CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting February 3,1949 10:50 Α.Μ. Council Chamber, City Hall 65 The Meeting was called to order, with Mayor Miller presiding Roll Call: Present: Absent: Councilmen Bartholomew, Johnson, Glass, Long, Mayor Miller None Present also: Guiton Morgan, City Manager; J. E. Motheral, Director of Public Works; Trueman E. O'Quinn, City Attorney; and R. D. Thorp, Chief of Police. The reading of the Minutes was dispensed with. Councilman Johnson offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, Blue Cross Veterinary Clinic has made application in writing through Fred P. Savage, for permission to use and maintain a building for the treatment of small domestic animals on Lot 5, Block 2, Shoalmont Addition, the same being the west side of Burnet Road and is locally known as 5434 Burnet Road and is located in a "C" Commercial District, which under Section 6, Item 33 of the Zoning Ordinance, requires a special permit from the City Council; and WHEREAS, the applicant further agrees to soundproof and aircondition. the building, that no kennels, runs or other housing of animals outside of the main building will be erected or used and that no animals will be boarded, or bred, or confined longer than is necessary for the proper treatment of diseases, and WHEREAS, this application has been considered and approved by the City Council of the City of Austin, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT permission for the use and maintenance of a building for the treatment of small domestic animals be granted to Blue Cross Veterinary Clinic, and operated by E. P. Savage, D. V. M. じ CITY OF AUSTIN, TEXAS 66 After discussing this resolution, Councilman Johnson moved that action on same be delayed until February 10, 1949, pending compliance with the requirements set forth therein. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Long, Mayor Miller Noes: None Foy Wallace Moulder appeared and asked to have his taxicab driver's permit reinstated. This was a 90-day probationary permit and had been revoked by the Council on January 27, 1949, upon recommendation of the City Manager and Chief of Police. Mr. Moulder was advised that the Council could do nothing about this unless the Chief of Police, after a reinvestigation of his case, recommended that the permit be granted. Rufus Winn, colored, appeared again and requested that the City pay him $200 more and he would consider this as a final settlement of his case against the City, because of injuries received while in the employ of the City last year. The matter was referred to the City Manager and Dr. Primer and he was told their decision would be final. Councilman Glass moved that the following applications for taxicab operator's license and taxicab driver's permits, duly approved by the City Manager, be granted: Taxicab Operator's License: Sabatino Sconci, 3608 Monson Street, 1947, 4-door Hudson, Motor No. 1715588, License No. JD-1674 Taxicab Driver's Permits: L. Joseph owner, 1200 East 6th street The motion carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Long, Mayor Miller Noes: None Councilman Bartholomew offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, the Austin Chapter of the Reserve Offiers' Association of CITY OF AUSTIN, TEXAS = 67 the United States is again taking the lead in consideration, by all of our citizens, of the state of our nation's strength through its traditional observance of National Security Week, a period sought by the ROA and proclaimed by the President of the United States, the Governor of our State, and the Mayors of our various cities, and WHEREAS, there is always a need to combat the lethargy and apathy toward military affairs which would render this nation virtually defenseless: and WHEREAS, our City as part of a great nation has just emerged from a great war in which our people demonstrated their strength and character and now face the traditional postwar enemy of reaction and pseudo-pacifism; and WHEREAS, under these circumstances of international unrest and uncertainties, of jealousies and distrust among nations, and of economic, ideologi- cal, and national rivalries, it is more important probably than ever before that our entire citizenry must be kept informed and aroused to the dangers to our National Security; THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT we commend the Reserve Officers Association for its leadership in establishing this National Security Week observance; that we pledge to the ROA and the many organizations assisting in this observance our fullest cooperation; and that we urge all of our fellow citizens to join together in this all-important observance. Councilman Johnson offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, the Southwestern Bell Telephone Company has presented to the City Council tentative maps or plans showing the proposed construction of its underground telephone conduits in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the Director of Public Works; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestern Bell Telephone Company be and the same is hereby permitted to construct its underground telephone conduits in the following streets: (1) An underground telephone conduit in GEORGETOWN ROAD, from a point 26 feet south of West 45th Street north to point 760 feet south of Brentwood Street, the centerline of which underground telephone conduit shall be 31.5 feet west of and parallel to the centerline of said GEORGETOWN ROAD. (2) An underground telephone conduit in GEORGETOWN CITY OF AUSTIN, TEXAS ROAD, from a point 760 feet south of Brenwood Street north to Brentwood Street, the centerline of which underground telephone conduit shall be 36 feet west of and parallel to the centerline of said GEORGETOWN ROAD. Said gas main described above shall have a cover of notless than 2 feet. (2) A gas main in PEQUENO STREET, from Camino Real to Hall Street, the centerline of which gas main shall be 7½ feet south of and parallel to the north property line of said PEQUENO STREET. Said gas main described above shall have a cover of notless than 2 feet. (3) A gas main in HALL STREET, from Pequeno Street southerly 230 feet, the centerline of which gas main shall be 7 feet west of and parallel to the east property line of said HALL STREET. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special point. After this matter was fully explained by the City Manager and the Director of Utilities, the Council instructed the City Manager to answer the letter with a denial of such claim. (See L. C. R.
