353 CITY OF AUSTIN, TEXAS 353 MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting May 10,1945 11:00 Α.Μ. Council Chamber, City Hall The meeting was called to order, with Mayor Miller presiding. Roll call Present: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Absent : Councilman Wolf 1 - - 4 The minutes of the Regular Meeting of April 26, the Adjourned Meeting of May 1, and the Regular Meeting of May 3 were read; and on motion of Councilman Alford were adopted as read by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilman Wolf Mrs. May Yelderman, attorney for Mrs. Maude Pridgen Butler, submitted a petition for the removal of the remains of two unknown bodies from the family burial lot of her client in Oakwood Cemetery, and reinterment of same on another lot at her client's expense. After some discussion, it was moved by Mayor Miller that action on the matter be postponed to the next regular meeting; and that the City Manager be instructed to advertise notice in the American-Statesman that the City Council will order said bodies moved as requested at that time if no one has made claim to same in the meantime. The motion carried by the following vote: Ayes : Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilman Wolf Mrs. J. T. Eaves, Mrs. Lyman J. Bailey, and other residents of the neighborhood appeared before the Council in behalf of their petition previously submitted asking for the removal of a trailer camp in the 1400 block of East 2nd Street, declaring that same was in violation of residential zoning restrictions and a menace to the health of the community on account of the in- sanitary condition. A group of women representing the occupants of the trailer camp, composed of Mrs. McAdams and others, wives of service men, also appeared and were heard in defense of their position. 354 CITY OF AUSTIN, TEXAS 354 After considerable discussion of the matter, it was the sense of the Council that the trailers should be moved from their present location; and the City Manager was instructed to find another location for same, and, if need be, to have same moved onto city property for the duration of the war and provided with proper sanitary facilities. The application of KENNETH CROFT, 106 East 2nd Street, for a taxicab driver's permit, duly approved by the City Manager, was submitted. Councilman Alford moved that the permit be granted. The motion carried by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilman Wolf The application of EAST SIDE LIQUOR STORE, 2100 East 7th Street, for a liquor permit, duly approved by the City Manager, was submitted. Councilman Gillis moved that the permit be granted. The motion carried by the following vote: Ayes : Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilman Wolf Councilman Alford offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be, and the same is hereby, permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in RALEIGH AVENUE from Enfield Road to Bonnie Road, the centerline of which gas main shall be 7.5 feet west of, and parallel to, the east property line of said Raleigh Avenue. Said gas main described above shall have a cover of not less than 2 feet. (2) A gas main in WOODROW AVENUE from a point 513 feet south of Houston Street northerly 688 feet, the centerline of which gas main shall be 7.5 feet west of, and parallel to, the east property line of said Woodrow Avenue. Said gas main described above shall have a cover of not less than 22 feet. (3) A gas main in EAST 51ST STREET from a point 264 feet west of Lancaster Court easterly 2010 feet, the centerline of which gas main shall be 7.5 feet south of, and parallel to, the north property line of said East 51st Street. 355 CITY OF AUSTIN, TEXAS 355 Said gas main described above shall have a cover of not less than 22 feet. (4) A gas main in BONNIE ROAD from Raleigh Avenue westerly 159 feet, the centerline of which gas main shall be 7.5 feet south of, and parallel to, the north property line of said Bonnie Road. Said gas main described above shall have a cover of not less than 2 feet. (5) A gas main in SINGLETON AVENUE from a point 135 feet south of East 18th Street northerly 454 feet, the centerline of which gas main shall be 13.5 feet west of, and parallel to, the east property line of said Singleton Avenue. Said gas main described above shall have a cover of not less than 2 feet, (6) A gas main in EAST AVENUE from a point 115 feet south of East 16th Street north to a point 130 feet south of East 18th Street, the centerline of which gas main shall be 64 feet east of, and parallel to, the west property line of said East Avenue. Said gas main described above shall have a cover of not less than 2 feet. (7) A gas main in EAST 22ND STREET from a point 281 feet east of Curtis Avenue easterly 128 feet, the centerline of which gas main shall be 9 feet south of, and parallel to, the north property line of said East 22nd Street. Said gas main described above shall have a cover of not less than 25 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the City Engineering Department not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. And that whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. That the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain 356 CITY OF AUSTIN, TEXAS 356 franchise granted to said Company by the City of Austin. LUNG for a change in zoning of the property at 307 Lamar Boulevard, from "C" Commercial District to "0-1" Commercial District, was received. The matter was referred to the Board of Adjustment for consideration and recommendation, and a public hearing called for May 31 at 11:00 A. Μ. 357 CITY OF AUSTIN, TEXAS 357 The written application of GEORGE RAYMOND SLAUGHTER for a change in zoning of the property at 2119 East 8th Street from residential to commercial was received. The matter was referred to the Board of Adjustment for consideration and recommendation, and a public hearing called for May 31, at 11:00 A. M. A written request from P. A. WELTY and W. D. MOORE, property owners, asking that the block on West 13th Street between Congress Avenue and Colorado Street be designated as a one-way street, with no parking privileges, was received. The matter was referred to the Traffic Division for consideration and report. Mayor Miller offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT no pavement shall be placed or laid on any street in Austin until curbs and gutters are installed by abutting property owners along the property line adjacent to such proposed pavement, under the supervision and approval of the City Engineer of the City of Austin. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes : Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilman Wolf The following resolution was introduced: (RESOLUTION) WHEREAS, the City of Austin taxes for the year 1939 were assessed in the name of the Calcasieu Lumber Company on Lot 15, Block 4, McGuire #1 Subdivision, Plat 76, in the City of Austin, Travis County, Texas; said taxes for said year being in the amount of $52.43, and for non-payment of same at maturity, penalty in the sum of $2.62 has been assessed, and interest in the amount of $16.02 has accrued, making the total amount of taxes, penalty and interest due $71.07; and WHEREAS, the City Council of the City of Austin deems it just and equitable to remit said penalty in the sum of $2.62, and one-half of said interest in the sum of $8.01; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the aforesaid penalty in the sum of $2.62 and one-half of said interest in the sum of $8.02 are hereby remitted, and the Tax Assessor and Collector of the City of Austin is hereby authorized and directed to charge said penalty in the sum of $2.62 and said interest in the sum of $8.01 off his rolls and to issue to the party entitled to receive same a receipt in full upon the payment of the aforesaid taxes and interest.
