1844 CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Recessed Meeting December 24, 1947 10:30 Α.Μ. Council Chamber, City Hall 1844 The meeting was called to order, with Mayor Miller presiding. Roll call Present: Councilmen Bartholomew, Glass, Johnson, Mayor Miller, and Councilman Thornberry - 5 Absent : None Present also: Guiton Morgan, City Manager; Trueman E. O'Quinn, City Attorney. The Mayor called up for its third reading, the following ordinance: AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF AUSTIN AND THE ANNEXATION OF CERTAIN ADDITIONAL TERRITORY CONSISTING OF TEN AND TWELVE ONE HUND- REDTHS (10.12) ACRES OF LAND, BEING A PORTION OF THE ISAAC DECKER LEAGUE IN TRAVIS COUNTY, TEXAS, WHICH SAID ADDITIONAL TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF AUSTIN, IN THE PARTICULARS STATED IN THE ORDINANCE. The ordinance was read the third time and Councilman Thornberry moved that the ordinance be finally passed. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Mayor Miller, and Councilman Thornberry Noes: None The Mayor thereupon announced that the ordinance had been finally passed. The Mayor called up for its third reading, the following ordinance: 1845 CITY OF AUSTIN, TEXAS 1845 AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF AUSTIN AND THE ANNEXATION OF CERTAIN AD- DITIONAL TERRITORY CONSISTING OF 124.56 ACRES OF LAND, BEING A PORTION OF THE THOMAS HAWKINS SURVEY, THE THOMAS HARRELSON SURVEY, PORTIONS OF OUTLOTS 27 AND 50, DIVISION B, AND ALSO PORTIONS OF OUTLOTS 32, 34, AND 35, DIVISION C, OF THE GOVERNMENT OUTLOTS, ADJOINING THE ORIGINAL CITY OF AUSTIN, TEXAS, ALL OF WHICH LAND AND TERRITORY LIES ADJACENT TO AND ADJOINING THE PRESENT LIMITS OF THE CITY OF AUSTIN IN THE PARTICULARS STATED IN THE ORDINANCE. The ordinance was read the third time and Councilman Johnson moved that the ordinance be finally passed. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Mayor Miller, and Councilman Thornberry Noes: None Thereupon Mayor Miller announced that the ordinance had been finally passed. Councilman Bartholomew moved that, upon the recommendation of the Chief of Police, the taxicab driver's permit issued to NOLAN FLOYD PAENITZ, 4528 Avenue H be revoked. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Mayor Miller, and Councilman Thornberry Noes: None Councilman Glass offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Tom Miller, Mayor, be and he is hereby authorized and directed, in behalf of the City of Austin, to enter into an agreement with N.J.FERRIS for the sale by the City of Austin to the said N. J. Ferris of approximately 250 feet by 314 feet of land out of the Butler Tract on Lamar Boulevard, for a cash consideration of $48,000.00, said agreement to be substantially in the following terms: MEMORANDUM OF AGREEMENT MADE this 24th day of December, 1947, by and between the City of Austin, referred to as "Seller, and N. J. Ferris, referred to as "Purchaser". The City of Austin hereby agrees to sell, and N. J. Ferris hereby agrees to purchase, for the sum of $48,000.00 cash, a tract of land fronting 250 feet on the west side of Lamar Boulevard south of the Colorado River, being approximately 314 feet deep on the north side and 357 feet deep on the south side. 1846 CITY OF AUSTIN, TEXAS 1846 The City of Austin agrees to furnish a good merchantable title and hereby acknowledges receipt of the check in the amount of $5,000.00 as a payment by the Purchaser to bind this sale, and said sale shall be consummated within thirty days from this date, and the remaining $43,000.00 shall be paid to the City of Austin in cash at the time deed to the property is made by the Seller. Taxes shall be pro rated as of the date of sale. The City Council in a scheduled meeting in the City Hall has authorized and this agreement is executed by both parties hereto. Which motion, carrying with it the adoption of the resolution, carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Mayor Miller, and Councilman Thornberry Noes: None There being no further business, Councilman Bartholomew moved that the meeting be recessed to January 8, 1948. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Mayor Miller, and Councilman Thornberry Noes: None The meeting was then recessed.
