Council Chamber, City Hall 222 The meeting was called to order, with Mayor Miller presiding. Roll call Present: Councilmen Bartholomew, Glass, Johnson, Long, Mayor Miller Absent: None Councilman-elect W. S. Drake, Jr., was present also. Present also: Guiton Morgan, City Manager; Trueman E. O'Quinn, City Attorney; J. E. Motheral, Director of Public Works; and R. D. Thorp, Chief of Police. The reading of the Minutes was dispensed with. Colonel Robert Phinney appeared before the Council to extend an invitation from the Travis County Society of Crippled Children to the present Council and the newly elected Council to the official dedication and opening of the Austin Cerebral Palsy Center, Sunday, May 1st, 4:00 P.M. Mr. E. W. Jackson appeared before the Council to express appreciation for the services rendered by the Council and to particularly commend Councilman Bartholomew and Mayor Miller for their fine leadership under which the City had grown. He stated the Mayor had used his vast amount of power and influence for the good of the City and had visioned and promoted this growth. The Mayor's leadership would always be a challenge to those following him, and Mr. Jackson wanted to express gratefulness for this fine service through the past sixteen years. Mr. M. H. Crockett appeared before the Council requesting that Haywood Avenue be dedicated as a street. As the Planning Board had not accepted or approved this dedication, Mr. Crockett asked if he would get the street in order, furnish the pipe, etc., would the City connect the utilities. The City Attorney stated unless it was properly passed and approved by the City Planning Commission and approved by the City Council, it would be unlawful for the utility officers to make any connections. Councilman Glass moved that the City Manager be instructed to arrange a meeting with Mr. Crockett, the Planning CITY OF AUSTIN, TEXAS 2 223 Engineer, City Attorney, and others to try to work something out with Mr. Crockett. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Long, Mayor Miller Noes: None Mayor Miller was presented a floral offering, representing two medals, each with an orchid in the center, with a note attached, "The people of Austin want to express their appreciation to you for a job well done", the note being signed by John Rutherford, Bryant Collins, Walter E. Long, E. W. Jackson, Joe Dacy and E. H. Perry. Mr. Morton Harris, representing H. E. Butt Grocery Company appeared again before the Council with the request that the alley in back of the H. E.Butt Grocery Company on West 12th Street, be vacated and sold by the City. After discussing this matter at length, the Council agreed to the sale of this alley provided the H. E. Butt Company would agree to keep it open to the public forever. Mr. Harris stated that the H. E. Butt Company would agree to this stipulation, and that this should be recited in the deed. Mayor Miller introduced the following ordinance: AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE IN BEHALF OF THE CITY OF AUSTIN A DEED CONVEYING TO H. E. BUTT GROCERY COMPANY, A CORPORATION, APPROX- IMATELY 3871 SQUARE FEET OF A CERTAIN 13-FOOT PUBLIC ALLEY IN GREGG ADDITION 125 FEET NORTH OF AND PARALLEL TO WEST 12TH STREET AND TERMINATING ON THE WEST AT SHOAL CREEK BOULEVARD, WHICH ALLEY IS HEREIN CLOSED AND VACATED, TOGETHER WITH APPROXIMATELY 993 SQUARE FEET OF LAND ABOUT 255 FEET IN LENGTH OFF THE SOUTH SIDE OF A TRACT CONVEYED BY W. T. Pursuant to published notice thereof, the public hearing on proposed amendments to the Zoning Ordinance of the City of Austin for the establishment of building setback lines and provisions for off-street parking of vehicles on certain thoroughfares in the City of Austin, in the following particulars: I. Lamar Boulevard from 24th Street to 45th Street: (1) Establishment of a building line a minimum distance of 65 feet from the center line of Lamar Boulevard between its intersection with West 24th Street and West 45th Street; and providing further that no maximum building setback shall be indicated and that if the owner of property abutting the boulevard shall desire to construct a building more than 65 feet from the center line in order that the area from property line to building may be used for parking, such owner shall be permitted an additional setback on condition that the owner construct a curb along the front line of his property to prevent parking of vehicles in or across the sidewalk area, and shall provide a minimum setback from property line of 48 feet for the building, and shall provide driveways sufficient to afford separate routes for ingress and egress. (2) Parking areas