537 537 CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting July 11, 1946 10:50 Α.Μ. Council Chamber, City Hall The meeting was called to order, with Mayor Miller presiding Roll call • Present: Councilman Bartholomew, Mayor Miller, Councilmen Thornberry and Wolf - 4 Absent: Councilman Alford 1 - Present also: Guiton Morgan, City Manager; J. E. Motheral, Director of Public Works; Trueman O'Quinn, City Attorney; and R. D. Thorp, Chief of Police. The reading of the Minutes was dispensed with. A committee from the South Austin Civic Club, with Roy Morey, as spokesman appeared before the Council and requested that a sewer extension be made to the area on Kenwood Avenue in Travis Heights where there have been several polio cases and one death this year. The Mayor advised the group that this extension and the one in the northeastern part of the city would be made as soon as bids for this work could be advertised and the award of the contract made, which would take about eighteen or twenty days. A map showing the needed sewer extensions all over the city was shown, and the Mayor stated that the city had grown faster than the needed utilities could be installed; that each area felt that its needs were greater than those of the other areas; but that the area on Kenwood Avenue would be taken care of first. The hearing on the recommendations of the Zoning Board regarding the location of fraternities and sororities in the "B" Residential District was held. A map prepared by the Zoning Board, showing the suggested areas for the location of fraternities and sororities, to be known as "B-1", was submitted. The following persons appeared regarding this proposed change: JIM SMITH, representing the TEJAS CLUB, who stated that his organization owns a lot located at 2806 Rio Grande Street, just outside the proposed "B-1" area, and wished to know where they would stand if they wanted to build. He was advised that he had the right of appeal to the City Council for a permit to build a fraternity house or club house on this property, CITY OF AUSTIN, TEXAS 534 538 WILL HART, who wanted to know what the status of his property located at East Avenue and 20th Street would be if this "B-1" district were created, and stated further that he did not favor this change if it would limit the use of his property; ADELE HENDERSON, owner of property at 24th and Leon Streets, who stated that she had bought this property for the purpose of selling it to a fraternity but that said property had not been included in the area proposed for fraternities and sororities, and asked if she would be permitted to sell said property to a fraternity and was advised that she would and that a permit would be issued for a fraternity at this location; JAS. ANDERSON, JR., representing the Beta Theta Pi Fraternity, who stated that his fraternity owned several lots at the corner of 24th Street and Shoal Creek Boulevard, and asked if a fraternity house could be built on said property, After a lengthy discussion of the matter, the City Manager suggested that an amendment to the Zoning Ordinance providing that anyone wishing to build a fraternity or sorority or co-operative house for students would have the right of appeal to the City Council for such permit if such property were in a "B" District be prepared, such provision being similar to the one in the Zoning Ordinance for a "C-1" District. The City Attorney was instructed to prepare such amendment and have same ready for the Council at its next regular meeting. "SKINNY" PRYOR appeared and asked that Zilker Springs pool be enlarged to accommodate the increasing number of patrons, and suggested that this be done by building another dam below the present dam. He was advised that this matter was already underconsideration, but would have to be undertaken at some future date. A petition signed by a number of property owners on the Cameron Road from 51st Street north to the city limits, asking that some relief regarding the water pressure in that area, in the way of a la rger water main, be given them immediately, was submitted; and the matter was taken under advisement. L. HIRSCH, 1104 Taylor Street, appeared and requested the City Council to grant a change in zoning, from "A" Residence to "C" Commercial, of his property located at 1104 Taylor Street; the Zoning Board having reported adversely on said change. A public hearing on the matter was called for August 1 next at 11:00 A. M. FREDERICK ROMBERG, who lives on Park Place, appeared and asked that something be done about the traffic hazards on this street, stating that the Police Department had painted some lines and stop signs some time ago, but that they had faded out, and the property owners in this area would appreciate something being done to lessen the traffic hazard. He further asked if it would be possible to keep the taxicabs and heavy trucks off his street, but was told that this could not be done. W. T. WILLIAMS, SR., appeared and requested a zoning change from "A" Residence to "C" Commercial of the property owned by the CHALK HILL THEATER COMPANY, LTD., located on the Dallas Highway between Nelray Boulevard and the property owned by the City of Austin, said property to be used for a drive-in theatre. 