1586 CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting September 11,1947 10:45 A.M. Council Chamber, City Hall The meeting was called to order, with Mayor Miller presiding. Roll call Present: Councilmen Bartholomew, Glass, Johnson, Mayor Miller Absent: Councilman Thornberry - 1 4 Present also: Guiton Morgan, City Manager; J. E. Motheral, Director of Public Works; Trueman E. O'Quinn, City Attorney; and R. D. Thorp, Chief of Police. The reading of the Minutes was dispensed with. A. W. Penn and Stuart Watt came before the Council on behalf of the Parent-Teacher Association of Wooldridge School and asked that Seton Avenue from 24th to 25th Streets be made a one-way street north during the school term in order to lessen the traffic hazard to children attending said School. The matter was referred to the City Manager to have the Traffic and Engineering Departments make a report on same for the next regular meeting. Councilman Bartholomew offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That Guiton Morgan, City Manager, be and he is hereby authorized and directed in behalf of the City of Austin to accept an easement of rightof-way from the Texas and New Orleans Railroad Company in consideration of the payment by the City of Austin of Two Thousand Dollars ($2000.00) for a crossing of East 7th Street at, on and near the present crossing of Morelos Street and Northwestern Avenue on the Llano Branch of the H&TC Railroad; grantor of the easement will agree at its own expense to lower the grade of its existing track upon and across the property conveyed, 2.3 feet to meet the grade of the proposed street, and 2.3 feet below the top of the west rail, and the super elevation will be taken out of the CITY OF AUSTIN, TEXAS 1587 track at the point of corssing, leaving the top of rail the same elevation on each side. ) Which motion, carrying with it the adoption of the resolution, carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Mayor Miller Noes: None Absent: Councilman Thornberry Councilman Johnson offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, a municipal corporation of the State of Texas: THAT Guiton Morgan, said corporation's City Manager, be and he is hereby duly authorized and fully empowered to enter into and execute, for and in the name of said corporation, one certain written agreement, dated August 21, 1947, between said corporation and Guy A. Thompson, Trustee, International-Great Northern Railroad Company, herein called Carrier, respecting among certain things the construction, ownership, maintenance and use of one certain two-inch water line crossing Carrier's Premises at Engineer's Chaining Station 9264/02 near Camp Mabry, Travis County, Texas, all as more particularly set out in said agreement, to which reference is made the same as if fully set out herein. G. Rogers for change in zoning, from "A" Residence District to "C" Commercial District of Lots 66 and 67, Block U, Harmon Terrace, Ridgetop, located at the northeast corner of 49th Street and Airport Boulevard, called for this day, was not held due to Applicant's withdrawal of the application. Pursuant to published notice thereof, the public hearing on the application of Chas. J. Armstrong and O. Cage for change in zoning to-wit: To amend the USE designation of the following described property so as to change the same from "A" Residence District to " Commercial District, as follows: West two-thirds of Lots 9, 10, and 11, Block 5, Penn Addition; Lots 6, 7, and 8, and south 5 feet of Lot 5, Hillview Addition, being located at southeast and northeast corners of Lamar Boulevard and West 34th Street in the City of Austin, Travis County, Texas, was duly opened. Mr. O. Cage stated in support of his application that the change in zoning was desired to permit the erection of a filling station on the property. CITY OF AUSTIN, TEXAS 1590 Mr. James Shaw objected to the change, stating that he saw no reason for a filling station or any other business there at this time, and asked that the matter be postponed for a while in order to look into it further. Mr. Chas. J. Armstrong stated that he would object to his corner not being changed if Mr. Cage's property were changed, as his lot is a short lot by reason of the City's having taken part of it for a right-of-way, and therefore is only suitable for commercial use. Messrs. M. O. Speir, Travis Woodland, James Shaw, and Miss Afton Wynn, property owners within two hundred feet of the proposed change, stated that they would not object to the change if their property were included also. : Thereupon Councilman Glass moved that action on the matter be postponed for thirty days in order to give the surrounding property owners an opportunity to file their applications for change in zoning of their property. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Mayor Miller; Absent: Councilman Thornberry Noes : None Pursuant to published notice thereof, the public hearing on the application of Bascom Giles to amend the Zoning Ordinance in the following particular: To amend the USE designation of the following described property so as to change the same from "A" Residence District to "C" Commercial District, to-wit: One and one-half (1) acres located at the southwest corner of Airport Boulevard and Manor Road, and being out of Block A of Pannell Place; in the City of Austin Travis County, Texas; and To amend the USE designation of the following described property so as to change the same from "A" Residence District to "D" Industrial District, to-wit: Seven (7) acres of land bounded on the north by Manor Road, on the east by Pannell Place, on the south by East 19th Street, and on the west by H&TC Railroad tracks, in the City of Austin, Travis County, Texas, was duly opened. No property owner or other interested person appeared to protest the proposed change. Thereupon Councilman Bartholomew moved that the hearing be closed and the action of the Board of Adjustment be sustained and the change be granted; and further, that the City Attorney be instructed to prepare the ordinance making the change effective. