Roll Call MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting January 10, 1946 Council Chamber, City Hall The meeting was called to order at 11:00 A.M., with Mayor Miller Present: Councilman Bartholomew, Mayor Miller, Councilman Wolf. Absent: Councilmen Alford and Gillis Present also: Guiton Morgan, City Manager; J. E. Motheral, City Engineer; W. T. Williams, City Attorney; and R. D. Thorp, Chief of Police. Mr. E. C. Duke appeared before the Council requesting the use, without any charge, of a part of the Butler Tract for a carnival to be sponsored by the Austin Symphony Orchestra; but upon the suggestion of Mayor Miller that many people did not approve of carnivals and that the Austin Symphony might be harmed more than benefitted by sponsoring such a carnival, Mr. Duke withdrew his request. He expressed appreciation of the cooperation the City of Austin had given the Texas State Guard Battalion. Pursuant to public notice given in the local newspaper, the proposal of the City Council to amend the Zoning Ordinance in the following par- ticulars came up for public hearing: (1) To amend the USE designation of the following described property so as to change the same from "A" Res- idence District to "C" Commercial District, to wit: (a) That portion of land in the City of Austin, Texas, being the southeast portion of Lot A, Louisa Peterson Estate and ex- tending a distance of l12.13 feet north- erly along Alice Avenue from the inter- section of Alice Avenue and 40th Street, and for a distance of 109 feet westerly along 40th Street from the intersection of Alice Avenue and 40th Street. (b) Lots 1,2 and 3, Block 5, M. A. Jarrell Subdivision. There being no property owners or other interested persons present to protest the proposed change, the City Attorney was thereupon instructed CITY OF AUSTIN, TEXAS 20 20 to have the ordinances enacting the change prepared for presentation at the next regular meeting. Pursuant to public notice given in the local newspaper, the proposal of the City Council to amend the Zoning Ordinance in the following par- ticulars came up for public hearing: (8) To amend the USE designation of the following described property so as to change the same from "A" Res- idence District and First Height and Area District to "C" Commercial District and First Height and Area District, to wits (a) All that property contained within a strip 125 feet wide and bound on the north by the north boundary line of Lot 17, Harmon Terrace No. 2; on the west by the east boundary line of High- way No. 29; on the south by the south boundary line of Lot 11, Block U, Ridge- top 4th Addition; and on the east by a line parallel with Highway No. 29. Mr. J. D. Fisk, 914 E. 48층 St., presented a petition signed by 17 property owners in this area protesting this change fearing that it would permit the sale of intoxicating liquors in this area. Mrs. Gramon, 918 East 48 St., also appeared in protest; but after being assured that this change would not permit the same of beer or liquor, she withdrew her protest, but Mr. Fisk protested further the community center. In order to give the 17 petitioners an opportunity to be heard before the Council, this hearing was continued until the Council Meeting of January 17. Pursuant to public notice given in the local newspaper, the proposal of the City Council to amend the Zoning Ordinance in the following par- ticulars came up for public hearing: (2) That the USE designation of all that property known as Blocks 54, 55, 60 and 61, Outlot 24, Division C, Christian and Fellman Addition, located in the City of Austin, Texas, shall be "B" Residence and Second Height and Area District. (3) To amend by changing from Second Height and Area District to Third Height and Area District of all the following described property, to wit: (a) East 1/2 of Blocks 35, 36, 37, 38 and all of Blocks 39 to 54 inclusive, all in Division E; and the East 1/2 of Blocks 134, 149, 157, 175 and all of Blocks 135, 136, 147, 148, 158, 159, 160, 161, 171, 172, 173 and 174 of the Original City of Austin, Texas. (4) To amend the USE designation of the following described property so as to change the same from "A" Residence District to "B" Residence District, to wit: CITY OF AUSTIN, TEXAS 21 21 (a) Lots 6, 7, 8 and 9 in Block 1; Lots B. D, 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11 and 12 in Block 2; Lots 1, 2, 3,4,5,6,7,8, 9 and 10 in Block 3; Lots 1, 2, 3, 4,5 and 6 in Block 4, all in Outlot 4, Divi- sion B. The Council discussed these changes and requested the City Attorney to prepare an ordiance covering same and present to the Council. Mr. Eckert, the Building Inspector, was requested to assist the City Attorney in the prepar ation of this ordinance. Rickey Key, representing the Austin Real Estate Board, appeared before the Council, asking that Tom Graham's name be submitted for consideration CITY OF AUSTIN, TEXAS 22 22 as a member of the City Plan Commission, to take the place of Murray