539 CITY OF AUSTIN, TEXAS 539 C. F. HERRING appeared and stated that he represented a number of property owners in this area and that they wanted to protest such change, and that he thought the matter should be referred to the Zoning Board but that the City Attorney had stated that the City Council would be the proper authority to hear this request. After a discussion of the matter, the Council set a public hearing on the change requested by W. T. Williams, Sr., for July 18 next at 11:00 A. M. The continued hearing on the zoning of the property on the west side of the Dallas Highway from Koenig Lane to the Railroad Tracks, was held. After a lengthy discussion, the Council voted NOT to sustain the recommendations of the Zoning Board but to change this property to "C-2" Commercial, and the City Attorney was instructed to prepare an amendment to the Zoning Ordinance covering this change. The application of S. G. GARRETT for a change in the zoning of 175 along Red River Street and 150 along 32nd Street from "B" Residence to "C"Commercial was referred to the Zoning Board for their consideration and recommendation. Councilman Bartholomew introduced the following ordinance: AN ORDINANCE AMENDING THAT CERTAIN ORDINANCE PASSED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS, JULY 17, 1941, AND RECORDED IN ORDINANCE BOOK "L", PAGES 152-174, INCLUS IVE, OF THE ORDINANCE RECORDS OF THE CITY OF AUSTIN, WHICH ORDINANCE WAS AMENDATORY OF THAT CERTAIN ORDINANCE ESTABLISHING ZONING REGULATIONS AND DISTRICTS IN ACCORDANCE WITH A COMPREHENSIVE PLAN PASSED BY THE CITY COUNCIL APRIL 23, 1931, AND RECORDED IN ORDINANCE BOOK "I" PAGES 301-318, BOTH INCLUSIVE, OF THE ORDINANCE RECORDS OF THE CITY OF AUSTIN, THE AMENDATORY ORDINANCE HEREBY CHANGING THE USE DESIGNATION FROM "A" RESIDENCE DISTRICT AND FIRST HEIGHT AND AREA DISTRICT TO "C" COMMERCIAL DISTRICT AND SECOND HEIGHT AND AREA DISTRICT ON CERTAIN PORTIONS OF LOTS 13 AND 14, IN EVERGREEN HEIGHTS ADDITION, CITY OF AUSTIN, TRAVIS COUNTY, TEXAS; AND ORDERING A CHANGE IN THE USE MAPS SO AS TO RECORD THE CHANGES HEREBY ORDERED; AND DECLARING AN EMHIRGENCY. Councilman Thornberry offered the following resolution, and moved its adoption: CITY OF AUSTIN, TEXAS 54 42 542 (RESOLUTION) WHEREAS, in Book 3, page 227, of the Plat Records of Travis County, Texas, there appears a map or plat of a subdivision of land known as Happy Hollow, a subdivision of a portion of the George W. Spear League within the City of Austin, Travis County, Texas; and WHEREAS, upon said map or plat there appear various streets and alleys, one of which alleys herein referred to is 20 feet in width, and being the alley one-half block north of, and parallel to, West 34th Street, and extending from Jackson Avenue westerly to the west line of the said Happy Hollow Subdivision; and WHEREAS, all the owners of the property abutting said alley have requested the City Council of the City of Austin to close said alley; and WHEREAS, said request has been reviewed and considered by the City Council of the City of Austin; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT that certain alley 20 feet in width which is one-half block north of, and parallel to, West 34th Street, and extends from Jackson Avenue to the west line of Happy Hollow Subdivision as referred to above, be closed and vacated, except the City of Austin hereby retains utility easement rights in, upon, and across said alley. