171 CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Regular Meeting March 31,1949 10:30 Α. Μ. Council Chamber, City Hall 171 The meeting was called to order, with Mayor Miller presiding. Roll call: Present: Councilmen Bartholomew, Glass, Johnson, Long, Mayor Miller Absent: None Present also: Guiton Morgan, City Manager; Trueman E. O'Quinn, City Attorney; J. E. Motheral, Director of Public Works; and R. D. Thorp, Chief of Police. The reading of the Minutes was dispensed with. Councilman Glass moved that the time for the payment of City taxes, without interest be extended to April 4, 1949, and without penalty to June 1, 1949. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Long, Mayor Miller Noes: None Stan Hickman, representing the University Fair Practices Committee, appear ed and requested better garbage collection service in the area surrounding University boarding houses, fraternity and sorority houses. He stated that the conditions in this area were a menace to the health of the students and very unsightly. The Council instructed the City Manager to investigate this complaint and see what could be done to correct same. Dr. Kelton, President of the Community Nursery Board of Austin, appeared and requested help from the City to find a new location for the Nursery which had been operating in the Chalmers Court Housing Project but which will have to be moved. He suggested that the City give them one of the houses which would have to be moved off the Interstate Highway on East Avenue and move it to a City-owned lot, preferably in the downtown section. The O. Henry Museum property or the park located at 5th and Guadalupe streets was suggested. The Council requested the City Manager to investigate the possibility of granting this request and the use of the suggested sites. The public hearing on the application of E. C. MCCLURE and LEM SCARBROUGH for a change in zoning, from "A" Residence to "C" Commercial, of the property located at 5209 and 5211 Eilers Avenue, this city, which was continued from last week was held. No one appeared to protest this change. Councilman Johnson moved that 172 CITY OF AUSTIN, TEXAS 172 the recommendation of the Board of Adjustment be NOT SUSTAINED and the change GRANTED, and the City Attorney instructed to prepare an ordinance for passage at the next meeting of the Council. Murray and Euphie R. Said gas main described above shall have a cover of notless than 2 feet. (2). Said gas main described above shall have a cover of not less than 2 feet. 110 CITY OF AUSTIN, TEXAS (11) A gas main in EAST 41st STREET, from a point 388 feet east of Red River Street easterly 664 feet, the centerline of which gas main shall be 7½ feet south of and parallel to the north property line of said EAST 41st STREET. Said gas main described above shall have a cover of notless than 2 feet. (12) A gas main in ATTAYAC STREET, from East 2nd Street southerly 147 feet, the centerline of which gas main shall be 13 feet west of and parallel to the east property line of said ATTAYAC STREET. Said gas main described above shall have a cover of notless than 22 feet. 178 The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments they shall apply to the Department of Public Works not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets and the restoration and maintenance of said streets after said mains have been laid shall be under the supervision and direction of the City Manager, and under all the pertinent terms and conditions of the certain franchises granted to said company by the City of Austin. Councilman Long offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Council of the City of Austin hereby approves the erection of a private covered boat dock on the property owned by Marion Fowler as described in the Travis County Deed Records and known as Lots 20 and 21, of the Lakeshore Addition and being on the west side of Lake Austin, and hereby authorizes the said Marion Fowler to construct, maintain and operate this private covered boat dock subject to the same being constructed in compliance with all the ordinances relating thereto and further subject to the foregoing attached recommendations; and the Building Inspector is hereby authorized to issue an occupancy permit for the erection of this private covered boat dock after full compliance with all the provisions of this resolution. Nash, President, to operate a private gasoline plant consisting of a 550-gasoline underground tank and visible pump for the sole purpose of servicing their own motor equipment, and from which no gasoline is to be sold, subject to the same being operated in compliance with all the ordinances relating thereto, and further subject to the foregoing attached recommendations; and the Building Inspector is hereby authorized to issue an occupancy permit for the operation of this private gasoline plant after full compliance with all the provisions of this resolution, and said permission shall be held to be granted, and accepted subject to all necessary, reasonable and proper, present and future, regulations and ordinances of the City of Austin, Texas, in the enforcement of the proper police, traffic and fire regulations; and the right of revocation is retained, if, after hearing, it is found by the City Council that the said Capitol Unloading and Storage, Inc., has failed and refused, and will continue to fail and refuse to perform any such conditions, regulations and ordinances.