on private property must be provided as follows: for grocery stores, super-markets, restaurants, and similar businesses, nd less than 3 square feet of private parking area shall be provided for each square foot of building area; for drug stores, haberdasheries, cleaning and pressing establishments, laundrys, and similar businesses, there shall be provided on private property not less than 2 square feet of private parking area for each square foot of building area. II. East Avenue from East 1st Street north to city limit line: (1) No building shall be constructed or structurally altered closer than 125 feet from the center line of East Avenue or a minimum of 25 feet behind the front line of private property abutting East Avenue; and providing further that no maximum building setback shall be indicated and that if the owner of property abutting the avenue shall desire to construct a building more than 125 feet from the center line in order that the area from property line to building may be used for parking, such owner shall be permitted an additional setback on condition that the owner construct a curb along the front line of his property to prevent parking of vehicles in or across the sidewalk area, and shall provide a minimum setback from property line of 48 feet for the building, and shall provide driveways sufficient to afford 255 CITY OF AUSTIN, TEXAS 225 separate routes for ingress and egress. (2) Parking areas on private property must be provided as follows: for grocery stores, super-markets, restaurants, and similar businesses, not less than 3 square feet of private parking area shall be provided for each square foot of building area; for drug stores, haberdasheries, cleaning and pressing establishments, laundrys, and similar businesses, the re shall be provided on private property not less than two square feet of private parking area for each square foot of building area. III. Govalle. Industrial Area: (1) Streets having a proposed 60 foot right-of-way: On all streets in this area where a future minimum 60 foot right of way width is contemplated, the building line for commercial or industrial buildings shall be a minimum of 55 feet from the center line of the streets. (3) Streets having a proposed 80 foot right of way: On all streets in this area where a future minimum 80 foot right of way width is contemplated, the building line for commercial or industrial buildings shall be a minimum of 65 feet from the center line of the streets. The streets included in this group are: CITY OF AUSTIN, TEXAS 225 Pleasant Valley Road - from East Ist Street to Govalle Avenue. Tillery Street Springdale Road East 5th Street Lyon Road Govalle Avenue - - from East 1st Street to Govalle Avenue. from East 1st Street to Airport Boulevard. from Pleasant Valley Road to Springdale Road. from Webberville Road to Springdale Road. from Webberville Road to Springdale Road. (4) Provided that no maximum building setback shall be indicated and that if the owner of property abutting the streets shall desire to construct a building more than 65 feet from the center line in order that the area from property line to building may be used for parking, such owner shall be permitted an additional setback on condition that the owner construct a curb along the front line of his property to prevent parking of vehicles in or across the sidewalk area, and shall pro- vide a minimum setback from property line of 48 feet for the building, and shall provide driveways sufficient to afford separate routes for ingress and egress. (5) For industrial structures on all streets in Industrial Govalle Area (III), loading docks shall be so located that the loading and unloading of all trucks and other vehicles can be performed on private property and not within the right of way of any such abutting street. IV. East 7th Street Extensions: (1) No commercial or industrial building shall be constructed or structurally al tered with a distance of less than 25 feet from the property line fronting on East 7th Street from Comal Street east to the corporate limits of the City of Austin. (2) Parking areas on private property must beprovided as follows: for grocery stores, super-markets, restaurants, and similar businesses, not less than 3 square feet of private parking sea shall be provided for each square foot of building area; for drug stores, haberdasheries, cleaning and pressing establishments, laundrys, and similar businesses, there shall be provided on private property not less than 2 square feet of private parking area for each square foot of building area. (3) For industrial structures, loading docks shall be so located that the loading and