Council Chamber, City Hall 77 97 The meeting was called to order, with Mayor Miller presiding. Roll call Present: Councilmen Glass, Johnson, Mayor Miller, Councilman Thornberry Absent : Councilman Bartholomew Present also: Guiton Morgan, City Manager; Trueman E. O'Quinn, City Attorney; J. E. Motheral, Director of Public Works; and R. D. Thorp, Chief of Police. The reading of the Minutes was dispensed with. Dr. Wm. J. Battle came before the Council and complained of a hazard to pedestrians caused by overhanging limbs of trees and shrubs over the sidewalks in the City, and asked that same be remedied. He was advised to furnish a list of such places and the matter would be attended to. A committee from the local Restaurants Association, composed of Calvin Westbrook, President, and others, came before the Council and indorsed the proposed ordinance regulating restaurants, declaring that it would benefit the restaurant owners and the citizens of Austin as a whole. Lyons to amend the Zoning Ordinance in the following particular : To amend the USE designation of the following described property so as to change the same from "A" Residence District to #C# Commercial District, to-wit: Lot 9, Block B, Ridgetop Addition, in the City of Austin, Travis County, Texas, was duly opened. No property owner or other interested citizen appeared to protest the change. Judge Ben H. Powell appeared on behalf of the proponent and spoke in favor of the change. Thereupon Councilman Glass moved that the hearing be closed and the action of the Board of Adjustment be not sustained and the change be granted, and the City Attorney be instructed to prepare the ordinance making same effective, for passage at the next regular meeting. G. Linscomb, by David J. Pickle, attorney, to amend the Zoning Ordinance in the following particular: To amend the USE designation of the following described property so as to change the same from "A" Residence District to "D Industrial District, to-wit: A tract of land 450x370 located north of Lyons Road between Cherico and Gunter Streets and south of Neal Street, in the City of Austin, Travis County, Texas, was duly opened. The following appeared and spoke in favor of the change, substantially as follows: H. G. Linscomb, proponent; and Judge David J. Pickle, attorney, plead for the change on the grounds that it is an extension of a D Industrial Zone; that it is contemplated that the Railroad Company will construct a spur line which will go through the middle of proponent's property; and that proponent proposes to put in a 50-foot street, running north and south, so that the buildings to the west would have a street between him and any buildings that may be built. The following appeared and spoke in opposition to the change, substantially as follows: Mrs. L. E. McEachern, 1101 Cherico Street; Mrs. Ralph Robbins, 1011 Cherico Street; Mrs. A. J. Bartlett, 1100 Cherico Street; and Mrs.A. Daugherty, 3403 Neal Street, opposed the change on the grounds that they built their homes there because it was a residential district and that they wished to preserve it as such; that the proposed change would greatly lessen the value of their property as residential. All property owners or other interested persons having been given an opportunity to be heard, Councilman Thornberry moved that action on the matter be postponed for an inspection of the property. P. CITY OF AUSTIN, TEXAS 100 100 The following appeared and spoke in favor of the change, substantially as follows: Henry L. P. Phillips, proponent, plead for the change on the grounds that there is a great demand for housing for University students and that he wants to convert three houses that he bought from the University into living quarters for students. Morris Gerhardt, proponent, plead for the change on the grounds that he wants to build an addition to his place to house the families of his married children. The following appeared and spoke in opposition to the change, substantially as follows: Frank D. Quinn, who also represented a number of other property owners in the neighborhood, opposed the change on the grounds that when an application for rezoning of this property was before the City Council several months ago, proponent opposed the change then, but that now that he sees an opportunity to make money, he is asking for it; that when proponent moved the three houses there he stated that they would be for private residences; that, with the exception of the fraternity house at 28th and Rio Grande Streets, which was there before zoning was inaugurated, the whole area is residential "A"; that as modest homeowners they do not think their zone should be changed, at least not until the time comes to change the whole picture and that time is not here, and asked that the Council postpone any change until conditions warrant changing the area from 28th to 29th and Rio Grande Street to Shoal Creek. Mrs. Kay Miller, representing her mother, Mrs, J. W. Calhoun, asked that the zoning be not change until there is a real need for same; and further declared that the proposed change would increase traffic on Rio Grande Street thereby creating additional hazards on this narrow street. Mrs. E. A. Blackburn and other property owners also protested the change. All property owners or other interested citizens having been given an opportunity to be heard, Councilman Johnson moved that action on the matter be deferred for an inspection of the property. Thereupon Mayor Miller announced that the ordinance had been finally Councilman Glass offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Council of the City