CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting April 25, 1946 The meeting was called to order with Mayor Miller presiding. Roll Call 357357 $ Present: Councilmen Bartholomew, Mayor Miller, Councilman Wolf Absent: Councilman Alford Present also: Guiton Morgan, City Manager; Trueman E. O'Quinn, City Attorney; J. E. Motheral, Director of Public Works; R. D. Thorp, Chief of Police. The following citizens from the Govalle section appeared before the Council: Messrs. Travis Howard, John H. Aldridge, W.F. Gardner, S. T. Ragsdale, J. W. Suter and W. N. Terrell. The purpose of their visit to the Council was to find out what the City could do for that section regarding the drainage problem. The Mayor told them that relief would be given as soon as possible and that a lot of work had been planned for this area to be paid for out of the bonds that he hoped would be voted. The group invited the Mayor and Council to speak on the bonds at a meeting which the Govalle citizens were plan- ning at the School House, Friday night, 8:00P.M. The Mayor accepted and said that the Council and he would be glad to explain the bond program and answer any questions they might want to ask. Mr. Henry Morena, representing the Lulac Club, appeared before the Council asking that the City install lights at the Zaragose Park Baseball Park so that night baseball could be played. The Mayor stated that this was in the program but that because of the shortage of wire and other needed materials, he did not think that this installation could be made this year. The Mayor suggested that the Lulac Club have a meeting next week, any night excepting Monday, and that he and the Council would be glad to appear and explain to their members just what the Bond program will mean to them and to Austin. Mr. Moreno is to let the Mayor know the date. Councilman Bartholomew offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, in Book 3, page 55, of the Plat Records of Travis County, Texas, there appears a map or plat of a subdivision of land known as The Highlands, a subdivision of a portion of the James P. Wallace League within the City of Austin, Travis County, Texas; and CITY OF AUSTIN, TEXAS 1 35858 WHEREAS, upon said map or plat there appear various streets and alleys, one of which alleys herein referred to is 20 feet in width and traverses Blocks 45 and 50 of said Highlands, and being the alley one-half block west of and parallel to Avenue Fand extending from East 51st Street to East 53rd Street; and WHEREAS, A. F. Smith and M. F. Abrahamson, owners of all the proper ty abutting said alley, have requested the City Council to close said alley in order that they might re-subdivide Blocks 45 and 50 of the said Highlands; and WHEREAS, said request has been reviewed and considered by the City Council of the City of Austin; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT, that certain alley 20 feet in width which traverses Blocks 45 and 50 referred to above, be, and the same is hereby permanently closed and vacated. F. Smith and M. F. Abrahamson, owners of all the land abutting each side of said North Loop Boulevard, have petitioned the City Council of the City of Austin to permanently abandon, vacate and close the said North Loop Boulevard, and the said A. F. Smith and M. F. Abrahamson have agreed to dedicate in lieu of North Loop Boulevard another street serving this general vicinity to a better advantage, and a tentative layout has been prepared showing the street to be dedicated in lieu of said North Loop Boulevard, and said plan has been reviewed and considered by the City Council of the City of Austin; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: CITY OF AUSTIN, TEXAS 359 THAT, North Loop Boulevard as previously referred to is hereby permanently abandoned, vacated and closed. A. Webb is the Contractor for the repair of a building located at 503-05-07 Colorado Street and desires a portion of the sidewalk and street space abutting Lot 11, Block 55, of the Original City of Austin, Travis County, Texas, during the repair of the building, such space to be used in the work and for the storage of materials therefor; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: 1. THAT space for the uses hereinabove enumerated be granted to said T. A. Webb, the boundary of which is described as follows: Sidewalk and Street Working Space Beginning at the east curb line of Colorado Street and the projected south line of the above described property; thence in a westerly direction and at right angles to the centerline of Colorado Street approximately 14 feet to a point; thence in a northerly direction and parallel with the centerline of Colorado Street approximately 46 feet to a point; thence in an easterly directinn and at right angles to the centerline of Colorado Street to the east curb line. 2. THAT the above privileges and allotment of space are granted to the said T. A. Webb, hereinafter termed "Contractor", upon the following CITY OF AUSTIN, TEXAS 361 express terms and conditions: (1) That the Contractor shall construct a foot walkway within the outer boundaries of the above described working space, such walkway to be protected on each side by a guard rail at least 4 feet high and substantially braced and anchored, and without wood strips or obstructions of any kind