Roll call. 4 Present: Councilmen Glass, Johnson, Mayor Miller, Councilman Thornberry Absent : Councilman Bartholomew - 1 Present also: Guiton Morgan, City Manager; Trueman E. O'Quinn, City Attorney; J. E. Motheral, Director of Public Works; and R. D. Thorp, Chief of Police. The reading of the Minutes was dispensed with. Councilman Glass offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Council of the City of Austin hereby approves as a filling station site the property located on the southwest intersection of Georgetown Road and Stark Street, which property fronts 107.5 feet on Georgetown Road and 95.31 feet on Stark Street and is known as Lots 3 and 4 of the Stark Addition within the City of Austin, Travis County, Texas, and hereby authorizes the said Jack Griffin to construct, maintain and operate a drive-in gasoline filling station and to construct curbs, ramps and sidewalks in conjunction therewith, subject to the same's being constructed in compliance with all the ordinances relating thereto, and further subject to the foregoing attached recommendations and plans; and the Building Inspector is hereby authorized to issue an occupancy permit for the operation of this filling station after full compliance with all the provisions of this resolution, and said permission shall be held to be granted and accepted subject to all necessary, rea- sonable and proper, present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of the proper police, traffic and fire regulations; and the right of revocation is retained if, after hearing, it is found by the City Council that the said Jack Griffin has failed and refused, and will continue to fail and refuse to perform any such conditions, regulations and ordinances. (Recommendations attached) 1367 CITY OF AUSTIN, TEXAS "Austin, Texas June 19, 1947 1367 Mr. Guiton Morgan City Manager Austin, Texas Dear Sir: We, the undersigned, have considered the application of Jack Griffin for permission to construct, maintain and operate a drive-in gasoline filling station and to construct commercial driveways in conjunction therewith upon property located on the southwest intersection of Georgetown Road and Stark Street, which property fronts 107.5 feet on Georgetown Road and 95.31 feet on Stark Street and is known as Lots 3 and 4 of the Stark Addition within the City of Austin, Travis County, Texas, and the property upon which this filling station is to be located is owned by the said Jack Griffin, and we hereby advise that the following conditions exist: The property upon which this filling station is to be located is designated as "C" Commercial Use District upon the zoning maps of the City of Austin. There are no storm water drainage facilities in place adjacent to this property. The storm water and surface drainage from this filling station will have to be conveyed to a seep well to be constructed on the property of the applicant. We recommend that Jack Griffin be granted permission to construct, maintain and operate said drive-in gasoline filling station and to construct curbs, ramps, and sidewalks in conjunction therewith, subject to the following conditions: (1) That all buildings and equipment shall be placed inside of the property line, correct lines to be obtained before construction starts or equipment is installed. Lines and grades to be obtained from the Department of Public Works for entrances and driveways, building lines to be approved by the City Building Inspector. That the applicant shall confer with the Department of Public Works as to the future grades of the sidewalks and gutters on the adjacent streets before he starts any construction relative to the filling station. (2) That the gasoline tanks and pumps shall be of an approved type and shall bear the label of Underwriters Laboratories, Inc., that all construction of the filling station improvements shall be in accord with the Building Ordinance, the Zoning Ordinance, the Filling Station Ordinance, and in accord with the ordinance prohibiting the disposal of commercial water or oils upon the City streets. (3) That the grades of the station shall be such that no waste water or oils or any floor washings shall ever pass over the City sidewalk area and that all of said oils and water shall be concentrated into a combined grease and sand trap which shall be constructed in accordance with our standard plan 1368 CITY OF AUSTIN, TEXAS 1368 2-E-146 and shall be conducted by a pipe connection from said sand trap into a seep well located upon the property of the applicant. (4) That all filling station improvements, pumps, driveways, ramps, gutters, sidewalks, and curbs shall be constructed of concrete at the expense of the applicant as set forth upon the plan hereto attached, which plan bears the Director of Public Works file number 2-H-869. (5) Expansion joints shall be constructed as shown upon the plan hereto attached marked 2-H-869 and shall be of the pre-moulded type. (6) That before use of said station, the owner shall apply to the Building Inspector for final inspection when he considers that he has complied with all the requirements of the City. Which motion, carrying with it the adoption of the resolution, carried by the following vote: Ayes: Councilmen Glass, Johnson, Mayor