Council Chamber, City Hall 558 The meeting was called to order with Mayor Miller presiding. Roll call Present: Absent: Councilmen Alford, Bartholomew, Gillis, Mayor Miller and Councilman Wolf None Present also: Guiton Morgan, City Manager; W. T. Williams, City Attorney; J. E. Motheral, City Engineer; R. D. Thorp, Chief of Police. The minutes of the Regular Meeting of October 4, 1945, were read, and on motion of Councilman Alford were adopted as read by the following vote: Councilmen Alford, Bartholomew, Gillis, Mayor Miller and Councilman Wolf None Ayes: Noes: Absent: None The application of NATHAN REX BURNS, 311 Comal street, for a taxicab driver's permit, duly approved by the City Manager, was submitted. Councilman Wolf moved that the permit be granted. The motion carried by the following vote: Ayes: Noes: Absent: Councilmen Alford, Bartholomew, Gillis, Mayor Miller and Councilman Wolf. None None The application of DENNIS LEE DUKE, 1212 West 40th street, for a taxicab driver's permit, duly approved by the City Manager, was submitted, Councilman Alford, moved that the permit be granted. TWIDWELL, 210 Brushy street, for a taxicab driver's permit, duly approved by the City Manager, was submitted. Coun- cilman Alford moved that the permit be approved. The motion carried by the following vote: Ayes: Noes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller and Councilman Wolf None Absent: None LESLIE CROCKETT, 112 Academy Drive, appeared before the Council and requested permission to operate a boating concession at Deep Eddy and to build a boat house to store canoes and rowboats in. After discussing this request, the Mayor requested the City Manager to advertise for bids in the local newspaper for this concession, same to be received at 11 A. M., October 31 and then read at next week's meeting on November 1. Mr. Crockett was asked to withdraw his bid and resubmit it on October 31, if he cared to do 80. The application of JAMES EDGAR CRIDER, 302 West 8th street, for a license to operate as a taxicab a Ford Sedan, 1941 Model, Motor No.6453663, License FT 4329, to replace License No. 127, J. G. Vasquez, cancelled, duly approved by the City Manager, was submitted. Councilman Gillis moved that the permit be approved. R. Arnhamn, approved by the City Manager, was submitted. Councilman Alford moved that the permit be approved. The motion carried by the following vote: Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller and Noes: Councilman Wolf None Absent: None The application of WESTENFIELD DEVELOPMENT COMPANY for a change in the zoning of the following lots: Lots 1 to 22 of Tarrytown from Residence "A" to Commercial "C", Lots 2, 3, 23 and 24 of Tarrytown from Residence "A" to Residence "B", Lots 1 to 20 of Tarrytown #1 from "C" to "C-2", and Lots 1, 2, 3 and 4 of the Resubdivision of Westfield A from Residence "A" to Residence "B", was received; and the matter was referred to the Board of Adjustment for consideration and recommendation. Granted the American Legion permission to place a small house, about 5 ft., square, in front of the Paramount Theatre on Congress Avenue, to be used during their membership drive. The Mayor presented the following application of B. H. WILLIAMS, AGENT for GULF OIL PRODUCTS, for permission to construct a service station on the property located at 2306 South Congress Avenue: "Austin, Texas October 23, 1945 The Honorable City Council Municipal Building Austin, Texas Dear Sirs: We want to ask permission to construct a service station on the property located at 2306 South Congress Avenue. We are attaching four copies of blueprints covering the proposed curb cuts and drainage of this property. Detailed plans on the other construction will be submitted to you for approval before any actual construction starts. It is our desire to purchase this property for the purpose of constructing a service station, but before we complete the purchase, we should know that we will be permitted to build; therefore, we are making application for this permit at this time. Thanking you for your consideration. Yours truly, 18/ B. H. Williams, Agent" CITY OF AUSTIN, TEXAS The following is the report of J. E. Motheral, City Engineer and J. C. Eckert, Building Inspector, on the above request: "Austin, Texas October 25, 1945 561 Mr. Guiton Morgan City Manager Austin, Texas Dear Sir: We, the undersigned, have considered the application of the Gulf Oil Corporation, acting by and through B. H. Williams, Agent, for permission to construct, maintain and operate a drive-in gasoline filling station and to construct commercial driveways in conjunction therewith upon property located on the west side of South Congress Avenue north of Oltorf Street, which property fronts 152.6 feet on South Congress Avenue and 150 feet on College Avenue and is known as Lots 4, 5, and 6, Block 1 of LaPrelle Place, in the City of Austin, Travis County, Texas, and the property upon which this filling station is to be located is under option to the Gulf Oil Corporation and we hereby advise that the following conditions exist: The property upon which this filling station is to be located is designated as "C" Commercial Use District upon the zoning maps of the City of Austin. A storm sewer exists on East Live Oak Street at College Avenue north of this filling station site. We recommend that the Gulf Oil Corporation, acting by and through B. H. Williams, Agent, be granted permission to construct, maintain and operate said drive-in gasoline filling station and to construct curbs, ramps, and sidewalks in conjunction therewith, subject to the following conditions: (1) That all buildings and equipment shall be placed inside of the property line, correct lines to be obtained before construction starts or equipment is installed. Lines and grades to be obtained from the City Engineering Department for entrances and driveways, building lines to be approved by the City Building Inspector. That the applicant shall confer with the City Engineering Department as to the future grades of the sidewalks and gutters on the adjacent streets before he starts any construction relative to the filling station. (2) That