387387 CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting May 9,1946 Council Chamber 11 Α. Μ. The meeting was called to order, with Mayor Tom Miller presiding. Roll call Present: Absent: Councilman Bartholomew, Mayor Miller, and Councilman Wolf Councilman Alford Present also: Guiton Morgan, City Manager; Trueman O'Quinn, City Attorney; J. E. Motheral, Director of Public Works; and R. D. Thorp, Chief of Police. Pursuant to published notice thereof, the public hearing on the proposal of the City Council to amend the Zoning Ordinance in the following particulars, to-wit: To amend the USE designation of the following described property so as to change the same from "B" Residence District, Third Height and Area District to "C" Commercial District, Third Height and Area District, to-wit: Original Lots 1, 2, 3, 10, 11 and 12, Block 172, Original Lots 1, 2, 3, 10, 11 and 12, Block 173, City of Austin, located on the north side of 14th Street, between Colorado and Brazos Streets, City of Austin, Travis *County, Texas. The following citizens appeared to protest this change, Rev. Roesner, Pastor of St. Martin's Luthern Church, Mr. Betts, a member of the Luthern Church Board of Stewards, Rev. Walter Kerr, pastor of the Central Methodist Church, Mr. D. C. Carlson, a member of the Central Methodist Church, Mr. H. J. H. Melin, owner of property located at 1409 Congress Avenue, and a member of the Luthern Church, and representatives of the First Church of Christ Scientist. The following citizens appeared to appeal for this change: Mrs. Wayne Huff, Mrs. S. W. Johnson, and Mrs. Ethel Hartman. After a lenghty discussion, pro and con, Councilman Wolf moved that the recommendation of the Zoning Board of Adjustment to grant this change be NOT sustained, but that Mrs. S. W. Johnson and Mrs. Ethel Hartman, two of the applicants, be referred to the Zoning Board of Adjustment for an appeal for a tempo- rary use permit which would permit them to rent their property to the State of Texas for office space. Upon the following vote, the motion prevailed: Ayes: Noes: Absent: Councilman Bartholomew, Mayor Miller and Councilman Wolf None Councilman Alford CITY OF AUSTIN, TEXAS 388384 Mr. James Nash appeared and asked what had been done with his request for the widening of West 7th Street, between Colorado and Lavaca Streets. The City Engineer was instructed to see what could be done about this request and, at the suggestion of several of the Council members, to include in this widening program the area on West 7th Street between Lavaca and Guadalupe streets also. The following report of the Zoning Board of Adjustment on the requests of Messers C. E. Dye, Roy W. Frazier and R. T. Spaw for a change in the zoning of Lots Nos. 6, 7. 8, 9, 10, 12, 13, 14 and 15, Block 2, Pecan Grove Addition, and 312.9 feet by 90 feet deep lying on the west side of Jessie Street, all in the City of Austin, from "A" Residence, 1st Height and Area District, to "C" Commercial District, 2nd Height and Area District, was received: "Austin, Texas May 8, 1946 Hon. Mayor and City Council Austin, Texas Gentlemen: The following is a copy of a resolution which was passed by the Board of Adjustment at a meeting on April 30, 1946: RESOLUTION WHEREAS, the City Council of the City of Austin, pursuant to the terms of Section 31 of the Zoning Ordinance of the City of Austin, has referred to the Zoning Board of Adjustment for its consideration the petitions of C. E. Dye, Roy W. Frazier and R. T. Spaw requesting changes in the Use Designation of the following properties: a. Lots Nos. 6, 7, 8, 9, 10, 12, 13, and 15, Block 2 of the Pecan Grove Addition to the City of Austin, and b. Lots No. 14, Block e of the Pecan Grove Addition to the City of Austin, and C. 312.9 feet by 90 feet deep lying on the West side of Jessie Street, from "A" Residence District and First Height and Area District to "C" Commercial District and Second Height and Area District. WHEREAS, the Board of Adjustment at a meeting on April 30, 1946 carefully considered this application; and WHEREAS, the Zoning Maps of the City of Austin disclose the fact that the block