unloading of all trucks and other vehicles can be performed on private property and not within the right of way of East 7th Street or any intersecting street between Chicon Street and the east corporate limits of the City of Austin. After considerable discussion, Councilman Glass moved that this matter be deferred for further study by the Council, and that it be set for public hearing again to be heard May 26, 1949. The motion carried by the following vote: Ayes: Councilman Bartholomew, Glass, Johnson, Long, Mayor Miller. Noes: None ン ت CITY OF AUSTIN, TEXAS 227 The City Manager submitted the following tabulation of bids which had been received for Concession rights at the City Coliseum: M. Nussbaum Burke Matthews Nuke Conte - Texas Sport Service, Inc. (Both concessions or note) Victor H. Randolph Clifford Lander Dewey Smith Charles Schmidt 26% of the gross receipts 26% of the gross receipts 25% of the gross receipts 21.2% of the gross receipts 19% of the gross receipts 18% of the gross receipts 15% of the gross receipts All bidders submitted a price list of articles, the charges being substantially the same. M. Nussbaum and Burke Matthews had a tie bid and agreed to a-drawing; and Burke Matthews was the successful bidder after the drawing. Councilman Long moved that the bid of Burke Matthews for the Concession rights at the City Coliseum, duly recommended by the City Manager, be accepted and that the City Manager be authorized to enter into a contract with Burke Matthews. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Long, Mayor Miller Noes: None The City Manager submitted the following tabulation of bids which had been received for Concession rights at the Softball Fields at Butler Park West: Nuke Conte J. O. Hopkins John M. Butcher Dewey Smith Burke Matthews 25% of the gross receipts 22% of the gross receipts 20% of the gross receipts 18% of the gross receipts 15% of the gross receipts All bidders submitted practically the same charges for the concessions. Mr. Nuke Conte, withdrew his bid of 25%, as he was not interested in one concession unless awarded both concessions. His withdrawal left Mr. J. O. Hopkins as the highest bidder. Councilman Long moved that the bid of Mr. J. 0. Hopkins for the Concessions at the Softball Fields at Butler Park West, duly recommended by the City Manager, be accepted, and that the City Manager be authorized to enter into a contract with J. O. Hopkins. The motion carried by the following vote: Ayes: Councilmen Bartholomew, Glass, Johnson, Long, Mayor Miller Noes: None The Council received a petition from Mr. E. B. Snead and a group of residents in Highland Park West, requesting the Austin Transit Company to furnish bus service in this area; and if this service cannot be furnished, that they be granted permission to operate a single bus of their own. The Council instructed the City Manager to refer the petition to the Austin Transit Company to arrange a hearing with Mr. Sneed and a group of these petitioners to work out something satisfactory to all parties concerned. 223 CITY OF AUSTIN, TEXAS 228 Mayor Miller expressed regrets/that the Real Estate representatives had left, and made the suggestion regarding the rent control that a Rent Control Committee be appointed advisory to the City Council, with a representative from the landlords, a representative from the tenants and one from the public generally, to make a study and report to the Council; then have public hearings. He suggested this Rent Control Committee call on the Rent Control Board or any other organization for information they might need for their study. Mayor Miller introduced the following ordinance: 4 AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF AUSTIN AND THE ANNEXATION OF CERTAIN AD- DITIONAL TERRITORY CONSISTING OF 8.35 ACRES OF LAND, SAME BEING OUT OF THE HENRY P. HILL LEAGUE, IN TRAVIS COUNTY, TEXAS, WHICH SAID ADDITIONAL TERRITORY LIES AD- JACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF AUSTIN, IN THE PARTICULARS STATED IN THE ORDINANCE. The ordinance was read the first time and laid over for publication. Benson, Jr., and Florence D. Benson, for the laying of certain water mains, sanitary sewer mains and other pipes in Park View Addition, a subdivision of Tracts 3 and 4, Outlot 3, Division Z of the Outlots of the City of Austin, in accordance with the terms and provisions of a certain contract, a copy of which is eat- tached to this Resolution and made a part hereof for all purposes. City of Austin Election Suit, in which the Supreme Court held that no part of the election proceedings, including payment of necessary and incidental expenses could be enjoined.