along the pavement within the walkway, and at any time in the opinion of the City officials it becomes necessary for any reason to install a board floor within the walkway, the Contractor shall upon notice from the Building Inspector immediately place such a wood floor and substantially support same to prevent sagging under load. (2) That the Contractor is permitted to construct in his working space a substantial gate which shall be kept closed at all times when not in use, and at all times that such gate is open, the Contractor shall maintain a person at this gate to warn pedestrians and vehicles of approaching trucks. This gate is not to open out so as to impede vehicular or pedestrian traffic. (3) That no vehicles in loading or unloading material at the working space shall park on any part of the street outside of the allotted working space. (4) That "No parking" signs shall be placed on the street side of the barricades. (5) That the Contractor is permitted to construct a temporary work office within such allotted working space provided such work office is not with- in 25 feet of any corner street intersection. (6) That the Contractor shall in no way obstruct any fire plugs or other public utilities in the construction of such barricades. (7) That provisions shall be made for the normal flow of all storm waters in the gutter and the Contractor will be responsible for any damage done due to obstruction of any such storm water. (8) That the Contractor shall place on the outside corners of any walkway, barricades or obstructions, red lights during all periods of darkness and provide lighting system for all tunnels. (9) That the Contractor shall remove all fences, barricades, loose materials, and other obstructions on the sidewalk and street immediately after the necessity for their existence on said sidewalk or street has ceased, such time to be determined by the City Manager, and in any event all such sidewalk, barricades, materials, equipment and other obstructions shall be removed not later than June 15, 1946. (10) That the City reserves the right to revoke at any time any and all the privileges herein granted or to require the erection or installation of additional barriers or safeguards if the conditions demand it. (11) That the use and enjoyment of the spaces herein granted shall not be exclusive as against public needs, and the City, in making such grant reserves the right to enter and occupy any part or all of said space any time with its public utilities, or for other necessary public purposes. CITY OF AUSTIN, TEXAS 362 (12) That any public utility, or public or private property, disturbed or injured as a result of any of the activities necessary for the completion of the construction work for said building projects, whether done by the Contractor, City forces, or public utilities, shall be replaced or repaired at the Contractor's expense. (13) That the Contractor shallfurnish the City of Austin a surety bond in the sum of Five Thousand Dollars ($5,000.00), which shall protect, indemnify and hold harmless the City of Austin from any claims or damages to any per- son or property that may accrue to or be brought by any person by reason of the exercise or abuse of the privileges granted the Contractor by the City of Austin and shall guarantee the replacement of all sidewalks, pavement and all other public property and public utilities distrubed or removed during the construction work and shall further guarantee the construction of a walkway and other safeguards during the occupancy of the space. The request of C. E. Dye, acting for his mother, Mrs. Jessie T. The City Attorney was instructed to contact Kenneth Lampkin, Attorney for Mattie Roberts, to find out if she wanted a public hearing on her request to change the property located at 1911 Salina Street from "A" Residence to "C" Commercial and which the Zoning Board of Adjustment did NOT recommend. The report of the Zoning Board on their recommendations for the zoning of the 1901 acres, located north and northeast of the city, which was taken into the city limits October 18, 1945, was received and discussed bythe Council. The Mayor stated that this was a matter which would have to be studied and considered, and that a public hearing would be held, setting the date, May 23, at 8 P.M., in the Council Room, for such hearing. Crockett appeared before the Council regarding the zoning of his property in this area, a part of the Hill Tract, and he was told that the final decision would be made after the hearing on May 23rd. Johnson, representing Patton's, Inc., appeared and presented a petition from several of the taxicab terminal operators asking that the taxicab ordinance be amended so as to require meters in all taxicabs. The Mayor told Mr. Johnson that a public hearing would be held on this question and set May 14, at 8 P. M. as the date for the hearing. The Mayor asked that a letter be written to Councilman Alford extending sympathy and congratulating him on his recovery and wishing him a speedy recovery. The Council extended an invitation to the 550 Chinese students at Bergstrom Field to visit the City-owned plants, such as the power, filter, sewage disposal, etc. The Mayor was to extend the invitation through the Commander of Bergstrom Field at a dinner he was to attend.