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: AYES : Councilman Bartholomew, Mayor Miller, Councilman Thornberry and : Noes Absent: Wolf None Councilman Wolf Councilman Bartholomew introduced the following resolution; and moved its adoption: (RESOLUTION) WHEREAS, the certain portions of public streets hereinafter described are within an excavated area which prevents the practical use of such streets or portions thereof for development as a street and for use by the public; and WHEREAS, no part of said tracts of land has ever been opened to or used by the public as a street; and WHEREAS, the courses of said streets should be altered in such manner as to allow the free passage of traffic; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the following described streets or portions thereof be, and the same are hereby, abandoned and closed as public streets: (1) West fifty-four (54) feet of Raleigh Avenue between the north line of Cherry Lane and the north line of Clearview Drive, all as shown upon the map or plat of Walsh Place of record in Book 3, page 26, of the Plat Records of Travis County, Texas; CITY OF AUSTIN, TEXAS 543 543 (2) A portion of Cherry Street now known as Cherry Lane between Scenic Avenue now known as Rockmoor Avenue and Walsh Avenue now known as Raleigh Avenue, as shown on the map or plat of Walsh place of record in Book 3, page 26, of the Plat Records of Travis County, Texas, the portion of said Cherry Lane to be vacated being more particularly described as follows: : Beginning at a point at the intersection of the south line of Cherry Lane and the west line of Raleigh Avenue; Thence with the south line of said Cherry Lane, same being the north line of Lot 14, Block 9, of the aforementioned Walsh Place N. 600441 W. 96.75 feet to a point; Thence N. 25°46' W. 101.20 feet to a point in the north line of said Cherry Lane; Thence with the north line of Cherry Lane S. 60044 E. 180.13 feet to a point at the intersection of the said north line of Cherry Lane with the west line of Raleigh Avenue; Thence S. 29°42' W. 58.0 feet to the place of beginning. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes: Councilman Bartholomew, Mayor Miller, Councilmen Thornberry and Noes: Wolf None Absent: Councilman Alford CITY OF AUSTIN, TEXAS 544 545 Councilman Thornberry offered the following resolution, and moved its adoption: (RESOLUTION) WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore 1 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be, and the same is hereby, permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in BRENTWOOD STREET from Georgetown Road westerly 3½ blocks, the centerline of which gas main shall be 7.5 feet south of, and parallel to, the north property line of said Brentwood Street; Said gas main described above shall have a cover of not less than 22 feet. (2) A gas main in HODGES STREET from Crockett Street southerly 60 feet, the centerline of which gas main shall be 7.5 feet west of, and parallel to, the east property line of said Hodges Street. Said gas main described above shall have a cover of not less than 25 feet. (3) A gas main in CROCKETT STREET from a point 21 feet east of Hodges Street westerly 76 feet, the centerline of which gas main shall be 6.5 feet south of, and parallel to, the north property line of said Crockett Street; Said gas main described above shall have a cover of not less than 22 feet. (4) A gas main in ELTON LANE from Forest Trail northerly 77 feet, the centerline of which gas main shall be 7.5 feet west of, and parallel to, the east property line of said Elton Lane. Said gas main described above shall have a cover of not less than 20 feet. (5) A gas main in TOM GREEN STREET from a point 43 feet south of East 33rd Street northerly 247 feet, the centerline of which gas main shall be 20 feet west of, and parallel to, the east property line of said Tom Green Street. Said gas main described above shall have a cover of not less than 2 feet. (6) A gas main in CLEARVIEW DRIVE from Meadowbrook Drive easterly 358 feet, the centerline of which gas main shall be 7.5 feet south of, and parallel to, the north property line of Clearview Street. 5416 546 CITY OF AUSTIN, TEXAS Said gas main described above shall have a cover of not less than 2 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the Department of Public Works not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. And that whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. That the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Which motion, carrying with it the adoption of the resolution, prevailed by the following vote: Ayes: Noes: Councilman Bartholomew, Mayor Miller, Councilmen Thornberry and Wolf None Absent: Councilman Alford The application of East Side Taxi Company, by Jimmie A. Cadd and Woodie McWallace, owners, for a permit to operate a taxicab terminal at 2000 Rosewood Avenue was submitted. Councilman Wolf moved that the application be approved. Conn, 203 West 15th Street, for a license to operate as a taxicab a 4-door Ford Sedan, 1940 Model, License No. HE 3221, duly approved by City Manager, was submitted. Councilman Bartholomew moved that the application be approved.
