38386 CITY OF AUSTIN, TEXAS 385 MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting June 7,1945 10:30 Α.Μ. Council Chamber, City Hall The meeting was called to order, with Mayor Pro tem Bartholomew presiding. Roll call Present: Councilmen Alford, Gillis, Mayor Pro tem Bartholomew - 3 Absent : Mayor Miller and Councilman Wolf - 2 Present also: Walter E. Seaholm, City Manager; J. E. Motheral, City Engineer; W. T. Williams, City Attorney; and R. D. Thorp, Chief of Police. The minutes of the Regular Meeting of May 31, 1945, were read, and on motion of Councilman Alford, were adopted as read by the following vote: Ayes: Councilmen Alford, Gillis, Mayor Pro tem Bartholomew Noes: None Absent: Councilman Wolf and Mayor Miller MR. LOUIS BONUGLI and REVEREND WARD CHANDLER came before the Council and requested that the paving of San Marcos Street from Ist Street south to Taylor Street be started at an early date, the necessary deposits by abutting property owners, with the exception of two, having been made; and suggested further that the paving be extended farther south to Holly Street. The matter was referred to the City Engineer for attention. The application of HARRY WILLIAM GUNTER, 1509 West 6th Street, for a taxicab driver's permit, duly approved by the City Manager, was submitted. Councilman Alford moved that the permit be granted. The motion carried by the following vote: Ayes : Councilmen Alford, Gillis, Mayor Pro tem Bartholomew. Noes : None Absent: Mayor Miller and Councilman Wolf The application of STEAMBOAT INN, 1112 East 11th Street, by O. C. Wilson, for a wine and beer license, duly approved by the City Manager, was submitted. Councilman Alford moved that the license be granted. The motion carried by the following vote: Ayes: Councilmen Alford, Gillis, Mayor Pro tem Bartholomew Noes: None Absent: Mayor Miller and Councilman Wolf 33 CITY OF AUSTIN, TEXAS 386 The application of HONG KONG CAFE, 717 East 6th Street, by Joe Carlin, for a wine and beer license, duly approved by the City Manager, was submitted. Councilman Alford moved that the license be granted. The motion carried by the following vote: Ayes: Councilmen Alford, Gillis, Mayor Pro tem Bartholomew Noes : None Absent: Mayor Miller and Councilman Wolf The application of CITY CAFE, 600 East 6th Street, by Richard Hodges, for a wine and beer license, duly approved by the City Manager, was submitted. Councilman Alford moved that the license be granted. The motion carried by the following vote: Ayes: Councilmen Alford, Gillis, Mayor Pro tem Bartholomew Noes: None Absent: Mayor Miller and Councilman Wolf Councilman Gillis introduced the following ordinance: AN ORDINANCE AMENDING THAT CERTAIN ORDINANCE PASSED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS, JULY 17, 1941, AND RECORDED IN ORDINANCE BOOK "L", PAGES 152-174, INCLUSIVE OF THE ORDINANCE RECORDS OF THE CITY OF AUSTIN, WHICH ORDINANCE WAS AMENDATORY OF THAT CERTAIN ORDINANCE ESTABLISHING ZONING REGULATIONS AND DISTRICTS IN ACCORDANCE WITH A COMPREHENSIVE PLAN PASSED BY THE CITY COUNCIL APRIL 23,1931, AND RECORDED IN ORDINANCE BOOK "I", PAGES 301318, BOTH INCLUSIVE, OF THE ORDINANCE RECORDS OF THE CITY OF AUSTIN; THE AMENDATORY ORDINANCE HEREBY ENACTED CHANGING THE USE DESIGNATION FROM "B" RESIDENCE DISTRICT TO "C" COMMERCIAL DISTRICT OF THAT CERTAIN PROPERTY FORTY-FIVE (45) FEET BY ONE HUNDRED THIRTY (130) FEET ABUTTING ON EAST 8TH STREET, AND BEING A PORTION OF OUTLOT 9, DIVISION "B" (UNPLATTED) IN THE CITY OF AUSTIN, TEXAS; AND ORDERING A DELINEA TION OF THE OFFICIAL USE MAP SO AS TO SHOW THE CHANGES HEREBY ORDERED; AND DECLARING AN EMERGENCY. The ordinance was read the first time and Councilman Alford moved that the rule be suspended and the ordinance be passed to its second reading. The motion carried by the following vote: Ayes: Councilmen Alford, Gillis, Mayor Pro tem Bartholomew Noes: None Absent: Mayor Miller and Councilman Wolf The ordinance was then read the second time and laid over. Mayor Pro tem Bartholomew called up for its third reading the following ordinance: 381 CITY OF AUSTIN, TEXAS 387 AN ORDINANCE VACATING THAT PORTION OF PATTERSON LANE OR EAST 41ST STREET EXTENDING IN AN EASTERLY DIRECTION FROM THE EAST LINE OF THE H&TC R.R. (LLANO BRANCH) TO THE SOUTH LINE OF WILSHIRE BOULEVARD; AND MAKING CERTAIN RESERVATIONS FROM SUCH VACATION. The ordinance was read the third time and Councilman Gillis moved that the ordinance be finally passed. The motion was seconded by Councilman Alford, and the same prevailed by the following vote: Ayes: Councilmen Alford, Gillis, and Mayor Pro tem Bartholomew