CITY OF AUSTIN, TEXAS 3315 MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting April 04, 1946 10:30 Council Chamber, City Hall The meeting was called to order, with Mayor Miller presiding. Roll call Present: Councilmen Alford, Bartholomew, Mayor Miller, and Councilman Absent: None Wolf : Present also: Guiton Morgan, City Manager; Trueman O'Quinn, City Attorney; J. E. Motheral, City Attorney; R. D. Thorp, Chief of Police. Mrs. Beal Stone, 1810 Chicon Street, came before the Council regarding taxes on a piece of property she was contemplating purchasing, stating the taxes were more than the price on the property. The Mayor advised Mrs. Stone to contact the Tax Assessor and the City Manager, and they would work out something for her. Pursuant to published notice thereof, the public hearing on the proposal of the City Council to amend the Zoning Ordinance in the following par- ticulars: (1) To amend the USE designation of the following described property so as to change the same from "E" Heavy Industrial District and Third Height and Area District to "C-2" Commercial District and Third Height and Area District, to-wit: Lot No. Eleven (11) and Lot No. Twelve (12), Outlot No. 12, Division "C", Plat 25-B, in the City of Austin, Travis County, Texas; was duly opened at the appointed hour. Mr. HORACE SHELTON, representing DOMENICO MILICIA; and MR. HAGE, LESSEE, appeared favoring this requested change. MR. THRASHER appeared in opposition for himself and also a negro EDGAR LEE, stating the approach to the City was dry; the rezoning would not add value to the property surrounding the location and that the negro had small children, and did not want this package store next door to him; and also that the Zoning Board had refused to grant this CITY OF AUSTIN, TEXAS 316 change. Mayor Miller moved that in view of the fact Mr. Hage had other package stores, and since there was much opposition to packaage stores on the highways, and that there was opposition in the immediate territory, that the recommendation of the Zoning Board of Adjustment be adopted and that the change from "E" to "C-2" be NOT approved. CITY OF AUSTIN, TEXAS 318 adoption: Councilman Alford submitted the following resolution and moved its (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN THAT THE MAYOR is hereby authorized and directed to execute a permit and right-of-entry granting to the Troop Carrier Command, Third Army Air Forces, the righ to conduct training operations at the Municipal Airport, provided that such temporary permit will be for thirty days only, and that prior to the expiration of the thirty-day period that a formal contract be entered into subject to the approval of the City Council. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayest Noes: Councilmen Alford, Bartholomew, Mayor Miller, and Councilmen Wolf. None Absent: None Mayor Miller stated he had called a public hearing on the Bond Issue with the Banking Group and Bond Dealers with the Council Monday, April 8th at 3:00 P.M. He stated he wanted other public hearings set with the Medical Association and staff of the Brackenridge Hospital, the Junior Chamber of Commerce, and any other groups that desired to be heard, before the meeting of the Council April 18, 1946. The Mayor moved that on April 18, 1946, after various public hearings have been held, the Council will set a date for the bond election, and would set out the various necessary propositions of the bond issue separately, so that everyone would have a chance to express themselves on any part of the issue. None Absent: None Mayor Miller expressed regrets of the resignation of Councilman Gillis, and stated he hoped Councilman Gillis would reconsider before the Council meeting of April 18th. The Mayor moved that the Council at its meeting on April 18th will set a date for an election to fill the vacancy of Councilman Gillis, if he did not withdraw his resignation before that date; the election to be at a later date than the bond election. Ayes: Noes: None Absent: None Councilman Bartholomew submitted the following resolution and moved its adoption: (RESOLUTION) WHEREAS, the City Council has decided to provide lower domestic rates to consumers residing within the corporate limits of the City of Austin for a seven months period; namely, for water consumption on which bills are rendered between April 1 and October 31, 1946, for the purpose of furthering the garden program and the further beautification of the city; and WHEREAS, it is the intention of the City Council that this reduction shall be made only to those water consumers whose use shall be strictly for residential purposes, and is not effective for commercial purposes; THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be and he is hereby authorized and directed to make effective on all water readings within the corporate limits of the City of Austin, Texas, for all water consumers whose use is strictly for residential pur- poses, as of bills rendered between April 1 to October 31, 1946, at the following rates: CITY OF AUSTIN, TEXAS First 1,500 Next 2,000 - 50 cents (minimum charge) 30 cents per 1,000 gallons Next 12,500 18 cents per 1,000 gallons Next 34,000 14 cents per 1,000 gallons Next Over 200,000 - 12 cents per 1,000 gallons 250,000- 12 cents per 1,000 gallons 321/ Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes: Councilmen Alford, Bartholomew, Mayor Miller, and Councilman Wolf Noes: None tion: Absent: None Councilman Wolf presented the following resolution and moved its adop(RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Council of the City of Austin hereby approves as a filling station site the property situated at the southeast intersection of East First Street and East Avenue, which property is owned by the Sinclair Oil Company and fronts ill feet on East First Street and approximately 139 feet on East Avenue, and is designated as Lots 1 and 2, and the west 10 feet of Lot 3, Block 1, of a subdivision of Outlots 31 and 32 of the government outlots of the City of Austin, Travis County, Texas, and hereby authorizes the said Sinclair Oil Company, acting by and through A. F. Buck, District Manager, to construct, maintain and operate a drive-in gasoline filling station and to construct curbs ramps and sidewalks in conjunction therewith, subject to the same being constructed in compliance with all the ordinances relating thereto, and further subject to the foregoing attached recommendations and plans, and the Building Inspector is hereby authorized to issue an occupancy permit for the operation of this filling station after full compliance with all the provisions of this resolution, and said permission shall be held to be granted and accepted subject to all necessary, reasonable and proper, present and future regultions and ordinances of the City of Austin, Texas, in the enforcement of the proper police, traffic and fire regulations, and the right of revocation is retai ned if, after hearing, it is found by the City Council that the said Sinclair Oil Company have failed and refused, and will continue to fail and refuse to perform any such conditions, regulations and ordinances. The Council received a petition signed by property owners requesting that East 2nd Street be opened to the City Limits. This petition was referred to the City Manager and Director of Public Works to make a study of this proposition and try to comply with their request. Councilman Alford moved that tax penalties be deferred until June 1, 1946, but that the interest will go on at the regular 6%; penalty of 5% not to go on until June 1, 1946.
