: Councilman Wolf - 1 - 4 Present also: Walter E. Seaholm, Acting City Manager; J.E.Motheral, City Engineer; W. T. Williams, City Attorney; and R. D. Thorp, Chief of Police. The minutes of the Regular Meeting of April 5, 1945, were read, and on motion of Councilman Alford, were adopted as read by the following vote: Ayes : Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilman Wolf Mesdames Falwell and Rundell came before the Council and requested that the fence erected by H. E. Wassell in the center of Summit Street be removed. The matter was referred to the City Attorney for attention. The application of MOSES SAMPSON, JR., 1709 East 12th Street, for a license to operate as a taxicab a 4-door Ford Sedan, 1942 Model, State License (1945) FS-3262, Motor No. 18-6917882, to replace Taxicab License No. 88 cancelled by Zeno Clark, duly approved by the Acting City Manager, was submitted. Councilman Alford moved that the license be granted. The motion carried by the following vote: Ayes : Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilman Wolf The application of PFC. ALFRED C. HEMMELGARN, Bergstrom Air Base, for a taxicab driver's permit, duly approved by the Acting City Manager, was submitted. Councilman Bartholomew moved that the permit be granted. The motion carried by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilman Wolf Councilman Gillis introduced the following ordinance: AN ORDINANCE AMENDING THAT CERTAIN ORDINANCE ENTITLED "AN ORDINANCE REGULATING TRAFFIC UPON THE PUBLIC STREETS OF THE CITY OF AUSTIN, PRE SCRIBING PENALTIES FOR THE VIOLATION OF SAME, REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH, AND DECLARING AN EMERGENCY," WHICH ORDINANCE WAS PASSED BY THE CITY COUNCIL ΜΑΥ 6, 1937, AND IS RECORDED IN BOOK "K", PAGES 159-179, OF THE ORDINANCE RECORDS OF THE CITY OF AUSTIN, BY ADDING TO SECTION 34(b) THE WORDS: "THE FIRST ALLEY WEST OF RAINEY STREET AND EX TENDING NORTH AND SOUTH - ONE WAY SOUTH FROM DAVIS STREET TO RIVER STREET"; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH, AND DECLARING AN EMERGENCY. The ordinance was read the first time and Councilman Gillis moved that the rule be suspended and the ordinance be passed to its second reading. The motion carried by the following vote: Ayes : Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilman Wolf The ordinance was then read the second time and Councilman Gillis moved that the rule be further suspended and the ordinance be passed to its third reading. Councilman Alford offered the following resolution and mved its adoption: (RESOLUTION) WHEREAS, on October 25, 1928, in Cause No. 45,747, styled City of Austin vs. Carolyn Stripling, in the District Court of Travis County, Texas, 333 CITY OF AUSTIN, TEXAS 333 a judgment was rendered in favor of the City of Austin for delinquent taxes interest, penalty and costs then owing to the City on Lot 9, Outlot 47, Division "D", Watson Sub-division, in the City of Austin; and WHEREAS, the said judgment has been paid in full and has never been released of record; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the said judgment and the tax lien foreclosed therein be, and the same are hereby cancelled, released and fully discharged. Seaholm, City Manager of the City of Austin, be, and he is hereby authorized and directed to execute for and in behalf of the CITY OF AUSTIN a deed to Viola Williams, conveying to her all of the right, title, claim and interest of the City of Austin to Lot 5, Block 7, Outlot 58, Division "B", in the City of Austin, for the consideration of Three Hundred and Seventy-five ($375.00) Dollars in cash. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Ayes : Noes : None Absent: Councilman Wolf Councilman Bartholomew offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, in Book 2, page 211, of the Plat Records of Travis County, Texas, there appears a map or plat of a subdivision of land known as Ridgetop Annex within the City of Austin, Travis County, Texas; and WHEREAS, upon said map or plat there appear various streets and alleys, one of which alleys herein referred to is twenty feet in width and traverses a portion of Block 7 of said Ridgetop Annex, and being the alley one-half block west of, and parallel to, Red River Street, and extending from East 44th Street south to the first alley south of East 44th Street; and WHEREAS, said alley has not been opened to the public; and WHEREAS, the owners of all the property abutting said alley have 334 CITY OF AUSTIN, TEXAS 334 requested the City Council of the City of Austin to close the above described alley; and WHEREAS, said request has been reviewed and considered by the City Council of the City of Austin; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT that alley in Block 7 of Ridgetop Annex, one-half block west of, and parallel to, Red River Street and extending from East 44th Street south to the first alley south of East 44th Street, is hereby permanently abandoned, vacated and closed. The ordinance was read the first time and Councilman Bartholomew moved that the rule be suspended and the ordinance be passed to its second reading.