Miller, Councilman Thornberry Noes: None Absent: Councilman Bartholomew Ben W. Greig, President and General Manager, and Ed Clark, Attorney, for the Austin Transit, Inc., came before the Council and asked that a special meeting of the City Council be called to hear the representatives of said Austin Transit, Inc., on their application for an increase in the bus fares. It was the sense of the City Council that said meeting be called for Tuesday, June 24, at 8:00 P. M., and that the press, the radio, and the public be invited to attend. The following memorandum was submitted by the City Manager: Memorandum to ; Guiton Morgan, City Manager "June 19, 1947. Memorandum from: J. E. Motheral, Director of Public Works. The final subdivision plat of Northvale, Section 1, has been completed and was approved by the Planning Commission on May 29, 1947. The subdivider has deposited $1800.00 to cover installation of sewers and water. Storm sewer and street costs are estimated at $3975.00, leaving an uncovered balance of $2175.00. The subdivider insists that the plan be presented to the City Council but funds have not been deposited to cover these costs and we are unable to recommend formal acceptance of the plat by the City Council. CITY OF AUSTIN, TEXAS 1369 Arrangements have been made for extension of gas mains, and sanitary sewers are not available. # The Director of Public Works reported that the subdivider has since complied with all requirements of the City with reference to the filing of plats, and recommended that said plat be formally accepted. Thereupon Councilman Thornberry offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That the final plat of the subdivision known as "Northvale, Section 1" approved by the City Plan Commission of the City of Austin on May 29, 1947, be and the same is hereby accepted and authorized to be filed of record in the office of the County Clerk of Travis County, Texas, in accordance with the provisions of the laws of the State of Texas and the ordinances of the City of Austin, and that this action of the City Council be indicated by appropriate notation, signed by the Mayor, on the original plat of said subdivision prior to its recording in the Plat Records of Travis County, Texas. Which motion, carrying with it the adoption of the resolution, carried by the following vote: Ayes : Councilmen Glass, Johnson, Mayor Miller, Councilman Thornberry Noes: None Absent: Councilman Bartholomew The application of Lester Lang for a change in zoning, from "A" Residence District to "D" Industrial District, of property located at 909 Cherico Street, being one acre out of Outlot 39, Division "A", was received. Councilman Johnson moved that the application be referred to the Board of Adjustment for consideration and recommendation. The motion carried by the following vo te: Ayes: Councilmen Glass, Johnson, Mayor Miller, Councilman Thornberry Noes: None Absent: Councilman Bartholomew Mr. O. Ashley, 1012 West 32nd Street, came before the City Council to find out why the construction of Lamar Boulevard was not being completed, and requested particularly that the City proceed at this time with the construction of said Boulevard in the area of West 32nd and San Gabriel Streets in order to alleviate the dust, traffic congestion, and unsightly condition resulting from partly-demolished houses. He was advised that it was not the purpose of the City to abandon the construction of said Boulevard; that there was an appropriation in this year's budget to buy the rest of the right-of-way and that same will be bought this year, but that the paving of said Boulevard could not be done this year. Action of the Board : Change not recommended For the following reasons: 1. This application is for a change in the Use designation of the tract of land to permit its sale for commercial purposes, either to the Pepsicola people or for the construction of a future community center, but not for any immediate development by the applicant. 2. There is a commercial zone now on both sides of Manor Road which extends from East Avenue to Chestnut Avenue, and if the property in question is zoned for "C" Commercial uses there will be a skip of one block between the existing business zone and the new zone, thereby creating a Community Center on the property now proposed to be zoned in which a bottling works would not be permitted since this use is only permitted in a commercial district which measures more than 900 feet, including streets and alleys, or an industrial district. In addition to the intervening Residence "A" block there is also a small triangular strip between the east line of Maple Avenue and the above tract fronting 37 feet on Manor Road and extending back 1372 CITY OF AUSTIN, TEXAS 1372 approximately 300 feet which would have no value for residence purposes since there would not be a sufficient build- able area for a residence. 3. The original zoning map of the City of Austin shows this property to be in a "C" Commercial District and the revised maps show all the property from Chestnut Avenue east to the railroad to be in an "A" Residence District. An inspection of the site discloses the fact that there are now a number of residences existing in the immediate vicinity of this property. 