Whereupon the bids were referred to the Finance Director for tabulation and report. The ordinance closing an alley in the property of the PRESBYTERIAN SEMINARY between West 27th and West 29th Streets and Speedway and Whitis, was brought up fordiscussion before its second reading. Action on the second and final reading of this ordinance was deferred pending a meeting between the representatives of the Austin Presbyterian Theological Seminary and the officials of the City of Austin. DR. EVERETT GIVENS was the spokesman for a group with a representative from the Baptist Ministerial Union, Inter-denominanal Alliance, Tillotson College, Sam Huston College, Anderson High School, Blackshear, Rosewood School, and the P.T.A., expressing appreciation for the work done at Downs Field, and asking for the following: (1) Playgrounds in West Austin and South Austin in the colored districts. (2) If playgrounds could not be set up, have playground equipment placed on the schoolgrounds in those sections, and to have this done before the summer is over, if possible. (3) More fire-plugs in East Austin from Chicon east, as there is quite a number of new homes being constructed, and the builders would like to obtain FHA loans. (4) Better maintenance of streets. It was (5) A request that the City Council not enlarge the Incinerator, as there is a school and stadium just across the street; their new high school is to be built within two blocks from the Incinerator. also requested that shrubbery be placed around the incinerator to help in appearance; but the group preferred that the Incinerator be moved farther out. (6) Privilege to take the examination for firemen, and to man the fire station that is to be built in East Austin; and also to integrate negro firemen in the Lydia Street Fire Station. (7) More swimming pools for the colored people. The Council received these requests and the petition and held a general discussion on the various items. The City Manager was instructed to look into the possibility of placing a fence and shrubs around the Incinerator. It was discussed as to whether or not the city could secure playground property in south Austin, or if it should equip the school grounds with playground equipment. CITY OF AUSTIN, TEXAS 310 Councilman Long offered the following resolution and moved its adoption: (RESOLUTION) WHEREAS, the Southwestern Bell Telephone Company has presented to the City Council tentative maps or plans showing the proposed construction of its underground telephone conduit in the streets in the City of Austin hereafter named, and said maps or plans have been considered by the Director of Public Works; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the Southwestem Bell Telephone Company be and the same is hereby permitted to construct its underground telephone conduit in the following streets: (1) An underground telephone conduit in WEST 24th STREET across Lamar Boulevard intersection, the centerline of which underground telephone conduit shall be 21 feet north of and parallel to the centerline of West 24th Street. THAT the work and construction of said underground telephone conduit, including the excavation of the streets and the restoration and maintenance of said streets after said underground telephone conduit has been constructed, shall be under the supervision and direction of the City Manager and in accordance with the ordinances and regulations of the City of Austin governing such construction. The motion carried by the following vote: Ayes: Councilmen Drake, Johnson, Long, MacCorkle, Mayor Glass Noes: None Councilman Johnson offered the following resolution and moved its adoption: (RESOLUTION) BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: THAT the City Council of the City of Austin hereby approves as a filling station site the property located at the northwest intersection of East ist Street and Chalmers Avenue, which property fronts 120 feet on East 1st Street and 100 feet on Chalmers Avenue and is known as a portion of Block 3, Outlot 21, Division 0, of the Government Outlots adjoining the Original City of Austin, Travis County, Texas, and hereby authorizes the said Texas Company to construct, maintain and operate a drive-in gasoline filling station and to Construct curbs, ramps and sidewalks in conjunction therewith, subject to the same being constructed in compliance with all the ordinances relating thereto, and further subject to the foregoing attached recommendations and plans; and the Building Inspector is hereby authorized to issue an occupancy permit for the operation of this filling station after full compliance with all the provisions of this resolution, and said permission shall be held to be granted and accepted subject to all necessary, reasonable and proper, present and future regulations and ordinances of the City of Austin, Texas, in the enforcement of the proper police, traffic and fire regulations; and the right of CITY OF AUSTIN, TEXAS 311 revocation is retained, if, after hearing, it is found by the City Council that the said Texas Company has failed and refused, and will continue to fail and refuse to perform any such conditions, regulations