Noes : None Absent: Mayor Miller and Councilman Wolf The Mayor Pro tem then announced that the ordinance had been finally passed. MR. M. H. CROCKETT came before the Council and submitted an appeal in writing from the action of the Board of Adjustment in refusing to grant him a variation from the Use designation of his property contiguous to Riverside Drive and Barton Springs Road to permit the erection of a riding stable thereon. Councilman Gillis moved that a public hearing on the matter be called for June 28, at 11:00 A. Μ. The motion carried by the following vote: Ayes: Councilmen Alford, Gillis, and Mayor Pro tem Bartholomew Noes: None Absent: Mayor Miller and Councilman Wolf MR. G. D. HETZEL came before the Council and requested that the restrictions against fishing in boats just below the Austin Dam be lifted. The matter was referred to the City Manager to confer with the Lower Colorado River Authority. The following resolution was submitted: (RESOLUTION) WHEREAS, the City of Austin taxes for the years 1936 through 1944 were assessed in the name of Nellie Lewis on 150 x 150 west side of Lot A, Block 3, 0. L. 36, Div. B, Plat 36, in the City of Austin, Travis County, Texas; said taxes for said years being in the amount of $218.61, and for non-payment of same at maturity, penalty in the sum of $10.93 has been assessed, and interest in the amount of $55.06 has accrued, making the total amount of taxes, penalty and interest due $284.60; and WHEREAS, the City Council of the City of Austin deems it just and equitable to remit said penalty in the sum of $10.93 and one-half of the interest in the sum of $27.53; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the aforesaid penalty in the sum of $10.93 and one-half of the interest in the sum of $27.53 are hereby remitted, and the Tax Assessor and Collector of the City of Austin is hereby authorized and directed to charge said penalty in the sum of $10.93 and said interest in the sum of $27.53 off his rolls, and to issue to the party entitled to receive same 35 CITY OF AUSTIN, TEXAS a receipt in full upon the payment of the taxes and one-half of the interest as aforesaid. vote: Upon motion, the foregoing resolution was adopted by the following Councilmen Alford, Gillis, Mayor Pro tem Bartholomew Ayes: Noes: None Absent: Mayor Miller and Councilman Wolf The following resolution was submitted: (RESOLUTION) 388 WHEREAS, the City of Austin taxes for the years 1932, 1933, 1934, and 1936 through 1944 on personal property in the City of Austin, Travis County, Texas, were assessed in the name of E. T. Livingston; said taxes for said years being in the amount of $101.22, and for non-payment of same at maturity, penalty in the sum of $5.06 has been assessed, and interest in the amount of $27.94 has accrued, making the total amount of taxes, penalty and interest due $134.22; and WHEREAS, the City Council of the City of Austin deems it just and equitable to remit said penalty in the sum of $5.06 and one-half of the inter- est in the sum of $13.97; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the aforesaid penalty in the sum of $5.06 and one-half of the interest in the sum of $13.97 are hereby remitted, and the Tax Assessor and Collector of the City of Austin is hereby authorized and directed to charge said penalty in the sum of $5.06 and said interest in the sum of $13.97 off his rolls, and to issue to the party entitled to receive same a receipt in full upon the payment of the taxes and one-half of the interest as aforesaid. vote: Upon motion, the foregoing resolution was adopted by the following Ayes : Councilmen Alford, Gillis, Mayor Pro tem Bartholomew Noes: None Absent: Mayor Miller and Councilman Wolf The following resolution was submitted: (RESOLUTION) WHEREAS, the City of Austin taxes for the years 1936, 1937, 1938, and 1940 through 1944 on personal property in the City of Austin, Travis County, Texas, were assessed in the name of T. A. Porter; said taxes for said years being in the amount of $18.46, and for non-payment of same at maturity, penalty in the sum of $0.92 has been assessed, and interest in the amount of $4.27 has accrued, making the total amount of taxes, penalty and interest due $23.65; and WHEREAS, the City Council of the City of Austin deems it just and equitable to remit said penalty in the sum of $0.92 and one-half of the inter- est in the sum of $2.13; therefore, و D ! H. Crockett for the use of said premises for said purpose be granted, was received and filed. There being no further business, upon motion seconded and carried, the meeting was recessed at 11:55 A.