containing the lots of Mr. C. E. Dye now has the frontage on Barton Springs Road zoned as a "C" Commercial District and the block east across Josephine Street is now a "C-1" Commercial District and the property north across Butler Road fronting thereon is now a "0-1" Commercial District; and WHEREAS, the property of Mr. R. T. Spaw fronts on Jessie Street to the west of the block referred to in the preceding paragraph and Lot No. 14 of Mr. Roy W. Frazier lies in the same block with Mr. C. E. Dye's property; and WHEREAS, should the Use Classification of the property of Mr. R. T. CITY OF AUSTIN, TEXAS 3898 Spaw be changed as requested, then all of the property of Mr. C. E. Dye and Mr. Roy W. Frazier would be surrounded by commercial property, and, conversely, should Mr. Dye's property be changed, then Mr. Spaw's residence property would front on commercial property; and WHEREAS, an examination of the property in question and the surrounding neighborhood indicates a continued commercial development along Barton Springs Road and Lamar Boulevard and the position of this property in the present pattern of zoning would indicate that the trend of development and the present zoning classification surrounding it render it less desirable for resi- dential purposes and has an adverse effect on its character and potential usefulness; and WHEREAS, the Board deemed under these conditions and circumstances all of this property should be changed rather than one portion or the other so that all will be treated alike and its use fit into the general scheme of zoning in this particular area; therefore BE IT RESOLVED BY THE BOARD OF ADJUSTMENT: THAT, the above changes in the Use Designation of these properties be recommended to the City Council. /s/ Respectfully submitted, BOARD OF ADJUSTMENT by H. Jones, for a change in the zoning of Lots Nos. 7, 8, 9, 10, 11 and 12, Block 4, Hartwell Addition, City of Austin, from "A" Residence, 1st Height and Area District, to "C" Commercial, 2nd Height and Area District, was received: "Austin, Texas May 8, 1946 Hon. Mayor and City Council Austin, Texas Gentlemen: The following is a copy of a resolution which was passed by the Board of Adjustment at a meeting on May 7, 1946: RESOLUTION WHEREAS, the City Council of the City of Austin, pursuant to the terms of Section 31 of the Zoning Ordinance of the City of Austin, has referred to the Zoning Board of Adjustment for its consideration the applications of Opal Brown, Eula Patterson and Ivor F. Jones requesting changes in the Use Designation of the following properties: 3909 CITY OF AUSTIN, TEXAS a. Brown in the amount of $426.00; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Manager be and he is hereby authorized to sell to the said John D. Brown a portion of Lot 58, Pleasant View Addition, City of Austin, for the sum of $426.00. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes: Councilman Bartholomew, Mayor Miller and Councilman Wolf Noes: None Absent: Councilman Alford CITY OF AUSTIN, TEXAS 392 The Council approved the recommendation of the Recreation Department and the City Manager that the Servicemen's Information Center, at the Driskill Hotel, which had been maintained for Servicemen since the beginning of World War II, be closed. The Mayor offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Recreation building located at Comal and Third Streets be hereafter known as the "Pan-Am Recreation Center"; BE IT FURTHER RESOLVED: THAT Concepcion Olvera be congratulated for his suggestion with regar d to the selection of the above mentioned name. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes: Councilman Bartholomew, Mayor Miller and Councilman Wolf Noes: Absent: None Councilman Alford Mayor Miller moved that the informal action of May 7, 1946, appointing William M. Wolf, attorney-at-law, Judge of the Corporation Court of the City of Austin, effective May 8, 1946, in order that Judge Wolf might sit as Judge of the Corporation Court during the temporary absence of Judge J. W. Maxwell, who, on account of illness, is at present unable to perform the duties of his office, be ratified.
