26 CITY OF AUSTIN, TEXAS 268 MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting February 1,1945 10:50 Α.Μ. Council Chamber, City Hall The meeting was called to order, with Mayor Miller presiding. Roll call Present: Absent : Councilmen Alford, Bartholomew, Gillis, Mayor Miller Councilman Wolf Present also: Walter E. Seaholm, Acting City Manager; J.E. Motheral, City Engineer; W. T. Williams, Assistant City Attorney; and R. D. Thorp, Chief of Police. Upon motion, the reading of the minutes was dispensed with. A committee from the Junior Chamber of Commerce, composed of Messrs. Mace Thurman, W. W. Dornberger, and others, came before the Council and asked that the Mayor and City Council cooperate with said organization in its educational campaign against social diseases by issuing a proclamation designating February 7 as SOCIAL HYGIENE DAY. The request was granted. A request by the Austin Council of Church Women and the Austin Council of Churches that the Mayor issue a proclamation proclaiming February 16 as WORLD DAY OF PRAYER was submitted. The request was granted. A committee from the City Plan Commission, composed of H. F. Kuehne, Chairman; Murray Graham; Walter Guttman; and Mrs. A. N. McCallum, came before the Council and submitted a report of said Commission, entitled: "Preliminary Capitol Plan Report of the Austin City Plan Commission", on the proposed Capitol expansion program contemplated by the State of Texas; and asked that the City Council concur in said report insofar as same does not conflict with any plans of the City of Austin. After considerable discussion of the matter, it was the sense of the meeting that the City Council join with the City Plan Commission in approving said report generally - it being considered, from an idealistic stand- point, probably the best plan - but with the stipulation that the owners of all churches and other buildings of sentimental or religious significance included in the proposed expansion program be consulted first 2109 CITY OF AUSTIN, TEXAS 269 before the plan is put into operation; and that a letter to this effect be written to the Capitol Planning Commission. Due to withdrawal by proponent, RICHARD MADISON, of his application, the public hearing on the proposal of the City Council to amend the Zoning Ordinance so as to change the classification of the property at 1204 Chicon Street from "C-1" Commercial to "C-2" Commercial, called for this day, was not held. The application of LIQUOR DEPOT, 300 Congress Avenue, by Winston Kinser, owner, for a Local Distributor's Beer License, recommended for approval by the Acting City Manager, was submitted. Councilman Alford moved that the license be granted. The motion carried by the following vote: Ayes : Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilman Wolf The application of FELIX GILBERT HOLLAND, Riverside Tourist Courts, for a taxicab driver's permit, recommended for approval by the Acting City Manager, was submitted. Councilman Alford moved that the permit be granted. The motion carried by the following vote: Ayes : Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilman Wolf Councilman Alford introduced the following ordinance: AN ORDINANCE REGULATING THE CONSTRUCTION AND REPAIR OF SIDEWALKS, CURBS AND GUTTERS, DRIVEWAYS, SETBACKS AND INCIDENTAL WORK IN THE CITY OF AUSTIN; SPECIFYING MATERIALS TO BE USED IN ALL SUCH CONSTRUCTION; PROVIDING THAT SUCH MATERIALS, KIND, CONTENT, SPECIFICATIONS, AND MANNER OF CONSTRUCTION SHALL BE SUBJECT TO THE APPROVAL OF THE CITY ENGINEER; DEFINING AND LICENSING CONTRACTORS; REQUIRING PUBLIC LIABILITY BONDS FOR ALL SUCH IMPROVEMENTS NOT MADE BY THE CITY OF AUSTIN; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL OTHER ORDINANCES; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH; REQUIRING PERMITS FOR ALL SUCH IMPROVEMENTS; FIXING PENALTIES; AND DECLARING AN EMERGENCY. The ordinance was read the first time and Councilman Alford moved that the rules be suspended and the ordinance be passed to its second reading. The motion carried by the following vote: Ayes : Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilman Wolf The ordinance was then read the second time and Councilman Alford moved that the rules be further suspended and the ordinance be passed to its third reading. The motion carried by the following vote: 274 CITY OF AUSTIN, TEXAS 270 Ayes: Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes: None Absent: Councilman Wolf The ordinance was then read the third time and Councilman Alford moved that the ordinance be finally passed. The motion carried by the following vote: Ayes : Councilmen Alford, Bartholomew, Gillis, Mayor Miller Noes : None Absent: Councilman Wolf The Mayor then declared that the ordinance had been finally passed. H. L. LASSETER came before the Council and complained of a nuisance created by lack of drainage in a certain section of Govalle. After some discussion of the matter, upon recommendation of the City Engineer that approximately $7000.00 would be needed to widen the channel of the creek to relieve the condition, it was agreed by the Council that said amount, or so much thereof as necessary, would be spent for this purpose, provided the adjoining property owners would furnish the City the necessary easements. Further consideration of the matter was referred to a meeting of said property owners and the City Engineer to be held at the Govalle School House. The appointment by the Acting City Manager of W. T. WILLIAMS to be Acting City Attorney, to succeed J. M. Patterson, Jr., resigned, was approved. There being no further business, upon motion seconded and carried, the meeting was recessed at 12:30 P.
