A committee composed of George Roberts, James McPherson, and others, representing the Travis County Progressive Party, came before the Council and requested permission to use the Dorie Miller Auditorium fer a political speaking by Glen Taylor, the Progressive Party's candidate for Vice President, on October 24, and to charge admission to same. Mayor Miller moved that the use of the Auditorium on said date be granted to the Progressive Party, but without admission charges and in accordance with previous arrangements made with the City Manager, and that police protection be given them. P. The public hearing on the proposed ordinance to regulate jewelry auction sales was opened. The following persons appeared and spoke for the ordinances Arthur Bagby, Attorney for the jewelers; and Aaron Kruger, jeweler, who declared that some sort of regulation was necessary to protect the public from unscrupulous itinerant jewelers who are coming into the city and putting on auction sales. The following person appeared and spoke against the ordinance: M. H. Crockett, who objected to the ordinance in its entirety, and specifically to the hour of closing stipulated therein. The hearing on the above ordinance was continued to the next regular meeting. The public hearing on the various amendments to the text of the Zoning Ordinance was continued to the next regular meeting. The application of Oscar Harper and Mable L. Harper for change in zoning, from A Residence District to #C# Commercial District, of property located at 1109 Colete Street, was received. Littlepage in opposition to the change. Action of the Board: Not recommended For the following reasons: 1. The above application is for the change of the present "C" Commercial District classification of Lot No. 24 at the southwest corner of the intersection of Hancock Drive and Burnet Road, being of a triangular shape with a depth of 150 feet from Burnet Road and 130.858 from Hancock Drive to a "C-1 Commercial District classification. CITY OF AUSTIN, TEXAS 243 2. The purpose of this application is to enable the present cafe occupied to sell beer and wine in connection with meals on the plea that such a change would increase the business of the cafe and meet a frequent demand for these beverages by customers. 3. An examination of the zoning maps showed this lot to be located in a continuous "C" Commercial zone along Burnet Road with a depth of 150 feet a large portion of which has not been developed for commercial purposes and still occupied by residences. The area adjacent to this lot to the west is a large "A" Residence District which is rapidly developing to residential uses. The adjacent triangular lot to the west facing on Hancock Drive and Lynnwood Street is now city property upon which a fire station is being erected. There are now about three non-conforming establishments on Burnet Road in the vicinity of this lot which now dispense beer and wine. 4. After the hearing held by the Board of Adjustment on October 5,1948, the applicant presented a petition bearing 14 names expressing no objection to this change, only four of which are located within 200 feet of this property. At this hearing there also appeared. a large number of property owners and residents in this neighborhood vigorously expressing objection to this change and presenting a petition signed by 101 persons who are opposed to the sale of alcoholic beverages in this location. The opposition to this change contended that the present cafe is well conducted and an asset to the community and has prospered without the sale of beer but that to change the zone would adversely affect the neighborhood and introduce additional traffic congestion and hazard due to the fact that Hancock Drive and Burnet Road are major arteries of traffic which is constantly increasing and that the construction of the fire station would further affect traffic conditions and that there is no need for such a change except for the personal gain of the present operator of the cafe. 5. After careful consideration of conditions and circumstances surrounding the property, inspection of the site by the members of the Board, and the overwhelming disapproval of this neighborhood to further introduction of the sale of intoxicating beverages in this neighborhood, and the fact that this change in effect on one lot represents a spot zone not in response to any public demand or necessity but for the sole benefit of the present operation, the Board deemed that it would not be to the best interest of this community nor in accordance with any zoning plan to grant this application. The motion carried by the following votes Ayes : Councilmen Bartholomew, Johnson, Mayor Miller Noes : None Absent: Councilman Glass CITY OF AUSTIN, TEXAS 844 adoptions Councilman Johnson offered the following resolution and moved its (RESOLUTION) WHEREAS, the land hereinafter described was sold to the City of Austin for taxes by Sheriff's deed dated March 2, 1900; and WHEREAS, all taxes for which such sale was made have been fully paid; Now, Therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: That Quiton Morgan, City Manager, be and he is hereby authorized and directed to execute a quitclaim deed for and on behalf of the City of Austin to Lou Bradley, and to his successors in title, conveying all right, title, and interest of the City of Austin in and to one-half (1/2) acre of land out of the George W. Which motion, carrying with it the adoption of the resolution, carried by the following vote: Ayes: Councilmen Bartholomew, Johnson, Mayor Miller Noes: None Absent: Councilman Glass adoptions Councilman Bartholomew offered the following resolution and moved its (RESOLUTION) WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named and said maps or plans have been considered by the City Council; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in PRUETT STREET, from a point 379 east of Wayside Drive easterly 156 feet, the centerline of which gas main shall be 7 feet south of and parallel to the north property line of said Pruett Street. Said gas main described above shall have a cover of not lees.than 22 feet. (2) A gas main in SINGLETON AVENUE, from a point 105 feet south of East 13th Street southerly 63 feet, the centerline of which gas main shall be ll feet west of and par- allel to the east property line of said Singleton Avenue. Said gas main described above shall have a cover of notless than 22 feet. CITY OF AUSTIN, TEXAS 845 The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the Department of Public Works not less than three days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. And that whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. That the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid, shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchise granted to said Company by the City of Austin. Which motion, carrying with it the adoption of the resolution, carried by the following votes adoptions Ayes: Councilmen Bartholomew, Johnson, Mayor Miller Noes: None Absent: Councilman Glass Councilman Johnson offered the following resolution and moved ite (RESOLUTION) WHEREAS, the tax roll for the year 1947 carries an assessable valuation 'of $1,480 on improvements located on the south 80 of Lot 1, Block A, Capital Heights, Plat 114, Item 103; and. WHEREAS, it has been brought to the attention of the Tax Department that as of January 1, 1947, said improvements assessed against Edelmiro T. Vidaurri were not completed, as contemplated by the appraisal of $1,480, but were actually only 30% completed as of January 1, 1947, warranting an assessable value of only $44440 instead of $1,480; therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Tax Assessor and Collector be and he is hereby directed to reduce the assessed valuation of said improvements on the tax roll for the year 1947 from $1,480 to $440. Steussy, Fanny W. Steussy and Mrs. Ida Lee Shanholtzer, asking for the closing of a portion of 17th Street extending from Neches Street easterly for a distance of 69 feet, was received. The written recommendation of the Director of Public Works that same be not granted was also received. It was the sense of the Council that the recommendation of the Director of Public Works stand unless further appeal is made. The written complaint of Louis Tittle against a nuisance created by the Chestmut Cleaners, located at the corner of 18th Street and Congress Avenue was received The matter was taken under advisement for investigation. The application of SYLVESTER E. HINTON, 410 West 11th Street, for a license to operate as a taxicab a 1948 Model, 4-door Chevrolet, Fleetline, Motor No. FAA-62416, State License No. JB-8161, duly approved by the City Manager, was submitted. Councilman Bartholomew moved that the license be granted.
