1667 CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting October 09, 1947 10:35 Α.Μ. Council Chamber, City Hall The meeting was called to order with Mayor Miller presiding. Roll call Present: Councilmen Bartholomew, Glass, Johnson, Mayor Miller, and Councilman Thornberry - 5 Absent : None Present also: Guiton Morgan, City Manager; J. E. Motheral, Director of Public Works; Trueman E. O' Quinn, City Attorney; and R. D. Thorp, Chief of Police. The reading of the Minutes was dispensed with. Messrs. Fred W. Catterall, Jr., and Gordon E. Mills, on behalf of the Walker's Austex Chili Company, extended an invitation to the City Council and City Manager to visit their plant during their celebration, and that the Mayor issue a proclamation proclaiming the week of October 13-17 as WALKER'S AUSTEX CHILI WEEK. The request was granted. Mr. E. E. Dubuque and Mrs. Guy Bell came before the Council and submitted a petition by residents and property owners on Pressler Street asking (1) that Pressler Street be opened, widened, and graded from its intersection with West Sixth Street northerly to its intersection with West Ninth Street; (2) that a storm sewer along said street be provided to take care of flood water and prevent damage to the property owners; (3) that at least two street lights be placed on said street, one to be about the 700 block on said street, and the other at a point which the City deems the most convenient; and (4) that Pressler Street be opened and extended from its intersection with West Ninth Street northerly to connect with Maufrais Street at West Tenth Street. An estimate by the Director of Public Works, showing the cost of the storm sewer and what right-of-way would be needed was also submitted by the City Manager. The matter was taken under advisement by the City Council for an inspection on the ground. Messrs. Dacy, Gaston and Turner, a committee representing the Boy Scouts Council, submitted a request that the City sell them a piece CITY OF AUSTIN, TEXAS 1668 of ground it owns on Neches Street along Waller Creek, being 100'x150', for a site for a new building for the Boy Scouts. The matter was taken under advisement by the Council to determine if any part of said land will be needed for a right-of-way, and whether the City would want to sell it or give a long-term lease on it. Murray Ramsey and others, representing the North Austin Civic Club, submitted a lengthy petition signed by merchants, business men, property, owners, and residents of Rosedale, Shoalmont, and North Loop Additions, asking for a fire station in that section of the City. The matter was taken under advisement by the City Council for consideration, and the Mayor advised petitioners that the City intended to build a fire station north of 45th Street, the exact location of same not having been determined as yet, but that it was hoped to have the work under way by next spring. Councilman Glass offered the following resolution and moved its adoptions (RESOLUTION) WHEREAS, the War Department has presented to the City of Austin a plan for the formation of Reserve Service Units of the Army to be established and organized as reserve components of the Army, and certain men will be enrolled as members of the Army Reserve and will be equipped and periodically given training; and WHEREAS, the War Department has asked that certain of these units be organized in the Fire and Police Departments and in the Utility Departments of the City subject to the approval and consent of the City of Austin as to training in peace time; Therefore, BE IT RESOLVED BY THE CITY COUNCIL : THAT the City Manager be and is hereby authorized to enter into an agreement whereby certain men will be enrolled in the Army Reserve and organized into Reserve Army Service Units, and providing further THAT said agreement may be cancelled by the City of Austin or by the War Department on thirty days' notice and further providing THAT such operations will not interfere with the operation of any Department of the City in which such service units may be installed. Which motion, carrying with it the adoption of the resolution, carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Mayor Miller, and Councilman Thornberry Noes: None The application of Hugh Blocker for change in zoning, from "B" to "C" Commercial of property known as 200 East 262 Street, being the south forty-five feet of Lots 1 and 2, in Block 1, Outlot 10, Division "D", CITY OF AUSTIN, TEXAS 1669 Moore's Subdivision, was received. Councilman Johnson moved that the matter be referred to the Board of Adjustment for consideration and recommendation. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Mayor Miller, and Councilman Thornberry Noes: None The application of J. D. Brown for a change in zoning, from "A" Residence District to "3" Residence District of property known as 1911 Eva Street, was received. Councilman Johnson moved that the matter be referred to the Board of Adjustment for consideration and recommendation. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Mayor Miller, and Councilman Thornberry Noes: None Councilman Thornberry introduced the following ordinance: AN ORDINANCE AMENDING THAT CERTAIN ORDINANCE ENTITLED "AN ORDINANCE REGULATING TRAFFIC UPON THE PUBLIC STREETS OF THE CITY OF AUSTIN; PRESCRIBING PENALTIES FOR THE VIOLATION OF SAME; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY", WHICH ORDINANCE WAS PASSED BY THE CITY COUNCIL OF THE CITY OF AUSTIN ΜΑΥ 6, 1937, AND IS RECORDED IN BOOK "K", PAGES 159-179, INCLUSIVE, OF THE ORDINANCE RECORDS OF THE CITY OF AUSTIN, BY AMENDING SECTION 12 (b) OF ARTICLE III RELATING TO STOP SIGN LOCATIONS AND BY AMENDING SECTIONS 23(b) AND 23(d) OF ARTICLE IV RELATING RESPECTIVELY TO PASSENGER ZONE LOCATIONS AND LOADING ZONE LOCATIONS; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. The ordinance was read the first time and Councilman Thornberry moved that the rule be suspended and the ordinance be passed to its second reading. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Mayor Miller, and Councilman Thornberry Noes: None The ordinance was read the second time and Councilman Thornberry moved that the rule be further suspended and the ordinance be passed to its third reading. Councilman Bartholomew introduced the following ordinance: AN ORDINANCE AMENDING THAT CERTAIN ORDINANCE PASSED BY THE CITY COUNCIL OF THE CITY OF AUSTIN, TEXAS, JULY 17, 1941, AND RECORDED IN ORDINANCE BOOK "L", PAGES 152-174, INCLUSIVE, OF THE ORDINANCE RECORDS OF THE CITY OF AUSTIN, WHICH ORDINANCE WAS AMENDATORY OF THAT CERTAIN ORDINANCE ESTABLISHING ZONING REGULATIONS AND DISTRICTS IN ACCORDANCE WITH A COMPREHENSIVE PLAN PASSED BY THE CITY COUNCIL APRIL 23, 1931, AND RECORDED IN ORDINANCE BOOK "I", PAGES 301-318, INCLUSIVE, OF THE ORDINANCE RECORDS OF THE CITY OF AUSTIN, THE AMENDATORY ORDINANCE HEREBY CHANGING THE USE DESIGNATION FROM "B" RESIDENCE DISTRICT AND SECOND HEIGHT AND AREA DISTRICT TO "C" COMMERCIAL DISTRICT AND SECOND HEIGHT AND AREA DISTRICT ON CERTAIN LOTS OUT OF BLOCK 1, DUVAL ADDITION, IN THE CITY OF AUSTIN, TRAVIS COUNTY, TEXAS; ORDERING A CHANGE IN THE USE MAPS SO AS TO RECORD THE CHANGES HEREBY ORDERED, AND DECLARING AN EMERGENCY. CITY OF AUSTIN, TEXAS 1671 The application of C. L. Daniel, 311 West 38th Street, for a license to operate as a taxicab a 4-door Chevrolet Sedan, 1942 Model, Motor No. BA87010, State License No. JA-1131, duly approved by the City Manager, was submitted. Councilman Glass moved that the license be granted. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Mayor Miller, and Councilman Thornberry Noes: None The application of BENJAMIN TOM MORRISON, 112 Franklin Boulevard, for a taxicab driver's permit, duly approved by the City Manager, was submitted. Councilman Glass moved that the permit be granted. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Mayor Miller, and Councilman Thornberry Noes: None The application of DEEP TEXAS DISTRIBUTORS, by Edward E. Schoen, 1919 East 7th Street, for a General Distributor's Beer License, duly approved by the City Manager, was submitted. Councilman Bartholomew moved that the license be granted. The motion carried by the following vote: Aye's: Councilmen Bartholomew, Glass, Johnson, Mayor Miller, and Councilman Thornberry Noes: None The application of LA TAPATIA MEXICAN RESTAURANT, by Mrs. Joe Carlin, 1509 East 6th Street, for a Wine and Beer License, duly approved by the City Manager, was submitted. Councilman Bartholomew moved that the license be granted. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Mayor Miller, and Councilman Thornberry Noes: None The City Manager submitted a tabulation of bids received from Allis-Chalmers Company, Westinghouse Company, and General Electric Company for six 100 Ampere 7200 volt, 69 kva, regulators; and recommended that the bid of Allis-Chalmers Company, in the amount of $17,160.00, be accepted as the best bid on the basis of their 30-week delivery. Councilman Bartholomew moved that the recommendations of the City Manager be approved and he be authorized to accept the bid of the said AllisChalmers Company, in the amount of $17,160.00. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Mayor Miller, and Councilman Thornberry Noes: None Preparatory to a meeting with the City Plan Commission on the matter of extension of the city limits to include the Airport area, suggested by Councilman Glass, the City Manager and the Director of Public Works were instructed to have a map of said area prepared for study by the City Council.
