This application is for a change of zoning on two 25-foot lots adjoining a commercial zone at the southwest corner and two adjoining the commercial zone at the northwest corner of the intersection of Duval and East 51st Streets, the applicants affirming that the extension of the commercial area is requested to permit a more desirable development than would be permitted on the present 50-foot property in this zone and to permit offstreet parking. 2. The applicants further affirmed that they have no immediate plans for developing this commercial property but are considering a grocery store on one corner and a possible drug store, variety store, and cleaning and pressing shop on the other corner, and have had several offers for this type of use. 3. Several owners of property in this area appeared protesting this change on the grounds that there is no need for additional commercial property in this neighborhood and that any further exten- sion would have an adverse effect on their property for home development, and that there are grocery stores near this location to serve the needs of residents. 4. There is now a Community Center designated at the intersection of Duval Street and Bruning Avenue with East 51st Street consisting of four corners and a triangular tract extending to Evans Avenue, all being the equivalent of eight 50-foot lots and none of which has been developed for commercial uses since it was changed to #C# Commercial in 1938, and there are already several grocery stores and other community center uses within a few blocks of this intersection. 5. An extension of the commercial property at the southeast corner of this intersection was recently considered by the Board and not recommended for the same reasons, and the Board deemed, under the conditions and circumstances, that this property should not be changed to #C# Commercial as an extension of a Community Center that has not yet been developed and, therefore, is still available for commercial development, and the fact that no commercial development has taken place within the past ten years indicates that there is no great public demand or necessity for a large Community Center at this location; and further deemed that the existing community stores in this area are sufficient for the present needs of this section of the City. (Recommendations attached) "Austin, Texas May 6, 1948 Mr. Guiton Morgan City Manager Austin, Texas Dear Sir: I, the undersigned, have considered the application of Collins Construction Company for permission to operate a private gasoline plant con- sisting of a 1000 gallon underground tank and electric pump for the sole purpose of servicing their own motor equipment and from which no gasoline is to be sold, upon property located on the south side of East 19th Street, which property is designated as a 1.08 acre tract of the Bertha Ulit Addition, of Outlot 31, Division B, of the City of Austin, Travis County, Texas, and locally known as 2821 East 19th Street. This property is located in a "D" Industrial District and I recommend that this permit be granted, subject to the following conditions: (1) That the gasoline tanks and pumps shall be of an approved type and shall bear the label of the Underwriters Laboratories, Inc., and that all tanks and pumps shall be installed in compliance with the Ordinance governing the storage and handling of gasoline. (2) That all pumps shall be located not nearer than 10 feet to the property line and so located that cars stopped for the purpose of receiving gasoline or other supplies shall not in any way obstruct the free passage of traffic on either the sidewalk, street, or alley. (3) That "NO SMOKING" signs shall at all times be prominently displayed, and no person shall be permitted to smoke on the premises where gasoline is handled or stored. (4) That all fees shall be paid and a permit secured from the Building Inspector's office before any installation work is started, and that no equipment shall be placed in operation until after final inspection and approval of same. 371 371 CITY OF AUSTIN, TEXAS Respectfully submitted, (Sgd) J. Said gas main described above shall have a cover of notless than 2 feet. (2) A gas main in WOODROW AVENUE, from Brentwood Avenue to Payne Avenue, the centerline of which gas main shall be 7.5 feet west of and parallel to the east property line of said Woodrow Avenue. Said gas main described above shall have a cover of notless than 2 feet. (3) A gas main in KAREN AVENUE, from Woodrow Avenue to Wild Street, the centerline of which gas main shall be 7.5 feet south of and parallel to the north property line of said Karen Avenue. Said gas main described above shall have a cover of notless than 2 feet. (4) A gas main in PAYNE AVENUE from Woodrow Avenue easterly 615 feet, the centerline of which gas main shall be 7.5 feet south of and parallel to the north property line of said Payne Avenue. CITY OF AUSTIN, TEXAS 372 372 Said gas main described above shall have a cover of notless than 2 feet. (5) A gas main in MAPLE AVENUE from a point 67 feet south of East 19th Street north to East 19th Street, the centerline of which gas main shall be 16 feet west of and par- allel to the east property line of said Maple Avenue. Said gas main described above shall have a cover of notless than 2 feet. (6) A gas main in EAST 19TH STREET, from Maple Avenue easterly 91 feet, the centerline of which gas main shall be 13.5 feet south of and parallel to the north property line of said East 19th Street. Said gas main described above shall have a cover of notless than 2 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the Department of Public Works notless than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. And that whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. That the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin, Which motion, carrying with it the adoption of the resolution, carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Mayor Pro tem Thornberry Noes: None Absent: Mayor Miller The City Manager submitted a plan showing the future development of Gillis Playground, located between South Ist and Wilson Streets, the cost for this year's part of the development amounting to $3,840.00, covering the opening of new streets, preparation of the ground for the planting of grass on the whole area, water and playground equipment, the expenditure authorized being included in this year's budget. It was the sense of the Council that the plan be approved. CITY OF AUSTIN, TEXAS 373 373 The City Manager submitted a plan for the future development of Westenfield Playground, the cost for this year's part of the program amounting to $5,000.00, covering the laying of walks around the swimming pool, playground apparatus, etc., said amount being also included in this year's budget. It was the sense of the Council that the plan be approved. It was the sense of the Council that action on the following zoning changes now pending be postponed to the next regular meeting: Lewis R. Fisher, from "A" Residence District to "B-1" Residence District, of property located between West 19th and West 22nd Streets, and be- tween Cliff Street and alley east of David Street; S. R. Fulmore, Agent, from "A" Residence District to "C" Commercial District, of property fronting Shirley Avenue in Plaza Place, about three blocks long; W. A. Driscoll & W. D. Moritz, from "A" Residence District to "C" Commercial District, of property located between Alice Avenue and Bellvue Avenue south of West 42nd Street. Councilman Bartholomew moved that the appointment by the City Manager of Edward Robinson, Jr., David T. Lamme, Jr., and Leo Kuhn as members of the Firements and Policemen's Civil Service Commission, the terms of said Commissioners to be determined by their drawing for same, be confirmed. The motion was seconded by Councilman Johnson, and the same carried by the following votes Ayes: Councilmen Bartholomew, Glass, Johnson, Mayor Pro tem Thornberry; Noes: None Absent: Mayor Miller Pursuant to published notice thereof, the public hearing on the application of Travis C. Cook and J. W. Gregg, by J. M. Patterson, Jr., for change in zoning of their property, as follows: To amend the USE designation of the following described property so as to change the same from "A" Residence District to "C" Commercial District: That portion now zoned "A" Residence District of a strip of land out of the George W. Spear League at the northwest intersection of Georgetown Road and Koenig Lane and facing 200 feet on Georgetown Road and 755 feet on Koenig Lane, in the City of Austin, Travis County, Texas, was duly opened. No property owner or other interested person appearing to protest the proposed change, Councilman Bartholomew moved that the action of the Board of Adjustment be sustained and the change be granted, and the City Attorney be instructed to prepare the ordinance.
