Levander, Director of Public Works. Councilman Johnson moved that the Minutes of the previous meeting be approved. BAUMGARDNER, 2614 South 2nd Street, Oakridge Addition in South Austin, presented a petition asking the City to open Cumberland Road between Wilson and Lamesa Drive, thereby giving the petitioners direct access to South Congress and eliminating the use of South lst by giving them a better route to downtown Austin. The Mayor stated this matter would be reported on next week. MR. EDWARD LATOUF, submitted a petition asking the City not to open up 43rd and Clarkson on to the Interregional Highway. The City Manager stated there were requests from the people north to open it in order that they might get on to the expressway, and that the City had the right-of-way. Councilman Long wanted the names of those who had requested opening the street. The Mayor stated the Council should look at this area. CITY OF AUSTIN. Kitchens is the Contractor for the alteration of a building located at 710 Brazos Street and desires a portion of the sidewalk and street space abutting Lots 8, 9, and 10, Block 84, of the Original City of Austin, Travis County, Texas, during the alteration of the building, such space to be used in the work and for the storage of materials therefor; therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN: 1. THAT space for the uses hereinabove enumerated be granted to said Rex D. Kitchens, the boundary of which is described as follows: Sidewalk and Street Working Spaces Beginning at the northeast corner of the above described property; thence in an easterly direction and at right angles to the centerline of Brazos Street to a point 12 feet east of the west curb line; thence in a southerly direction and parallel to the centerline of Brazos Street approximately 104 feet to a point; thence in a westerly direction and at right angles to the centerline of Brazos Street to the southeast corner of the above described property. 2. THAT the above privileges and allotment of space are granted to the said Rex D. Kitchens, hereinafter termed "Contractor", upon the following express terms and conditions: (1). That the Contractor shall construct a four-foot walkway within the outer boundaries of the above described working space, such walkway to be protected on each side by a guard rail at least 4 feet high and substantially braced and anchored, and without wood strips or obstructions of any kind along 359 359 CITY OF AUSTIN, TEXAS the pavement within the walkway, and at any time in the opinion of the City officials it becomes necessary for any reason to install a board floor within the walkway, the Contractor shall upon notice from the Building Inspector immediately place such a wood floor and substantially suppor t same to prevent sagging under load. (2). That the Contractor is permitted to construct in his working space a substantial gate which shall be kept closed at all times when not in use, and at all times that such gate is open, the Contractor shall maintain a person at this gate to warn pedestrians and vehicles of approaching trucks. This gate is not to open out so as to impede vehicülar or pedestrian traffic. (3). That no vehicles in loading or unloading material at the working space shall park on any part of the street outside of the allotted working space. (4). That "NO PARKING" signs shall be placed on the street side of the barricades. (5). That the Contractor is permitted to construct a temporary work office within such allotted working space provided such work office is not within 25 feet of any corner street intersection. (6). That the Contractor shall in no way obstruct any fire plugs or other public utilities in the construction of such barricades. (7). That provisions shall be made for the normal flow of all storm waters in the gutter and the Contractor will be responsible for any damage done due to obstruction of any such storm water. (8). That the Contractor shall place on the outside corners of any walkway, barricades or obstructions, red lights during all periods of darkness and provide lighting system for all tunnels. (9). That the Contractor shall remove all fences, barricades, loose materials and other obstructions on the sidewalk and street immediately after the necessity for theêr existence on said sidewalk or street has ceased, such time to be determined by the City Manager, and in any event all such sidewalk, barricades, materials, equipment and other obstructions shall be removed not later than November 1, 1953. 1 (10). That the City reserves the right to revoke at any time any and all the privileges herein grante dor to require the erection or installation of additional barriers or safeguards if the conditions demand it. (11). That the use and enjoyment of the spaces herein granted shall not be exclusive as against public needs, and the City, in making such grant reserves the right to enter and occupy any part or all of said space any time with its public utilities, or for other necessary public purposes. (12). That any public utility, or public or private property, disturbed or injured as a result of any of the activities, necessary for the completion of the construction work for said building projects, whether done by the Contractor, City forces, or public utilities, shall be replaced or repaired at the Contractor's expense. (13). That