4. A number of the property owners living in this vicinity and owning property in this area protest this change and plead for the preservation of the residential character of this neighborhood. 5. A request for a change of zoning on property to the east of this location was made in 1938 but was not recommended by the Board or approved by the City Council after protest from adja cent property owners. 6. The majority of property along Manor Road now zoned for commercial uses is undeveloped for that purpose at this time and provides ample space for business expansion necessary to serve the needs of this area. 7. When the new Houston highway is completed connecting with the Airport Boulevard north of the City, traffic on Manor Road will be much less than at present, thereby lessening the need. for additional commercial development but enhancing the desir ability for residential development along this road. Moore and Frank Reeder for a change in the zoning of property located at the 1373 CITY OF AUSTIN, TEXAS 1373 northeast corner of East Ist and Tillery Streets, having a frontage of 150 feet on East Ist Street and 167 feet on Tillery Street, as shown on the attached plat, the Board wishes to call your attention to the fact that the Board has previously recommended to the City Council that the property in this part of the City be zoned as an industrial district to accommodate the growing demand for industrial property at reasonable prices, and deems that this area will eventually all be developed for industrial purposes as it is the most logical section of the City for such expansion and is so designated on the master plan of the City. The property proposed to be changed at this time is included in this area and the Board is, therefore, recommending to the City Council that the change from "C" Commercial District to "D" Industrial District be made. G. Garrett for the change of zoning on property located at the northeast corner of East 32nd and Red River Streets, the Board begs to call your attention to the resolution passed by the Board on July 23, 1946, on which date a hearing was held on the original application for the change. Copies of this resolution have been sent to each member of the City Council and the City Manager, and the Board requests careful consideration of the resolution before a disposition is made with reference to this zoning change. Kellum, Attorney, for permission to operate a doctor's office and clinic for human beings only, on Lot 1, Block 52, Division E, of the City of Austin, Travis County, Texas, the same being on the east side of Brazos Street, and locally known as 1709-1711 Brazos Street, and is located in a "B" Residence District, which requires a special permit from the City Council; and WHEREAS, this application has been considered and approved by the City Council of the City of Austin; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT permission for the operation and maintenance of a doctor's office and clinic for human beings only be granted to E. J. Hofheinz with the following conditionss 1. That this clinic be used in the general practice of medicine, and that no mental or psychiatric patients be houses in such clinic. 2. That all setback regulations required in this zone and all Building Code provisions be complied with in the operation and maintenance of such building. Which motion, carrying with it the adoption of the resolution, carried by the following vote: Ayes: Councilmen Glass, Johnson, Mayor Miller, Councilman Thornberry Noes: None ion: Absent: Councilman Bartholomew Councilman Johnson offered the following resolution and moved its adopt(RESOLUTION) 1375 CITY OF AUSTIN, TEXAS 1375 WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in ROBINSON AVENUE from a point 239 feet north of Edgewood Avenue southerly 200 feet, the centerline of which gas main shall be 13.5 feet west of and parallel to the east property line of said Robinson Avenue. Said gas main described above shall have a cover of not less than 2 feet. (2) A gas main in WILSON STREET from West Oltorf Street southerly 380 feet, the centerline of which gas main shall be 13.5 feet west of and parallel to the east property line of said Wilson Street. Said gas main described above shall have a cover of not less than 2 feet. (3) A gas main in LAFAYETTE AVENUE from East 382 Street southerly 118 feet, the centerline of which gas main shall be 12.5 feet west of and parallel to the east property line of Lafayette Avenue. Said gas main described above shall have a cover of not less than 2 feet. (4) A gas main in East 385 Street from Lafayette Avenue easterly 195 feet, the centerline of which gas main shall be 7.5 feet south of and parallel to the north property line of said East 38 Street. Said gas main described above shall have a cover of not less than 2 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the Department of Public Works not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. And that whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. 