663 663 CITY OF AUSTIN, TEXAS MINUTES OF THE CITY COUNCIL CITY OF AUSTIN, TEXAS Meeting of the City Council and the Subdivision Committee August 18, 1953 2:00 Ρ. Μ. The meeting was called to order with Mayor McAden presiding. Roll Call: Present: Councilmen Long, Pearson, Thompson, White, Mayor McAden Absent: None Present also: Mr. Walter E. Seaholm, City Manager; Mr. W. T. Williams, Jr., City Attorney; Mr. C. G. Levander, Director of Public Works; Mr. Noble Latson, Assistant Director of Public Works; and Mr. Mike Mahoney, Plänning Engineer. Present also Members of the Subdivision Committee: Messrs. Howard Kuhlman, Martin Kermacy, C. A. Dye, Tom Graham, Treeman E. O'Quinn, Travis Howard, Clyde Cppus, Bill Bullard, Frank Montgomery, A. B. Beddow, Farren McNamara, and Mrs. Frederick Meyers. MR. TOM GRAHAM wanted to know what the city's fiscal policy would be, and he thought this was the most important issue, as none of the subdividers were against paving, although a different type of paving would have to be decided upon and they did not believe the heavy type should be used outside the city. MR. COPUS asked that only the paving part be considered, and the other items of the ordinance be studied for another 60 or 90 days. Discussion of Section 31 was held, as respects to the plats being approved by the City Council and still comply with the State Statute, Article 974-A. It was agreed that the wording be changed and that the Planning Commission would disapprove a plat subject to approval of the City Council on the utility contracts; then approval by the Planning Commission would be automatic. Councilman Long felt that any appeal should be made to the Council. The following subcommittee was appointed to study this phase of the ordinance together with add- ing that "Any such appeal shall be governed by TRIAL DE NOVO", and that the appeal would be within 30 days rather than 10 days. (SECTION 31) COUNCILMAN LỒNG MR. TRUEMAN E. O'QUINN MRS W. T. WILLIAMS, JR. Councilman Thompson outlined the main items which the Planning Commission felt should be ironed out: (1) Fiscal policy of the City; (2) Method of insuring and carrying out of the preliminary plan; (3) standards of paving; (4) area outside of the City limits. CITY OF AUSTIN, TEXAS 664 664 MR. MARTIN KERMACY explained a Variance Clause which was recommended to be included in SECTION 31. MR. TOM GRAHAM explained the recommendation of the Planning Commission pertaining to a fiscal policy which would help subdividers develop on the outside of the City limits. MR. W. T. WILLIAMS, JR., suggested that there be a classification of subdivisions geographically or by character and that different regulations be made applicable to the different kinds of subdivisions. A sub-committee as followsn was named to study this aspect of the ordinance: MR. MARTIN KERMACY MR. BILL BULLARD MR. W. T. WILLIAMS, JR. MR. MIKE MAHONEY Councilman White suggested the committee all get together and come to the Council with its final decision to be worked out with the Council. Councilman Pearson suggested in this study that the variences be pine pointed as to what to vary on. He favored strict definitions, that would remove fear from the subdivider that possibly one developer could sell the Com- mission one idea and another might not. With regard to paving, the Mayor stated he had information from four contractors giving paving costs from $3.28 down to $3.00. One contractor suggested a five-year maintenance bond and another suggested laboratory tests. The City Manager explained the five-year maintenance bond would apply when specifications other than those set by the city were used. The following subcommittee was appointed to study paving specifications: MRS FREDERICK MEYERS, CHAIRMAN MR. TOM GRAHAM MR. CLYDE COPUS MR. A. B. BEDDOW MR. NOBLE LATSON MR. HOWARD KUHLMAN was appointed Chairman of the Subdivision Committee. MR. KUHHMAN then called a meeting of the general Committee for Friday, August 21st, at 2:00 P. M. in the Council Chamber. DR. WUPPERMAN asked that after the Committee had met and worked out something workable, thathit be publicized so that everybody would know what was being done. MAYOR MCADEN recommended that the subcommittees work on their particular phases and report back, and that the entire Committee and MR. MAHONEY and MR, WILLIAMS be ready to meet at the call of the Council, but that the call would not be less than seven days. The Council adjourned subject to the call of the Mayor.