Graham who recently resigned because of illness. The Mayor thanked the Board for its recommendation, and stated that the appointment would not be made until all of the Council members were present. The mayor asked that a letter be written Mr. Murray Graham accepting his resignation with regret, and expressing appreciation of the fine work he did while a member of the City Plan Commission. THAT space for the uses hereinabove enumerated be granted to said Rex D. Kitchens, the boundary of which is described as follows: Sidewalk and Street Working Space Beginning at the southwest corner of the above described property; thence in a southerly direction and at right angles to the centerline of West 6th Street to a point 4 feet north of the north curb line; thence in an easterly direction and parallel to the centerline of West 6th Street approximately 46 feet to a point; thence in a northerly direction and at right angles to the centerline of West 6th Street to the south line of the above described property. 2. (2) That the Contractor shall in no way obstruct any fire plugs or other public utilities in the construction of such barricades. (3) That provisions shall be made for the normal flow of all storm waters in the gutter and the Contractor will be responsible for any damage done due to obstruction of any such storm water. (5) That the Contractor shall remove all fences, barricades, loose materials and other obstructions on the sidewalk and street immediately after the necessity for their existence on said sidewalk or street has ceased, such time to be determined by the City Manager, and in any event all such sidewalk, barricades, materials, equipment and other obstructions shall be removed not later than March 1, 1946. (6) That the City reserves the right to revoke at any time any and all the privileges herein granted or to require the erection or installation of additional barriers or safeguards if the conditions demand it. (7) That the use and enjoyment of the spaces herein granted shall not be exclusive as against public needs, and the City, in making such grant reserves the right to enter and occupy any part or all of said space any time with its public utilities, or for other necessary public purposes. (8) That any public utility, or public or private property, disturbed or injured as a result of any of the activities necessary for the com- pletion of the construction work for said building projects, whether done by the Contractor, City forces, or public utilities, shall be replaced or repaired at the Contractor's expense. (9) That the Contractor shall furnish the City of Austin a surety bond in the sum of Five Thousand Dollars ($5,000.00), which shall protect, indemnify and hold harmless the City of Austin from any claims or damages to any person or property that may accrue to or be brought by any person by reason of the exercise or abuse of the privileges granted the Contractor by the City of Austin and shall guarantee the replacement of all sidewalks, pavement and all other public property and public utilities disturbed or removed during the construction work and shall further guarantee the construction of a walkway and other safeguards during the occupancy of the space. AND THAT whenever pavement is cut in the vicinity of a fire plug water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets, and the restoration and maintenance of said streets after said mains have been laid shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchises granted to said company by the City of Austin. Councilman Wolf offered the following resolution and moved its adop(RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Council of the City of Austin hereby approves as a filling station site the property located at the northwest intersection of Butler Road and Lamar Boulevard, which property fronts 250 feet on Lamar Boule vard and 339.73 feet on Butler Road, same being a portion of the Isaac Decker League within the City of Austin, and being located at 310 South Lamar Boulevard, and hereby authorizes the said Ben H. Powell, acting by and through Giesecke, Kuehne and Brooks, to construct, maintain and operate a drive-in gasoline filling station and to construct curbs, ramps and sidewalks in conjunction therewith, subject to the same being constructed in compliance with all the ordinances relating thereto, and further subject to the foregoing attached recommendations and plans; and the Building Inspector is hereby authorized to issue an occupancy permit for the operation of this filling station after full compliance with all the provisions of this resolution, and said permission shall be held to be granted and accepted subject to all necessary, reasonable and proper, present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of the proper police, traffic CITY OF AUSTIN, TEXAS 30 30 and fire regulations; and the right of revocation is retained if, after hearing, it is found by the City Council that the said Ben H.
