Thorp, Chief of Po- The Minutes of the previous meeting were approved as written, upon motion of Councilman Johnson, seconded by Councilman Long, by the following vote: None Ayes: Councilmen Drake, Johnson, Long, Mayor Glass Noes: Absent: Councilman MacCorkle REV. A. O. RAST, 3105 French Place, Field Secretary of Missions for the Texas District of the Luthern Church appeared before the Council in the interest of getting the church property where he lives placed on the tax exemption list, as his home is used as an office and meeting place for the different churches in his district. The City Attorney stated the law on this covered the church property and home for a minister of that particular congregation, and that property was limited to one acre; and that the property must be used as an actual place of worship or school. Councilman Drake suggested that there be no discrepancies and that all cases be handled on the same basis. Councilman Drake then moved that a survey be made of all church and educational property with a view of determining from a simple questionnaire as to what the status of the property is, who owns it, who occupies it, and how it is used, and that this questionnaire be answered by a person in authority of the property; and that this information be placed in the records of the Tax Office, and exemptions allowed or disallowed on the basis of thisinformation. Councilman Johnson seconded the motion, and it carried by the following vote: 676 CITY OF AUSTIN, TEXAS 696 Ayes: Councilmen Drake, Johnson, Long, Mayor Glass Noes: None Absent: Councilman MacCorkle With reference to the property at 3105 French Place, it was stated that this would be held in abeyance until the survey was completed, and it was hoped it could be completed by February. MR. KENNETH DAVIS appeared before the Council reviewing his claim for damages of his property at the Intersection of the Interregional Highway and Reinli and Clayton Lane. He stated he had asked for a zoning change on his property that would allow him to build to the property line, and the request never went through until all of the Highway was zoned, and it was included in that zoning providing a 25' set-back. This set-back, agreed to by him at the hearing, did eliminate three buildings on his property. He felt if the Council had accepted his zoning request to change his property so he could build on the property line, he would not have been damaged. The Mayor stated no promises had bee made regarding any zoning, and that t is property was already in a 25' set-back area; and that there was a thorough understanding at the time of the zoning to commercial, that there would be this 25 set-back. The City Manager stated there was no legal obligation on the part of the City; that Mr. Davis had agreed to that, but that Mr. Davis felt that a personal consideration should be made on his claim. He set about $700.00 as his claim. Councilman Drake moved that no damages be allowed on the request of Mr. Davis as there was no legal obligation on the part of the City. The motion, seconded by Councilman Long, carried by the following vote: Ayes: Councilmen Drake, Johnson, Long, Mayor Glass Noes: None Absent: Councilman MacCorkle MR. JESS AKIN appeared before the City Council inquiring about his permit for a filling station at Wilshire Boulevard and Airport Boulevard. The Council advised him all details had not been worked out completely; and at this meeting, it was not in resolution form to be acted upon. MR. RICKEY KEY, in behalf of the Austin Real Estate Board, invited the City Council to be present at the Annual Banquet honoring the Most Worthy Citizen for 1949 and the nominees, at the Austin Hotel, at 7:00P.M., January 10, 1950. JESSIE DAVID PHELAN appeared before the Council regarding the denial of his application to drive a taxi-cab. Said gas main described above shall have a cover of notless than 2 feet. The Southern Union Gas Company is hereby put upon notice that the City of Austin does not guarantee that the space assigned above is clear from other underground utilities, but is based upon the best records we have at hand, and that the minimum depth stated does not have any reference to the fact that greater depths may not be required at special points. When the Southern Union Gas Company requires definite information upon the ground as to elevations or working points from which to base the location of their assignments, they shall apply to the Department of Public Works not less than three (3) days Before such information is required. The Southern Union Gas Company is further put upon notice that they will be required to bear the expense of repairs or replacement of any underground utility damaged during the construction of lines named in this resolution. 705 CITY OF AUSTIN, TEXAS 705 AND THAT whenever pavement is cut in the vicinity of a fire plub, water must be used at intervals during the course of backfilling of the ditches. (Copy of contract attached) "THE STATE OF TEXAS COUNTY OF TRAVIS a This contract made and entered into by and between the City of Austin municipal corporation situated in Travis County, Texas, hereinafter for convenience sometimes called the City, and St. Edward's University, a corporation or- ganized and existing under and by virtue of the laws of the State of Texas with its home office in the City of Austin, Travis County, Texas, hereinafter for convenience sometimes called the University; WITNESSETH: I. The City of Austin, for the consideration hereinafter stated, agrees to supply to the University on its lands situated within and immediately without the southern corporaté limits of the City of Austin refuse and garbage materials gathered by the City of Austin from domestic, commercial, and other sources, for the purpose of enabling the University to compound, create and manufacture compost for fertilizer and other useful purposes; and the University agrees to 706 CITY OF AUSTIN, TEXAS 706 accept such refuse and garbage materials and to use the same in the compounding, creation, and manufacture of such compost. Refuse materials are defined as (1) ordinary city garbage and (2) wet sludge in quantities needed (approximately 10,000 gallons daily), this sludge being excess activated sludge (about 99% water), such sludge to be furnished at the City Sewage Treatment Plant. Other refuse materials will be delivered by the City. II. The term of this agreement shall be for a period of five (5) years, beginning on the 1st day of January, 1950, and terminating on the 31st day of Decem- ber, 1955, and the University shall have the option upon written notice to the City of Austin not less than six (6) months prior to the termination of said five-year period to extend the term of this agreement for an additional period of five (5) years beginning with the termination of the first five-year period. III. The consideration moving to the City of Austin under this agreement is that the University agrees to accept all refuse and garbage materials supplied by the City of Austin with the understanding that such arrangement will enable the City of Austin to dispose of such materials without the necessity of maintaining a public dump or disposing of such materials through incinerator processes. IV. For the period of this contract the City of Austin agrees to furnish men and machinery necessary to bury and cover with soil such garbage materials on University lands. MR. PAT J. MENDEZ appeared asking if storm sewers in the area east of Canadian Street had been in- cluded in the budget, as they had been requested a number of times. The City Manager stated there was nothing for this particular area; and that this request had been estimated by the Public Works Department at about $20,000. He stated there were from $800,000 to $900,000 of priority work scheduled and about a million and a half dollars of work desired. He stated if there were some changes in prices next year there might be a possibility of doing some of this work in this area, and to keep it in mind during the year. COUNCILMAN LONG suggested that the Council try to get more paving done; and if there were a surplus of money later on in the year, to try to use it to speed the paving programs along. She suggested using a part of the reserve of the Water and Light Department on paving. After a discussion of the needs of Austin in other facilities, it was decided to wait until later in the year to see how the paving works out. This was an application to drive a taxi-cab, and this had been denied by the Council at the regular meeting of December 15. The Mayor stated most of the charges against this young man were filed when he was a juvenile, and he would like to recommend that the Council reconsider this application and grant it, and give the young man an opportunity. Councilman Long moved that the Council grant ROGER DALE HOVIS a 90-day probation permit, with the provision that he report to the Chief of Police about every two weeks.
