Council Chamber, City Hall 1551 The meeting was called to order, with Mayor Miller presiding. Roll call Present: Councilmen Glass, Johnson, Mayor Miller, and Councilman Thornberry 4 Absent : Councilman Bartholomew 1 Present also: Guiton Morgan, City Manager; Trueman E. O'Quinn, City Attorney; J. E. Motheral, Director of Public Works; and R. D. Thorp, Chief of Police. The reading of the Minutes was dispensed with. An appeal by R. C. Wilson, Attorney for Tom S. Castillo, on his client's application for a wine and beer dealer's permit for the premises known as E. G. BAR, 317 East 6th Street, recommended for denial, was heard. After considering the facts in the case, it was moved by Councilman Glass that the permit be granted. The motion carried by the following vote: Ayes: Councilmen Glass, Johnson, Mayor Miller, and Councilman Thornberry Noes: None Absent: Councilman Bartholomew Hardy Hollers, Attorney for Mrs. Bessie Menem, came before the Council and asked for a rehearing on his client's application for a change in zoning of property at 509 Pedernales Street, being Lot 6, Morseland Place, Outlot 11, Division "A", from "E" Heavy Industrial District to "C1" Commercial District, and being the same property on which the City Council on June 12, 1947, voted to sustain the action of the Board of Adjustment and deny a like change; and in support of his petition, alleged there were circumstances in the case which would justify the reopening of the matter. The matter was referred to the City Attorney for legal opinion. Arthur DeWitty, Colored, came before the Council and submitted a written memorandum from the National Association for the Advancement of Colored People, 155 CITY OF AUSTIN, TEXAS 1552 charging racial discrimination against Negroes at Brackenridge Hospital and inadequate emergency service, and asking for the removal of Leonard Bulomewitz from its emergency staff. Protestant further charged racial discrimination and inadequate treatment in the case of a Negro mạn who was fatally wounded in an affray in the 1600 block of Rosewood Avenue. Both matters were referred to the City Manager for investigation. The application of M. H. Crockett for a change in zoning, from "A" Residence District to "C" Commercial District, of property located on the proposed Lamar Boulevard, being the west 83 feet of Lots 1 and 2, and the north 34 feet of the west 83 feet of Lot 3, of Hill View Addition, a subdivision of Outlot 76, Division "D", was received. Councilman Glass moved that the matter be referred to the Board of Adjustment for consideration and recommendation. The appellant's property consists of 1 lot and a portion of another lot left after the right-of-way was obtained for Airport Boulevard, and there is now a residence on this property fronting on 49th Street. Since all of the lots are laid out parallel to the Boulevard, therefore, it is questionable whether there is suitable space behind the present dwelling for a commercial business setting back 25 feet from the boulevard property line. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the Department of Public Works not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. And that whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. That the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. That the work and construction of said underground conduits, including the excavation of the streets and the restoration and maintenance of said streets after said underground conduits have been constructed, shall be under the supervision and direction of the City Manager and in accordance with the ordinances and regulations of the City of Austin governing such construction.