the gasoline tanks and pumps shall be of an approved type and shall bear the label of Underwriters Laboratories, Inc.; that all construction of the filling station improvements shall be in accord with the building ordinance, the Zoning Ordinance, the Filling Station Ordinance, and in accord with the ordinance prohibiting the disposal of commercial water or oils upon the City streets. (3) That the grades of the station shall be such that no waste water or oils or any floor washings shall every pass over the City sidewalk area and that all of said oils and water shall be concentrated into a combined grease and sand trap which shall be constructed in accordance with our standard plan 2-H-146 and shall be conducted by a pipe connectCITY OF AUSTIN, TEXAS 562 ion from said sand trap to the nearest storm sewer. Before commencement of any construction the applicant shall apply to the City Engineer for an estimate of the cost of that portion of the storm sewer which will have to be built within any City street or alley and shall deposit in escrow a sum equal to said estimate with the City Finance Director. (4) That all filling station improvements, pumps, driveways, ramps, gutters, sidewalks, and curbs shall be constructed of concrete at the expense of the applicant as set forth upon the plan hereto attached, which plan bears the City Engineer's file number 2-0-997. (5) Expansion joins shall be constructed as shown upon the plan hereto attached marked 2-C-997 and shall be of the pre-moulded type. (6) That before use of said station the owner shall apply to the Building Inspector for final inspection when he considers that he has complied with all the requirements of the City. Eckert, Building Inspector." adoption: Councilman Alford offered the following resolution and moved its (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Council of the City of Austin hereby approves as a filling station site the property located on the west side of South Congress Avenue north of Oltorf Street, which property fronts 152.6. feet on South Congress Avenue and 150 feet on College Avenue, and is known as Lots 4, 5, and 6, Block 1 of LaPrelle Place, in the City of Austin, Travis County, Texas, and hereby authorizes the said Gulf Oil Corporation, acting by and through B. H. WILLIAMS, Agent, to construct, maintain and oper- ate a drive-in gasoline filling station and to construct curbs, ramps and sidewalks in conjunction therewith, subject to the same being constructed in compliance with all the ordinances relating thereto, and further subject to the foregoing attached recommendations and plans; and the Building Inspector is hereby authorized to issue an occupancy permit for the operation of this filling station after full compliance with all the provisions of this resolution, and said permission shall be held to be granted and accepted subject to all necessary, reasonable and proper, present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of the proper police, traffic and fire regulations; and the right of revocation is retained if, after hearing, it is found by the City Council that the said Gulf Oil Corporation, acting by and through B. H. WILLIAMS, Agent, has failed and refused, and will continue to fail and refuse to perform any such conditions, regulations and ordinances. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes: Councilmen Alford, Gillis, Bartholomew, Mayor Miller and Councilman Wolf Noes: None Absent: None 563 CITY OF AUSTIN, TEXAS Councilman Bartholomew offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, the Southwestern Bell Telephone Company has presented to the City Council tentative maps or plans showing the proposed construction of telephone conduits in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Engineer; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be and the same is hereby permitted to construct telephone conduits in the following streets: (1) A telephone conduit in WEST MONROE STREET across South Congress Avenue intersection, the centerline of which telephone conduit shall be ll feet south of and parallel to the north line of said WEST MONROE STREET. (2) A telephone conduit across EAST 12th STREET at a location 107 feet east of the east line of EAST AVENUE, THAT the work and construction of said telephone conduits, including the excavation of the streets and the restoration and maintenance of said streets after said telephone conduits have been constructed, shall be under the supervision and direction of the City Manager and in accordance with the ordinances and regulations of the City of Austin governing such construction. Permission to construct the above curb setback is granted subject to the same being constructed in accordance with the plans approved by the City Engineer of the City of Austin, which plan is hereto attached marked 2-H-805 and made a part hereof, and in accordance with the following conditions: (1) That the construction of the setback area on West 26th Street shall be carried out in accordance with the accompanying plan marked a-H-805 and that all such widened areas, driveways or ramps and curbs shall be constructed of concrete at the expense of the applicant. (2) That all such concrete shall be not less than 6 inches in thickness and shall be of the following proportions: 1 part cement, 2 parts of sand, and 4 parts of screened gravel or rock. (3) That the concrete curb adjacent to the sidewalk area shall be not less than 6 inches high and that an expansion joint not less than 3/4 inch thick shall be placed between the curb and the sidewalk as shown on the plan hereto attached marked 2-H-805. (4) That all such expansion joints shall be of the pre-moulded type. (5) That all concrete work within the street area shall be done by a bonded sidewalk contractor. 566 CITY OF AUSTIN, TEXAS (6) That the applicant shall be required to clean the newly created ramp area at least twice per week and shall dispose of the debris at his expense. (7) That all work shall be done in accordance with lines and grades furnished by the Engineering Department of the City of Austin and under the direction of the City Engineer.
