The public hearing on the application of Tanner-Evans Corporation for a franchise to place waiting benches at bus stops, scheduled for this day, was opened. The Mayor announced that the City Council had received 958 postcards from patrons of the Austin Transit Company, 937 of whom were for the benches and 21 against. The following persons as spokesmen for a group of citizens present, spoke in opposition to the benches substantially as follows: Ralph Schneider declared that such benches carrying advertisements were in the nature of bill-boards and that to grant same would be opening the way for other bill-boards in residential areas, and that the City of Austin could put in its own waiting benches. Chas. L. Sandahl declared that they did not want to have bill-boards scattered over the City; that the City could build its own benches; and that a group of business men would place one hundred benches free of charge, over the city for bus riders, with no advertising on them, such benches to be of concrete construction. , Dr. Dan Greider declared that it was an encroachment on city property by private corporation and that it would be opening the way for numerous other advertisements to come in. Councilman Glass offered the suggestion that the City consider the proposition of putting in its own benches, the cost of same to be paid for out of the proceeds from the franchise tax of the bus company. The Mayor stated that there is an imperative need for the benches and a great many people want them, but that there is also a great deal of opposition over the city to them and that he was not in favor of advertisements on them, and, therefore, he would have to vote to decline the proposition of Tanner-Evans Corporation, but that if the benches are not supplied by either the city or individuals within a reasonable time, the City Council may again entertain the proposition of said corporation. All citizens present having been given an opportunity to be heard on the matter, Councilman Thornberry then moved that the application of the Tanner-Evans Corporation for a ten-year franchise to place waiting benches at bus stops over the city, with advertisements on said benches, 10% of the proceeds from same to be given the city, be denied. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Mayor Miller, and Councilman Thornberry Noes: None Councilman Thornberry then moved that the proposal submitted by Chas. L. Sandahl, on behalf of a group of business men, to place one hundred CITY OF AUSTIN, TEXAS 142 waiting benches at bus stops over the city, such benches to carry no advertisements and to be placed without cost to the city, be accepted, subject to approval by the City Manager of the type of bench to be used. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Mayor Miller, and Councilman Thornberry Noes: None Senator Joe Hill came before the Council and submitted a request that the Zoning Ordinance be amended to prohibit the erection in Residence "A" Districts of duplexes on lots of insufficient size for two dwellings, declaring that the construction of two houses at the corner of Duval Street and Carolyn Avenue under the present ordinance had greatly devaluated his residence on Carolyn Avenue. The Council took the matter under advisement for an inspection of the property of Senator Hill. Ralph Schneider submitted a protest against an unsightly condition existing on Edgecliff Terrace in Travis Heights caused by large quantities of manure being dumped there. The matter was referred to the City Manager for attention. Councilman Thornberry introduced the following ordinance: AN ORDINANCE VACATING AND CLOSING AN ALLEY TRAVERSING BLOCK 43, TRAVIS HEIGHTS ADDITION, BUT RETAINING EASEMENTS IN SAID ALLEY FOR ALL PUBLIC UTILITIES; AND SUSPENDING THE RULE REQUIRING THE READING OF AN ORDINANCE ON THREE SEPARATE DAYS. The ordinance was read the first time and Councilman Thornberry moved that the rule be suspended and the ordinance be passed to its second reading. Noack and others that in consideration for certain easements for sanitary sewer purposes the City of Austin will furnish free sewer connections as shown by the instrument to be executed by the City Manager in behalf of the City of Austin. Which motion, carrying with it the adoption of the resolution, carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Mayor Miller, and Councilman Thornberry Noes: None Councilman Johnson introduced the following resolution and moved its adoption: (RESOLUTION) WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in LYNNWOOD STREET, from a point 295 feet south of Hancock Drive northerly 114 feet, the centerline of which gas main shall be 7½ feet west of and parallel to the east property line of said Lynnwood Street. Said gas main described above shall have a cover of notless than 2 feet. (2) A gas main in EAST 16TH STREET, from Salina Street westerly 255 feet, the centerline of which gas main shall be 13 feet north of and parallel to the south property line of said East 16th Street. (3)A gas main in EILERS AVENUE, from a point 43 feet south of Keasby Street southerly 41 feet, thecenterline of which gas main shall be 10 feet west of and parallel to the east property line of said Eilers Avenue. Said gas main described above shall have a cover of not less than 2 feet, The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the Department of Public Works not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. And that whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. That the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Thereupon Mayor Miller announced that the ordinance had been finally A committee from the Junior Chamber of Commerce, composed of Henry Ramsey. President, and others, was present and expressed its approval of the action of the City Council in denying a franchise to Tanner-Evans Corporation to place waiting benches at bus stops, declaring that if the City were going to consider a proposition of this kind, the Junior Chamber of Commerce would like to have the franchise and use the proceeds from same for the betterment of the City. The above committee from the Junior Chamber of Commerce also offered the services of said organization in speeding up the work of acquiring rightof ways from property owners on East Avenue for the interregional highway. The offer was accepted and the committee was invited to have representatives of its organization meet with the city's representatives and the property owners during negotiations. The above committee from the Junior Chamber of Commerce further submitted a request for permission to use Deep Eddy on April 27, 28, and 29 for a show to be staged by the Acquatic Club of the University of Texas, the proceeds from same to be used by the Junior Chamber of Commerce for construction of a cover over the East Avenue swimming pool in order to make it usable throughout the year as a swimming pool. Councilman Thornberry moved that the request be granted, and the matter be referred to the City Manager and the Recreation Department to work out the details with the committee. The motion carried by the following vote: Ayes: Councilmen Bartholomen, Glass, Johnson, Mayor Miller, and Councilman Thornberry Noes: None CITY OF AUSTIN, TEXAS 147 It was the consensus of the City Council that the Mayor's proposal to write letters to our Congressmen, Senators, the Secretary of Treasury, and the Federal Reserve Board, asking that cities be considered when raising interest rates, be approved. A committee from the Senior Chamber of Commerce, composed of S, M.Price, Walter E. Long, Secretary, and others, was present and tendered the assistance of said organization to the City Council in speeding up the work of acquiring right-of-way from property owners on East Avenue for the interregional highway. The Mayor advised the committee that the services of their organization would be accepted and the City would call on them in the matter. Councilman Thornberry offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, Union Securities Corporation, acting by and through its Secretary, Kenneth H.
