Council Chamber, City Hall The meeting was called to order with Mayor Glass presiding. Roll call: Present: Councilmen Drake, Johnson, Long, MacCorkle, Mayor Glass Absent: None Present also: Guiton Morgan, City Manager; Trueman E. O'Quinn, City Attorney; J. E. Motheral, Director of Public Works; R. D. Thorp, Chief of Police; Dr. Ben Primer, City Health Officer. The minutes of the previous meeting were read and approved. MRS. MR. EMMETT SHELTON was the spokesman for a group of residents on the Bee Cave Road complaining of the City Dump, listing three major complaints: (1) flies; (2) filth and stench--garbage falling from the trucks--glass along the highway; (3) the traffic hazard. MR. WICK FOWLER AND MR. NASH spoke in protest as it was a health hazard. MRS. HORTON SMITH asked for immediate relief, and for an immediate reply. She stated the other services of the City were well planned; but the disposal site was in bad shape, and she would like to ask for a definite plan of what the City proposed to do and a definite date. FRANK SPILLAR spoke in the interest of children who would scout around the dump and asked that the City, if it did not move the dump, make it more sanitary. MR. HERMAN COFER spoke, suggesting that the dump be moved to the Industrial area of the town. MRS. KREISLE spoke complaining of the garbage trucks creating a traffic hazard. DR. L. F. HOLLAND suggested that the experts from the State Health Department be contacted and that the Council confer with these men. City Manager was instructed to get estimates on changing and enlarging the incinerator; to get estimates on a fill; to bring in the available experts from the State Health Department to confer with the City experts; and to prepare a report on the temporary relief the City will be able to give these people, as well as what can be done to give relief on a long range plan; and to have this report available in two weeks. Public hearing on the above change of zoning was held, with Mr. Charles Herring representing Mrs. John L. Martin. Speaking in opposition were Mr. Robert B. Thrasher for Miss Lynn Smith; Miss Ida Anderson, 104 E. 16th; Mr. Lester Brenizer; Mr. H. J. Nelson; 1509 Congress; and Mrs. Railey, 1615 Congress. It was brought out at the hearing that this was in the area that the State probably would purchase in the near future and no commercial development would be desirable in response to public need, necessity or convenience. Councilman Johnson moved that the recommendation of the Zoning Board of Adjustment be upheld and the requested change of zoning be NOT granted. JESSE COCHRAN, submitting a petition signed by thirty-four property owners vigorously opposing the change, stating this was ideal for residential areas if the threat of changing it to commercial were removed; and that the strip of land facing on Lamar Boulevard and adjoining the property owners could be made into a park lane, it would add to the beautification of the thoroughfare and add to the residential area, and it would add to the safety of the highway; and I. T. CHILDRESS, 4211 Marathon spoke in opposition. The Council received the petition submitted by Mr. Cochran and noted the opposition expressed by the others. Councilman Long moved that in view of the fact it had not been determined as to the disposition of the strip of land facing on Lamar Boulevard and adjoining these property owners, that the Council defer action on the requests for zoning changes until it could make some disposition of this strip of land and make a personal inspection of all the property involved. The motion carried by the following vote: Ayes: Councilmen Drake, Johnson, Long, MacCorkle, Mayor Glass Noes: None : 277 CITY OF AUSTIN, TEXAS 297 Councilman Drake offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, Texas Public Service Company has presented to the City Council tentative maps or plans showing the proposed construction of its gas mains in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the City Council; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT Texas Public Service Company be and the same is hereby permitted to lay and construct its gas mains in and upon the following streets: (1) A gas main in EAST 20th STREET, from Salina Street easterly 106 feet, the centerline of which gas main shall be 7½ feet south of and parallel to the north property line of said EAST 20th STREET. Said gas main described above shall have a cover of not less than 2 feet. (2) A gas main in GROVER AVENUE, from a point 170 feet north of North Street southerly 100 feet, the centerline of which gas main shall be 5 feet west of and parallel to the east property line of said GROVER AVENUE. The Texas Public Service Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Texas Public Service Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments they shall apply to the Department of Public Works not less than three (3) days before such information is required. The Texas Public Service Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. AND THAT whenever pavement is cut in the vicinity of a fire plug, water must be used at intervals during the course of backfilling of the ditches. THAT the work and laying of said gas mains, including the excavation in the streets, and the restoration and maintenance of said streets after said mains have been laid shall be under the supervision and direction of the City Manager and under all the pertinent terms and conditions of the certain franchises granted to said company by the City of Austin. Spear League within the City of Austin, Travis County, Texas, and hereby authorizes the said L. L. The motion carried by the following vote: Ayes: Councilmen Drake, Johnson, Long, MacCorkle, Mayor Glass Noes: None Mayor Glass introduced the following ordinance: AN ORDINANCE AMENDING THAT CERTAIN ORDINANCE ENTITLED "AN ORDINANCE REGULATING TRAFFIC UPON THE PUBLIC STREETS OF THE CITY OF AUSTIN; PRESCRIBING PENALTIES FOR THE VIOLATION OF SAME; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY," WHICH ORDINANCE WAS PASSED BY THE CITY COUNCIL OF THE CITY OF AUSTIN MAY 6, 1937, AND IS RECORDED IN ORDINANCE BOOK "K", PAGES 159-179, IN- CLUSIVE, OF THE ORDINANCE RECORDS OF THE CITY OF AUSTIN, BY AMENDING SECTION 23(d) OF ARTICLE IV RELATING TO LOADING ZONE LOCATIONS; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY, The ordinance was read the first time and Councilman MacCorkle moved that the rule be suspended and the ordinance passed to the second reading. HILL LEAGUE, IN TRAVIS COUNTY, TEXAS, WHICH SAID ADDITIONAL TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF THE CITY OF AUSTIN, IN THE PARTICULARS STATED IN THE ORDINANCE. Councilman Drake moved that the ordinance be finally passed. The motion carried by the following vote: CITY OF AUSTIN, TEXAS 303 Ayes: Councilmen Drake, Johnson, Long, MacCorkle, Mayor Glass Noes: None A discussion of the reduction in water rates for the summer was held, and it was decided by the Council to accept the recommendation of the City Manager and not grant a reduction in the water rates, as at peak loads the isolated sections will have trouble getting water pressure; and also the reduction in rates would not be good economics at this time. Councilman A discussion of the zoning of part of the Butler tract was held, MacCorkle moved that this request of the Planning Board be referred to the Zoning Board for complete study and recommendation: The motion carried by the following vote: Ayes: Councilmen Drake, Johnson, Long, MacCorkle, Mayor Glass Noes: None The Council briefly discussed the matter of filing fees on applications for change of zoning. The City Manager was instructed to make a study of this and to ask the Planning Board for a recommendation, and to secure additional information from cities charging filing fees, and to report to the Council. The application for Beer and Wine Permit for A.E. Spier was submitted to the Council with the recommendation that it be not granted. Councilman Long moved that the Council follow the recommendation of the City Manager and table this application.