and ordinances. ROSSON came before the Council in the interest of a Youth Program, and outline of which he left with the Council for study until the next regular meeting. Mr. Rosson stated he would be present at the next meeting to further discuss this program. A MR. JOHNSON who lives just east of Zaragosa Park came before the Council complaining of the drainage that comes from the two swimming pools. He stated ordinarilly the water from the swimming pools was all right as they drained them; but this past week, there was some other water perhaps from a shower drain or broken sewer pipe that was draining into this open ditch, and this water was detrimental to his livestock and bees. The City Manager was instructed to investigate this trouble. MR. JOHNSON stated that a few years back, the Recreation Department had promised to build a fence around the park to keep the children from his property; but as yet, this fence was not there. The City Manager was instructed to investigate the possibility of building a fence around these parks. The City Manager submitted to the Council the question of establishing certain speed limits on Highway 290, being East 7th Street; Highway 29, being the Burnet Road; Highways 81 and 79, being the Georgetown Road; and Highway 81, being the Post Road. He stated the Highway Department would have to concur in these different rates of speeds; and if the Highway Department did agree, the Council could then pass the necessary regulations. Councilman Drake moved that the City Manager present this matter to the State Highway Department. After hearing the appeal, it was the sense of the Council that due to his criminal record his application should be denied. TORREZ for change of zoning, realized the fact that there were many non-conforming uses in this neighborhood. No one appeared in protest of the change, and the Council was in receipt of a petition from a number of property owners in favor of the change of zoning to commercial. Councilman Drake moved that the application be referred again to the Zoning Board of Adjustment for further study to determine if there was a need for commercializing this whole area and if it could be made into a community center. C. MCCLURE, LEM SCARBROUGH, M. H. CROCKETT, JAC L. GUBBELS AND JACK H. KEY, was resumed. The Council felt that the strip of land remaining between the boulevard and these property owners should be disposed of, first, before any zoning changes should be made. At the Council meeting of June 2, 1949, the Council had stated to the applicants that they would be notified of the decision at the next meeting, and the City Manager was instructed to write to each of the applicants and inform them of this decision of disposing of this little strip of land before making any changes in zoning. 6. CITY OF AUSTIN, TEXAS 320 Mr. S. C. MCINTOSH and MR. H. M. WEBB came before the Council regarding the set-back of their property on East 7th Street, east of Allen. From a study of the maps, it was decided they would have no set-back on their property. The matter of the drainage ditch was referred to the Director of Public Works. Councilman Long moved that a public hearing be held on the 25-foot set-back on East Avenue on June 23rd at 2:30 P.M. The motion carried by the following vote: Ayes: Councilmen Drake, Johnson, Long, MacCorkle, Mayor Glass Noes: None The question of exchanging certain park land for the site that Polio, Incorporated, has now, was discussed briefly. Further discussion will be held at a later Council meeting. The Council discussed the matter of selling a certain amount of land in the LAKE AUSTIN METROPOLITAN PARK to some developers. The City Attorney offered an opinion that the Council was without authority to sell any part of this property, as it had never been abandoned as a park, and had been improved for park purposes and was being used as such. Any part that was unimproved was set aside in an agreement for the purpose of attracting wild life. The City Manager stated that in cases where there was excess property for park purposes, that the excess could be sold as it had been done in the past. The Council referred the matter to the City Attorney to advise the attorneys for the proposed developers. The City Manager submitted the proposition of purchasing certain land from the Missouri Pacific Railroad. The Land Board appraised the land at $29,560.00; it was set up in the budget for $30,000; and the Missouri Pacific had set a price of $33,500. The City Manager recommended that the Council authorize the purchase for $33,500 for the reason it has to go through the Trustees and Federal Court in St. Louis, and that this property is essential for the expansion of the Power Plant. Councilman Long moved that the Council accept the recommendation of the City Manager and authorize the purchase of ttis land for $33.500. The motion carried by the following vote: Ayes: Councilmen Drake, Johnson, Long, MacCorkle, Mayor Glass Noes: None The City Manager suggested that the NATIONAL CITY BANK, New York, be left as the paying agent for these bonds sold today; and possibly a different paying agent could be considered on the $7,000,000 issue.