the Contractor shall furnish the City of Austin a surety bond CITY OF AUSTIN, TEXAS 360 360 in the sum of Five Thousand Dollars ($5,000.00), which shall protect, indemnify and hold harmless the City of Austin from any claims or damages to any person or property that may accrue to or be brought by any person by reason of the exercise or abuse of the privileges granted the Contractor by the City of Austin and shall guarantee the replacement of all sidewalks, pavement and all other public property and public utilities disturbed or removed during the construction work and shall further guarantee the construction of a walkway and other safeguards during the occupancy of the space. JOHN WOLFF, 1411 Redd Street, stated the City was digging a ditch three and one-half and four feet deep in front of their property. She stated the children could not play in the front yard. She asked that the City put in pipe and close up the ditch. The Director of Public Works stated the ditch was not completed as yet. Everytime it rains the whole area is flooded, and this open ditch was the means of relieving those people in that area. He stated to do it in another manner ran in to quite a bit of money. The Mayor asked him if he would bring an estimate to the Council next week of the cost of putting in pipe for this drainage correction. MRS. JOHN CORDELL, on Goodwin Avenue, complained about not having any water; that when it rained, their yards were flooded. This is in an unrecorded subdivision. The City Manager explained it was in a bad condition; that the subdivision was turned down because no provision for drainage had been made; and that under state law the City is not permitted to run water into an unapproved subdivision. The City Manager had the file on this area, the City Attorney's report; report from the Utilities Department. He stated the houses were substandard; this was territory recently annexed. The Mayor stated to Mrs. Cordell that something would have to be worked out in this area. MR. M. H. CROCKETT reported to the Council that the zoning application for his son on the Manor Road from "A" Residence to "C" Commercial had been postponed in the Plan Commission, and he asked the Council to pass on it. He stated he always had delays in his requests. The City Manager had the file on this brought down. The Plan Commission wanted to make further study of this area. Discussion of the extension of Sheridan Avenue was held. No action was taken by the Council on this Matter. (This is the application listed as 1000 & 1100 Blocks U.S.Highway 290 or Texas State Highway 20) MR. R. E. HARDIN, 1411 Arcadia, stated he had had a petition for paving in since 1950. Some of the residents tried to go into the voluntary paving program, but some did not want that; hence it would be necessary to go on in the assessment plan. The petition is still active, but it was his understanding no money had been appropriated for a paving program at this time. The Mayor explained that after it was determined what the Interregional Highway would amount to; and if there is any money left over, the paving program would be started. 367 367 CITY OF AUSTIN, TEXAS As to the action on the request of the Texas Fine Arts Association, the Mayor stated there was a general agreement of all to postpone this at this time as there were some other ideas in the making. The City Manager reported on a request made the previous week for fire plugs in the area of 3206 East 14 Street, stating a work order had been issued to place fire hydrants on Tilley at 14½ Street and on Tilley at 17th. The City Manager stated that MR. V. L. MIKE MAHONEY from Tuscon, Arizona, had accepted the position of Planning Engineer and would report here on June 1st. He stated he was a Civil Engineer graduate of New Mexico, native of Arizona, and had done graduate work in Planning in the University of Texas and in Oklahoma. 368 368 CITY OF AUSTIN, TEXAS Councilman Long listed the following complaints she had received: (1) MRS. W. J. CLOER, Kinney Avenue, stated the asphalt sprinkling seemed to be too weak to do any good on this heavily travelled street, as this is on the bus route. Councilman Long inquired if the asphalt sprinkling were of lesser content this year than last, as there were several complaints. The Director of Public Works stated it was the same as last year; that the rains would ruin it if it did not have time to settle. Councilman Long asked if he would check Kinney Avenue in this respect. (2) MR. F. F. KUTZSCHBACH, 1916 E. 1lth, reported this street very dusty and needed repair. (3) MR. J. W. WILEY, 1200 Marcey & Hanks Avenue in Banister Acres, asked that a street be cut through. She stated he was an invalid with hayfever, and the dust was troubling him. (4) MRS. O. G. HUMPHRIES, Romeria Drive, asked that the City not nemove the culvert it has placed temporarily at Arroya Seca. She wanted her request in before the City removed the culvert. (5) MRS. W. A. REED, 1170 Walnut Avenue, has asked for street repairs and street lights. (6) MR. H. E. TOWERY, Sunshine Drive asked that this street be given the emulsion treatment. It is on a bus route. Councilman White inquired about the steel for the bridge. The City Manager reported the steel was ready, but at this time the ramp is being prepared by Mr. Raymond Canion, and it should be about ready in another week.