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Mayor Miller Noes: None Absent: Councilman Thornberry CITY OF AUSTIN, TEXAS 1591 Pursuant to published notice thereof, the public hearing on the application of Edward Joseph and Mrs. Wilhelmine B. Sheffield to amend the Zoning Ordinance in the following particulars: To amend the USE designation of the following described property so as to change the same from "A" Residence District and First Height and Area District to "C-1" Commercial District and Second Height and Area District, to-wit: The west 16 feet of the property now zoned "A" Residence District in Block 6, Buddington Subdivision of part of Outlot 77, Division "D", in the City of Austin, Travis County, Texas; and To amend the USE designation of the following described property so as to change the same from "A" Residence District to "B-1" Residence District, and from First Height and Area District to Second Height and Area District, to-wit: All of the property now zoned "A" Residence District in Block 6, Buddington Subdivision of part of Outlot 77, Division "D", in the City of Austin, Travis County, Texas, with the exception of the west 16 feet of such "A" Residence District zone, was duly opened. C. F. Herring, Attorney for Edward Joseph, plead for the change of the 16 feet to "C-1" Commercial on the grounds that the first half of his client's property is already zoned "C-1" Commercialand he wants to build a community center using the front on Guadalupe Street for shops and the rear for a warehouse; and for the remainder of the property to "B-1" Residence in order to construct some kind of multiple dwelling; otherwise the property cannot be used. The following property owners appeared and protested the proposed change of the west 16 feet to"0-1" Commercial District: H. Grady Chandler presented a petition signed by himself and twelve other property owners within 200 feet of the proposed change, and verbally protested the change on the grounds that there is already sufficient com mercial property on the north side of 34th Street; that it is all residential property back of that; that many apartments have been built facing 34th Street, which would make it undesirable for business property to be built on 34th Street; that there is no necessity for the change; that the Proponent stated to him that he intended to build a theatre there and if he does so, it will increase the traffic hazard, 34th and Guadalupe Streets being the most dangerous corner in the City of Austin from a traffic standpoint;; that it destroys the value of residential property when commercial property begins to encroach upon it; that Proponent had no right to encroach 16 feet on residence property when he started construction of his building; and further, that the property owners do not object to the proposed change to "B-1", but do opposed the change to "C-1." Commercial. Dr. F. L. Charlton, O. N. Bruck, and J. S. Woodard also opposed the change to "0-1" Commercial and to a theatre there, declaring that same CITY OF AUSTIN, TEXAS 1592 would be detrimental to the value of their property as residential and that they bought property there thinking it would remain residential; that it was spot zoning which would save Mr. Joseph six thousand dollars and damage a half million dollars worth of residential property. , Mr. Joseph, proponent, stated that his plans had been changed and he did not contemplate erecting a theatre on the property. No other property owners or interested persons desiring to be heard, Councilman Johnson moved that the hearing be closed and the action of the Board of Adjustment be sustained and the change be granted; and the City Attorney be instructed to prepare the ordinance making the change effective. W. Sternenberg to amend the Zoning Ordinance in the following particular: To amend the USE designation of the following described prop erty so as to change the same from "B" Residence District to "C" Commercial District, to-wit: The south 60 feet of Lot 10 and the south 60 feet of a triangular tract east, of and adjoining said Lot 10, Block 1, Grooms Addition, being located on the west side of Duval Street north of the alley between East 30th Street and East 31st Street, in the City of Austin, Travis County, Texas, was duly opened. F. W. Sternenberg, proponent, plead for the change on the grounds that the property is not suitable for anything but commercial use. The following property owners appeared and protested the change: Seventh Day Adventist Church opposed the change because of what might be built there that would be detrimental to their parochial school; Mrs. Nellie T. Evans opposed the change on account of additional traffic which would be created by a business there; J. C. Lynch and Robert Coltharp opposed the change on account of the further encroachment of business, which should stop at the alley. No other property owners or interested persons desiring to be heard, Councilman Glass moved that the hearing be closed and the action of the Board of Adjustment be sustained and the change be not granted. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Mayor Miller; Noes: None Absent: Councilman Thornberry CITY OF AUSTIN, TEXAS 1593 Pursuant to published notice thereof, the public hearing on the application of G. W. Cage to amend the Zoning Ordinance in the following particular: To amend the USE designation of the following described prop erty so as to change the same from "B" Residence District to "C" Commercial District, to-wit: That portion of the following described property which is now zoned "B" Residence District: 1.42 acres out of the Isaac Decker League Survey No.20, being located on the east side of South Congress Avenue in the 900 block, in the City of Austin, Travis County, Texas, was duly opened. No property owner or other interested person appeared to protest the proposed change. Thereupon Councilman Glass moved that the hearing be closed and the action of the Board of Adjustment be sustained and the change be granted, and the City Attorney be directed to prepare the ordinance making same effective. No property owner or other interested person appeared to protest the proposed change. Thereupon Mayor Miller moved that the action of the Board of Adjustment be not sustained, and the change be granted; and the City Attorney be instructed to prepare the ordinance making the change effective. Property affected: Lots 5 and 6, Block B, Statesman Property, being located on the west side of Duval Street south of East 43rd Street. III. To be changed From : "B" Residence District IV. V. VI. To : "C" Commercial District Considered by the Board on: September 9, 1947 Parties appearing: For : Joe A. Wukasch and Earl Wukasch Against: Mr. and Mrs. A. B. Craddock, D. F. Douglas, W.C.Rivers, Miss Eula Payton, Elmer V. McNeese, W. G. Clarkson, Mrs. Ella Jessen, Wallace Leonard, E. M. Oates, and George R. Haberlin, and letters from Miss Johanna Hughes, Mr. and Mrs. B. H. McGuire, Sr., Mrs. J.B.Rutland, and Mrs. A. Otting. Action of the Board: Change not recommended. For the following reasons: 1. The applicant affirms that he is requesting the extension of the present commercial zone at the southwest corner of East 43rd and Duval Streets to include the remainder of his property consisting of two 25-foot lots for the purpose of erecting an electric shop and possibly a restaurant, and further affirms that he now has two vacant lots in the commercial zone but that the proposed extension would permit him to erect a 100-foot building on the property. 2. The present commercial district at this intersection was created by the City Council to provide a community center to serve the needs of the neighborhood since that portion on the north side of 43rd Street was developed with commercial uses prior to the passage of the Zoning Ordinance, and CITY OF AUSTIN, TEXAS 1595 all of the present commercial area has been developed for various types of community services, all of which front on East 43rd Street, which thus becomes the principal business street. 3. Strenuous opposition was expressed by property owners in this area to the extension of the present zone on the grounds that they had purchased and developed their property for residential purposes and that the additional commercial district would adversely affect their peace and comfort and would decrease the value of their property and increase the traffic hazards at a location where there is already a heavy flow of traffic on both streets; and on the further grounds that there is sufficient commercial property in the present Community Center to serve the needs of the neighborhood, and that the application is not in response to any public demand or necessity. 4. The Board deemed that the extension of the present Community Center along Duval Street should not be made on the grounds that Duval Street is now carrying a heavy load of traffic which would be increased by additional business and that customers leaving and entering the flow of traffic would cause further congestion, and that in view of the opposition expressed by property owners in the neighborhood there is already a sufficient area designated as a Community Center to serve the needs of the vicinity, and further deemed that the present designation of the applicant's two lots as "B" Residence would permit the erection of an apartment house or other uses permitted in this district to serve as a transitional use between the adjacent residential development and the possible commercial development on the two vacant lots in the Community Center. 5. The Board further deemed that Duval Street, owing to its residential character and high traffic flow, should not be changed to a commercial street by fronting business thereon. (Sgd) H. F. Kuehne Chairman. Councilman Glass moved that a public hearing on the foregoing application of Joe A. Wukasch for change in zoning be called for Thursday, October 2, 1947, at 11:00 A. M. Trenckmann, Attorney for property owners, for change in zoning, from "B" to "C", of the south one-half of Blocks 172 and 173 of Original City, the same fronting south on East 14th Street, extending from Brazos Street west to Colorado Street, was received. Councilman Glass moved that the matter be referred to the Board of Adjustment for consideration and recommendation. Mueller and C. R.
