Council Chamber, City Hall 30 The meeting was called to order, with Mayor Pro tem Glass presiding. Roll call: Present: Councilmen Bartholomew, Johnson, Glass, Mayor Pro tem Glass Absent: Mayor Miller Present also: Guiton Morgan, City Manager; J. E. Motheral, Director of Public Works; W. T. Williams, Jr., Ass't City Attorney; and R. D. Thorp, Chief of Police: The reading of the Minutes was dispensed with. The following report of the Board of Adjustment was received: "ZONING BOARD OF ADJUSTMENT AUSTIN, TEXAS ZONING CHANGE RECOMMENDATION Applicant: I. II. III. Eulalia Sanchez. Referred to the Board by the City Council on November 12, 1948 Property affected: Lot 10, Block 2, Riverside Addition, Outlot 36, Division "0", being located at the southwest corner of East 1st and Chicon Streets and locally known as 1811 East 1st street. To be changed: From: "C" Commercial District and Second Height and Area District. To: #C-1" Commercial District and Second Height and Area District. IV. Considered by the Board on: January 18, 1949. V. Parties appearing: For: None (No hearing called) Against: None VI. Action of the Board: CITY OF AUSTIN, TEXAS Change not recommended. 31 For the following reasons: 1. This application is for a change of zoning on a lot on which a similar change was requested and recommended against by the Board on March 23, 1948, and on which no final action was taken by the City Council. 2. The Board delayed action on the new request until after the passage of an amendment to the Zoning Ordinance regulating "C-l" and "C-2" Commercial uses and considered the application at a meeting on January 18, 1949. 3. The Board still feels that it is unwise to make this change for the reasons contained in the previous recommendation as listed below: (1) The applicant affirms that he is requesting a change of zoning on his property to permit the sale of beer in a restaurant which will be established here if the zone is changed. (2) Strenuous opposition was expressed to this change on the grounds that there is a church located one block south and members attending services use a bus stop directly in front of this property, and that children pass this location going to and from school in the neighborhood, and on the further grounds that there is no need for this type of use in the neighborhood already developed with numerous homes which would be adversely affected by the change, and that the heavy traffic on East 1st Street would be increased by this business because of narrow driveways on the property. (3) The Board deemed that this change should not be made in view of the objections expressed and the fact that this would create a spot zone for the benefit of one property owner and not in response to any public demand or necessity. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Johnson, Long, Mayor Pro tem Glass Noes: None Absent: Mayor Miller CITY OF AUSTIN, TEXAS 32 The application of Jake Silberstein for change in zoning, from "A" Residence to "C" Commercial, of the property located at 202 to 210 Chicon Street was received. Councilman Bartholomew moved that the application be referred to the Board of Adjustment for consideration and recommendation. The motion carried by the following vote: Ayes: Noes: Absent: Councilmen Bartholomew, Johnson, Long, Mayor Pro tem Glass None Mayor Miller Richard Hernandez appeared before the Council and requested that the City sell him a small strip of land adjacent to his property and fronting on East 7th Street. The City Manager did not recommend the sale of this property at the present time, and Mr. Hernandez was advised that should the City sell this property at a later date it would have to be advertised and sold to the highest bidder. Sumners, President, was read advising that the Lions Club would provide for the cost of an additional speech room in the Cerebral Palsy Center, such cost amounting to $1,827.33. Messers Giesecke, Kuehne and Brooks, architects on the Cerebral Palsy Center, advised that Mr. B. L. McGee agreed to reduce his bid by $100.00, such amount to be his contribution to his project, thus making the total amount of his bid $13,131.51. Deducting the amount of $1,827.33 to be contributed by the Lions Club from the total bid of Mr. McGee, the amount the City of Austin will have to pay will be $11,304.18. Councilman Johnson moved that the bid of B. L. McGee and the amount of $1,827.33 be accepted. Ebner, 2209 Canterbury, appeared and protested the valuation placed on the improvements on his property. He stated that he had advised the Tax Department that an error had been made in the kind of construction they had charged him with and that a correction had been made on the file cards but not on his assessment. The Council advised that an investigation would be made of his complaint and he would be advised of their findings. Councilman Bartholomew offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Council of the City of Austin hereby approves the property situated on the west side of Nueces Street as a private gasoline plant, which property is owned by Quality Mills, and is designated as Lots 5, 6 and 7, Block 188 of the Original City of Austin, Travis County, Texas, and hereby authorizes the said Quality Mills to operate a private gasoline plant consisting of a 550-gallon underground tank and electric pump for the sole purpose of servicing their own motor equipment, and from which no gasoline is to be sold, subject to the same being operated in compliance with all the ordinances relating thereto, and further subject to the foregoing attached recommendations and the Building Inspector is hereby authorized to issue an occupancy permit for the operation of this private gasoline plant after full compliance with all the provisions of this resolution, and said permission shall be held to be granted, and accepted subject to all necessary, reasonable and proper, present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of the proper police, traffic and fire regulations; and the right of revocation is retained if, after hearing, it is found by the City Council that the said Quality Mills has failed and refused and will continue to fail and refuse to perform any such conditions, regulations and ordinances. This property is located in a "C-2" Commercial District and I recommend that this permit be granted subject to the following conditions: (1) That the gasoline tanks and pumps shall be of an approved type and shall bear the label of the Underwriter's Laboratories, Inc., and that all tanks and pumps shall be installed in compliance with the Ordinance governing the storage and handling of gasoline. (2) That all pumps shall be located not nearer than 10 feet to the property line and so located that cars stopped for the purpose of receiving gasoline or other supplies shall not in any way obstruct the free passage of traffic on either the sidewalk, street or alley. (3) That "NO SMOKING" signs shall at all times be prominently displayed, and no person shall be permitted to smoke on the premises where gasoline is handled or stored. (4) That all fees shall be paid and a permit secured from the Building Inspector's Office before any installation work is started, and that no equipment shall be placed in operation until after final inspection and approval of same. Said gas main described above shall have a cover of not less than 2 feet. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments they shall apply to the Department of Public Works not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. CITY OF AUSTIN, TEXAS 39 THAT the work and laying of said gas mains, including the excavation in the streets, and the restoration and maintenance of said streets after said mains have been laid shall be under the supervision and direction of the City Manager and under all the pertinent terms and conditions of the certain franchises granted to said company by the City of Austin.