1376 CITY OF AUSTIN, TEXAS 1376 That the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Which motion, carrying with it the adoption of the resolution, carried by the following vote: Ayes: Councilmen Glass, Johnson, Mayor Miller, Councilman Thornberry Noes: None Absent: Councilman Bartholomew City Manager Morgan submitted a report from C. G. Levander, Assistant City Engineer in charge of sanitary sewer maintenance and construction, showing that the approximate cost of constructing a sanitary sewer line on Summit Street from Inglewood to Taylor-Gaines Streets, a distance of 1575 feet. would be $2,000.00; and a report from the Water Department showing the approximate cost of constructing a 6" cast-iron water line on Summit Street from Manlove to Taylor-Gaines Streets, a distance of 2600 feet, to replace the 2" water line in place, would be $6,000.00. The City Manager was instructed to have this work done as soon as the pipe for same can be obtained, and to so advise Judge H. E. Wassell, one of the signers on the petition asking for these improvements, by letter to this effect. City Manager Morgan submitted the following tabulation of bids received for the construction of a concrete slab in front of the Club House at the Municipal Golf Course: "June 17, 1947 Memorandum to : Guiton Morgan, City Manager Memorandum from : J. E. Motheral, Director of Public Works Bids were received this morning for the construction of a concrete slab in front of the Club House at the Municipal Golf Course. They were as follows: John R. Andrews Earl Rogers Richard Schmidt - $807.92 $948.92 -$1,233.00 It is recommended that the contract be awarded to John R. Andrews, the low bidder. (Sgd) J. E. Motheral. " Councilman Glass moved that the City Manager be authorized and directed to accept the bid of John R. Andrews, in the amount of $807.92, and to enter into contract with him accordingly. The motion carried by the fol lowing vote: Ayes : Councilmen Glass, Johnson, Mayor Miller, Councilman Thornberry Noes : None Absent: Councilman Bartholomew 1377 CITY OF AUSTIN, TEXAS 1377 City Manager Morgan submitted the following tabulation of bids received for the construction of a fence around certain portions of Zilker Springs: Memorandum to : City Council "June 19, 1947 Bids were received for the construction of a fence around certain portions of Zilker Springs and the bids were as follows: John Broad Construction Company - W. H. Richardson Company Prade-Ferris Company Walter Tips Company - - - $1,955.00 2,085.58 - 2,088.00 - 2,141.41 It is recommended that the contract be made to the John Broad Construction Company, who is the lowest bidder, and who states that the approximate date of completion will be August 10. (Sgd) Guiton Morgan City Manager 11 Councilman Glass moved that the bid of the John Broad Construction Company, low bidder, in the amount of $1,955.00 be accepted, and the City Manager be authorized and directed to enter into contract with said John Broad Construction Company accordingly; and that he be further directed to have said fence set farther back than originally planned in order to afford more room for sun bathers. The motion carried by the following vote: Ayes: Councilmen Glass, Johnson, Mayor Miller, Councilman Thornberry Noes : None Absent: Councilman Bartholomew Councilman Johnson offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, in connection with the widening and extending of East 7th Street, the City of Austin acquired a part of Lot 1 in Block 1, Eden Acres, a subdivision of 10 acres in Outlot 18, Division "A", in the City of Austin, from Leola Price, a feme sole, by deed dated December 21, 1946, of record in Volume 838, Page 143, of the Deed Records of Travis County, Texas; and WHEREAS, the City of Austin has, in connection with the same project, acquired 1,697 square feet of land, same being a portion of the east 72.67 feet of Lot 1, Block 1, Eden Acres, a subdivision of a portion of Outlot 18, Division "A", from Fred C. Lancaster and wife, Lillian C. Lancaster, by deed dated June 13, 1947; and WHEREAS, the City of Austin does not need a segment, comprising two thousand two hundred sixty-seven (2,267) square feet out of the west 130 feet 1378 CITY OF AUSTIN, TEXAS 1378 of Lot 1, Block 1, Eden Acres, acquired from Leola Price, a feme sole, and abutting the property of Fred C. Lancaster and wife, Lillian C. Lancaster, not sold to the City of Austin; and WHEREAS, the said Fred C. Lancaster and wife, Lillian C. Lancaster, desire to acquire the 2,267 square feet of excess from the west 130 feet of Lot 1, Block 1, Eden Acres, and it is deemed advisable to convey said prop erty to Fred C. Lancaster and wife, Lillian C. Lancaster as part of the transaction by which a portion of the east 72.67 feet of Lot 1, Block 1, Eden Acres, is being acquired from the said Fred C. Lancaster, two thousand two hundred sixty-seven (2,267) square feet of land, being a portion of the west 130 feet of Lot 1, Block 1, Eden Acres, a subdivision of a portion of Outlot 18, Division "A" of the Government Outlots adjoining the Original City of Austin, Travis County, Texas, said 2,267 square feet of land being more particularly described by metes and bounds as follows: Beginning at an iron stake in the south line of Gonzales Street, same being the north line of Lot 1, and from which point of beginning the northeast corner of said Lot 1, as evidenced by an iron stake bears S. 66°53 E. 72.67 feet; Thence with the west line of the Fred C.