of Austin hereby approves as a filling station site the property located on the northeast intersection of Gunter Street and East 7th Street Extension, which property fronts 33.89 feet on Gunter Street and 134.74 feet on East 7th Street Extension, and is known as the unplatted portion of Outlot 17, Division "A" of the Government Outlots adjoining the Original City of Austin, Travis County, Texas, and hereby authorizes the said M. H. Helford to construct, maintain, and operate a drive-in gasoline filling station and to construct curbs, ramps, and sidewalks in conjunction therewith, subject to the same's being constructed in compliance with all the ordinances relating thereto, and further subject to the foregoing attached recommendations and plans; and the Building Inspector is hereby authorized to issue an occupancy permit for the operation of this filling station after full compliance with all the provisions of this resolution, and said permission shall be held to be granted and accepted subject to all necessary, reasonable, and proper, present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of the proper police, traffic and fire regulations, and the right of revocation is retained if, after hearing, it is found by the City Council that the said M. H. Helford has failed and refused, and will continue to fail and refuse to perform any such conditions, regulations and ordinances. (Recommendations attached) Mr. Guiton Morgan City Manager Austin, Texas Dear Sir: "Austin, Texas February 12, 1948 We, the undersigned, have considered the application of M.H.Helford for permission to construct, maintain and operate a drive-in gasoline 109 CITY OF AUSTIN, TEXAS 103 filling station and to construct commercial driveways in conjunction therewith, upon property located on the northeast intersection of Gunter Street and East 7th Street Extension, which property fronts 33.89 feet on Gunter Street and 134.74 feet on East 7th Street Extension and is known as the unplatted portion of Outlot 17, Division "A" of the Government Outlots adjoining the Original City of Austin, Travis County, Texas, and the property upon which this filling station is to be located is owned by M. H. Helford, and we hereby advise the following conditions exist: The property upon which this filling station is to be located is designated as cf Commercial Use District upon the zoning maps of the City of Austin. A storm sewer inlet exists on the north side of East 7th Street Extension east of Gunter Street and a storm sewer main exists on the north side of East 7th Street Extension adjacent to the above described property. We recommend that M. H. Helford be granted permission to construct, maintain and operate said drive-in filling station and to construct curbs, ramps and sidewalks in conjunction therewith, subject to the following conditions: (1) That all buildings and equipment shall be placed inside of the property line, correct lines to be obtained before construction starts or equipment is installed. Lines and grades to be obtained from the Department of Public Works for entrances and driveways, builting lines to be approved by the City Building Inspector. That the applicant shall confer with the Department of Public Works as to the future grades of the sidewalks and gutters on the adjacent streets before he starts any construction relative to the filling station. (2) That only underground tanks shall be used and that all pumps shall be so located that it will be impracticable to service motor vehicles therefrom while said motor vehicles are standing on any part of a sidewalk, street, or alley. (3) That the gasoline tanks and pumps shall be an approved type and shall bear the label of Underwriters Laboratories, Inc., that all construction of the filling station improvements shall be in accord with the Building Ordinance, the Zoning Ordinance, the Filling Station Ordinance, and in accord with the ordinance prohibiting the disposal of com- mercial water or oils upon the City streets. (4) That the grades of the station shall be such that no waste water or oils or any floor washings shall ever pass over the City sidewalk area and that all of said oils and water shall be concentrated into a combined grease and sand trap, which shall be constructed in accordance with our standard plan 2-H-146, and shall be conducted by a pipe connection from said sand trap to the nearest storm sewer. (5) That all filling station improvements, pump islands, driveways, ramps, gutters, sidewalks, and curbs shall be constructed of concrete at the expense of the applicant as set forth upon the plan hereto attached, which plan bears the Department of Public Works file number 2-H-892. Said gas main described above shall have a cover of notless than 2 feet. (2) A gas main in WEST 7TH STREET, from a point 97 feet west of Wayside Drive easterly 341 feet, the centerline of which gas main shall be 7.5 feet south of and parallel to the north property line of said West 7th Street. Said gas main described above shall have a cover of not less than 2 feet. (3) A gas main in BREEZE TERRACE, from East 32nd Street northerly 87 feet, the centerline of which gas main CITY OF AUSTIN, TEXAS 100 105 shall be 7.5 feet west of and parallel to the east property line of said Breeze Terrace. Said gas main described above shall have a cover of not less than 2 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the Department of Public Works not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. And that whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. That the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin.
